HEY, THIS APPLICATION SUBMITTED BY THE LAFAYETTE GUN CLUB IS A REQUEST FOR A SPECIAL USE PERMIT TO ESTABLISH AN INDOOR FIRING RANGE AT 3 31 DARE ROAD.

DURING THE DECEMBER PLANNING COMMISSION MEETING, THE COMMISSION VOTED TO CONTINUE THIS APPLICATION TO TODAY'S MEETING.

SUBJECT PROPERTY IS 26.3 ACRES IN SIZE.

A MAJORITY OF THE SUBJECT PARCEL IS ZONED RESOURCE CONSERVATION OR RC, UH, WITH A 10TH OF AN ACRE PORTION LOCATED AT THE ENTRANCE OF THE PROPERTY.

ZONED MEDIUM DENSITY SINGLE FAMILY RESIDENTIAL OR R 20.

THE ENTIRE PARCEL IS DESIGNATED MEDIUM DENSITY RESIDENTIAL IN THE COMPREHENSIVE PLAN.

THE SUBJECT PARCEL IS BOUNDED TO THE EAST BY BRANDYWINE HOUSING SUBDIVISION AND A PORTION OF THE LAKE OWNED BY THE BRANDYWINE LAKE OWNERS ASSOCIATION, WHICH ARE ZONED.

R 20 TO THE SOUTH IS KOHL'S HORSE AUTISM THERAPY STATION, OTHERWISE KNOWN AS CHATS AND PENINSULA HARDWOOD MULCH.

BOTH ZONED RC TO THE WEST IS A SINGLE FAMILY DWELLING.

JACOB SPRINGS HOUSING SUBDIVISION AND LAKESIDE BAPTIST CHURCH, WHICH ARE ALL ZONED R 20 AND TO THE NORTH ARE THREE SINGLE FAMILY DWELLINGS, WHICH ARE ALSO ZONED R 20 ACCORDING TO PROPERTY RECORDS.

EXISTING DEVELOPMENT ON THIS PARCEL INCLUDES A CLUBHOUSE, AN INDOOR FIRING RANGE, OUTDOOR FIRING RANGES, AND AN, UH, OUTDOOR SHOTGUN RANGE.

THE APPLICANT IS SEEKING AUTHORIZATION TO ESTABLISH A NEW APPROXIMATELY 12,600 SQUARE FOOT INDOOR FIRING RANGE ON THEIR PROPERTY.

ACCORDING TO SECTION 24.1 DASH 3 0 6, CATEGORY NINE.

NUMBER SEVEN, INDOOR FIRING RANGES ARE PERMITTED IN THE RC ZONING DISTRICT BY SPECIAL USE PERMIT.

THE NEW INDOOR BUILDING WILL BE LOCATED WHERE THE CURRENT SHOTGUN RANGE IS AND THE SHOTGUN RANGE WILL SHIFT APPROXIMATELY 150 FEET SOUTH.

SECTION 24.1 DASH 4 57 ESTABLISHES PERFORMANCE STANDARDS FOR FIRING

RANGES.

SECTION 24.1 DASH 4 57 A STATES, WITH THE EXCEPTION OF PAINTBALL RANGES ONLY COMPLETELY ENCLOSED INDOOR FIRING RANGES ARE PERMITTED.

THE APPLICANT PROPOSES ESTABLISHING A NEW COMPLETELY ENCLOSED INDOOR FIRING RANGE, WHICH MEETS THE STANDARD.

THE SUBJECT PARCEL CONTAINS SEVERAL OUTDOOR FIRING RANGES, WHICH WERE BUILT IN 1950.

YOUR COUNTY'S FIRST ZONING ORDINANCE WAS ADOPTED IN 1957.

THEREFORE, THE EXISTING OUTDOOR FIRING RANGES ON THE SUBJECT PARCEL ARE CONSIDERED A LEGALLY NON-CONFORMING USE AND ARE ALLOWED TO CONTINUE.

ANY NEW LAND USED ESTABLISHED ON THE SUBJECT PARCEL MUST COMPLY WITH THE REGULATIONS OF THE ZONING ORDINANCE.

SECTION 24.1 DASH 4 57 B STATES NO STRUCTURE EXCEPT SCREENING FENCES AND IDENTIFICATION SIGNS USED FOR FIRING RANGES SHALL BE LOCATED CLOSER THAN 100 FEET TO ANY RESIDENTIAL LOT LINE.

THE NEW INDOOR, UH, RANGE WOULD BE APPROXIMATELY 134 FEET FROM THE NEAREST PROPERTY LINE ON PERLEY COURT AND APPROXIMATELY 225 FEET FROM THE HOLDEN LANE AREA.

THE APPLICATION MEETS THIS REQUIREMENT, SO SECTION 24.1 DASH 4 57 C OF THE ZONING ORDINANCE STATES THAT THE PROTECTION OF ADJACENT PROPERTIES SHALL BE ASSURED BY PROPERTY DESIGN, LOCATION, AND ORIENTATION OF STRUCTURES, BACKSTOPS AND FIRING LINES.

WHILE THIS STANDARD CANNOT BE APPLIED TO THE EXISTING LEGALLY NON-CONFORMING OUTDOOR SHOOTING RANGES, THE APPLICANT HAS TAKEN STEPS TO MITIGATE THE IMPACT OF THE OUTDOOR RANGES USING PHYSICAL FEATURES LIKE THE PROPOSED ADDITIONAL LANDSCAPING AND EXISTING EARTH AND BERMS. AS STATED IN THE APPLICANT'S NARRATIVE, WE PLAN TO, UH, INSTALL ADDITIONAL LANDSCAPE BUFFERING ARBOR AND LAG GURA FOR HOLDEN LANE, THE PRIMARY LINE OF SIGHT TO THE NEW INDOOR RANGE BUILDING.

THIS WOULD PROVIDE A VISUAL BLOCK RUNNING LATERALLY FROM THE EAST SIDE OF THE LAFAYETTE GUN CLUB'S MAIN GATE TO THE NORTHWEST CORNER OF THE CURRENT INDOOR RANGE.

ALONG PERLEY COURT, UH, LINE OF SIGHT, THE MAJORITY OF THE BUILDING WILL BE BLOCKED BY THE EXISTING WESTERN BERM AND TREES.

ADDITIONAL LANDSCAPE BUFFERING FOR PURLEY COURT WILL EXTEND FROM THE NORTH END OF THE EXISTING GRAVEL DRIVE TOWARDS THE WEST SIDE OF THE LAFAYETTE GUN CLUB'S MAIN GATE SECTION 24.1 DASH 4 57 D STATES THAT THE INDOOR RANGE SHALL BE DESIGNED SO THAT NO RANGE NOISE IS AUDIBLE AT THE PROPERTY.

LINE.

DOCUMENTATION CERTIFIED BY AN ARCHITECT AND PROFESSIONAL ENGINEER TO THIS EFFECT SHALL BE SUBMITTED WITH THE SITE AND BUILDING PLANS.

IF THE SPECIAL USE PERMIT IS APPROVED, THE APPLICANT WILL BE REQUIRED TO SUBMIT THE NECESSARY DOCUMENTATION FOR THE NEW INDOOR FIRING RANGE DURING THE SITE PLAN APPROVAL PROCESS.

HOWEVER, THE APPLICANT HAS OUTLINED IN THEIR NARRATIVE SOME OF THE MEASURES THEY'VE TAKEN TO MITIGATE NOISE.

ACCORDING TO THE APPLICANT'S NARRATIVE, THE NEW INDOOR FIRING RANGE WILL EMPLOY STATE-OF-THE-ART TWO STANDARD SOUNDPROOFING.

THE APPLICANT GOES ON TO SAY THE FIRING RANGE WILL BE FULLY ENVELOPED WITHIN AN AT LEAST EIGHT TO 10 INCH THICK CEMENT STRUCTURE.

EMPLOY ACOUSTIC PANELS THE ENVELOPED BY A WELL INSULATED BUILDING AND HAVE A MUCH LOWER SOUND SIGNATURE THAN THE CURRENT INDOOR RANGE.

THIS DOCUMENTATION IS NOT REQUIRED FOR THE EXISTING LEGALLY NON-CONFORMING INDOOR FIRING RANGE.

NEVERTHELESS, THE APPLICANT HAS TAKEN MEASURES TO REDUCE THE NOISE, UH, IMPACTS PRODUCED BY IT.

THE EXISTING INDOOR RANGE IS LOCATED APPROXIMATELY 83 FEET FROM THE PROPERTY LINE ADJACENT TO HOLDEN LANE.

AND THE, UH, APPLICANT STATED IN THEIR NARRATIVE THAT WHILE THEY PLAN TO RETAIN THE EXISTING INDOOR RANGE, THEY WOULD MOVE A MAJORITY OF THE ACTIVITY FROM THE EXISTING INDOOR RANGE TO THE NEW ONE.

ACTIVITY IN THE EXISTING INDOOR RANGE WOULD BE CURTAILED FROM THE MULTI CALIBER FACILITY TO A 22 RIM FIRE ONLY FACILITY.

THE ESTABLISHMENT OF THE NEW INDOOR FIRING RANGE WOULD REDUCE THE IMPACT OF NOISE ON THE CITIZENS OF HOLDEN LANE CLOSEST TO THE EXISTING INDOOR FIRING RANGE.

ACCORDING TO SECTION 24.1 DASH 4 57 E, IT SHALL BE THE PROPERTY OWNER OR LESSEE'S RESPONSIBILITY TO ENSURE THE FIRING RANGE IS MANAGED BY AN INDIVIDUAL CURRENTLY CERTIFIED TO PERFORM SUCH SUPERVISION AS A RANGE MASTER OR RANGE SAFETY OFFICER BY A FEDERAL, STATE, LOCAL, OR OTHER NATIONALLY RECOGNIZED CERTIFICATION.

THIS DOES NOT NEED TO BE SUBMITTED DURING THE SPECIAL USE PERMIT PROCESS, BUT WILL NEED TO BE PRESENTED DURING ANNUAL INSPECTIONS.

THE APPLICANT CONFIRMED VERBALLY THAT THEY CAN MEET THIS REQUIREMENT AND WILL BE AND WILL PRESENT THE DOCUMENTATION UPON REQUEST.

UH, THE LAFAYETTE GUN CLUB IS A PRIVATE ESTABLISHMENT SECURED BY A GATE AT THE ENTRANCE OF THE PROPERTY.

THE COUNTY'S DEPARTMENT OF FIRE AND LIFE SAFETY REVIEWED THE APPLICATION AND REQUESTED THAT THE APPLICANT INSTALL A NOX GATE SWITCH ON THE MAIN GATE TO ALLOW FIRE APPARATUS TO ENTER THE SITE FOR EMERGENCIES.

A CONDITION OF APPROVAL HAS BEEN PROPOSED THAT WOULD MAKE THIS A REQUIREMENT.

LETTERS WERE SENT TO ADJACENT PROPERTY OWNERS INFORMATION ABOUT THE APPLICATION WAS POSTED TO THE COUNTY'S WEBSITE AND EMAIL TO THOSE WHO WERE SIGNED UP TO RECEIVE NOTIFICATIONS AND A NOTICE SIGN WAS POSTED ON THE PROPERTY.

SINCE THE LAST PLANNING COMMISSION MEETING, STAFF RECEIVED SEVEN LETTER, I'M SORRY, NINE LETTERS OF SUPPORT AND ONE LETTER EXPRESSING CONCERN THAT THE OFFERS MADE BY THE APPLICANT AREN'T CODIFIED IN THE RESOLUTION AS CONDITIONS OF APPROVAL.

I EMAILED THESE LETTERS TO YOU EARLIER, UH, TODAY, AND I ALSO PRINTED AND

PLACED A COPY OF EACH, UH, FOR EACH OF YOU ON THE DAIS.

THE PROPOSED INDOOR FIRING RANGE MEETS THE PERFORMANCE STANDARDS OF THE YORK COUNTY CODE AND IS PROPOSED TO MOVE MOST ACTIVITY FROM THE EXISTING INDOOR RANGE TO AN IMPROVED MODERN AND SOUND ATTENUATE FACILITY.

THE NEW INDOOR RANGE WOULD BE AT LEAST, UH, WOULD BE 130 FEET FROM THE NEAREST PROPERTY LINE, UH, REDUCE EXISTING NOISE AND PROVIDE A BETTERMENT, UH, TO THE SURROUNDING COMMUNITY.

THEREFORE, STAFF RECOMMENDS APPROVAL OF THIS APPLICATION, SUBJECT TO THE CONDITION SET FORTH AND PROPOSED RESOLUTION NUMBER PC 25 DASH 26.

MY THOUGHT, MY COMMENTS TONIGHT ARE GONNA FOCUS ON THE RESPONSIBILITY OF YOU GUYS AND THE ZONING ORDINANCE DETERMINING WHETHER THIS SPECIAL USE PERMIT AS CURRENTLY PROFFERED, UH, ACTUALLY PROTECTS ADJACENT PROPERTIES AND PUBLIC WELFARE.

UH, THE PERMIT IS FOR RECREATION AND RECREATION SHOULD NEVER PUT SURROUNDING HOMES AND FAMILIES AT RISK.

UH, OVER THE PAST TWO YEARS, MULTIPLE POLICE REPORTS HAVE DOCUMENTED ESCAPES LANDING ON MY PROPERTIES AND MY NEIGHBOR'S PROPERTY.

THIS IS A RANGE EXPANSION AND IT WILL EXASPERATE THOSE EXISTING CONDITIONS.

THROUGH DISCUSSIONS WITH THE CLUB.

WE NOW UNDERSTAND THAT THE TWO MAIN CAUSES WAS LANE ZERO, THAT WAS THE CLOSEST TO BRANDYWINE AND ALSO THE USE OF THOSE METAL TARGETS.

THE CLUB HAS BEEN, UH, HAS TAKEN POSITIVE STEPS BY MOVING LANE ZERO AND STOPPING THE USE OF METAL TARGETS, AND I APPRECIATE THAT.

BUT THESE ACTIONS ARE NOT PROFFERED, WHICH MEANS THEY'RE NOT ENFORCEABLE.

VERBAL STATEMENTS AND INTENTIONS CAN CHANGE AT ANY TIME AND THE COUNTY CANNOT RELY ON THOSE AS CONDITIONS FOR A SPECIAL USE PERMIT.

WHILE MOST OF THOSE CLUB MEMBERS USE THE RANGE FOR A FEW HOURS A WEEK, OUR COMMUNITY IS EXPOSED TO IT 24 HOURS A DAY AT SEVEN DAYS A WEEK.

WE ARE THE ONES THAT HAVE THE BULLETS IN OUR YARDS AND THE SHRAPNEL ON OUR DECKS.

THIS RISK IS NOT THEORETICAL.

IT IS A LIVED EXPERIENCE.

NOW THAT THE COUNTY IS FULLY AWARE OF THOSE DOCUMENTED ESCAPES, THEN THE RISK TO LIFE AND PROPERTY AND THE POTENTIAL LEGAL LIABILITY, I BELIEVE THE FOCUS MUST SHIFT FROM RECREATION TO SAFETY.

THE ZONING ORDINANCE REQUIRES THAT SPECIAL USE PERMIT PROVIDES ADJACENT PROPERTY AND PUBLIC WELFARE.

THE STANDARD MUST BE MET BEFORE THE RECREATIONAL EXPANSION IS APPROVED.

APPLICATION NUMBER CP 11 DASH 26 IS A REQUEST TO AMEND CHARTING THE COURSE.

2024 YORK COUNTY'S COMPREHENSIVE PLAN BY ADDING PARCELS RECENTLY ADDED TO THE YORK COUNTY TO YORK COUNTY THROUGH A BOUNDARY LINE ADJUSTMENT BETWEEN YORK COUNTY AND THE CITY OF POCOS TO THE LAND.

USE 2040 MAP IN CHAPTER 11.

AND BY ASSIGNING THEM A FUTURE LAND USE DESIGNATION ON DECEMBER 19TH, 2023, THE BOARD OF SUPERVISORS APPROVED A RESOLUTION TO ADJUST AND RELOCATE THE COMMON BOUNDARY LINE BETWEEN THE TWO JURISDICTIONS.

THIS WAS DONE TO ELIMINATE UNCERTAINTY

AND CONFUSION IN REGARDS TO THE PHYSICAL LOCATION OF THE JURISDICTIONAL BOUNDARY.

FOLLOWING THE ADOPTION OF THE RESOLUTION, NEW LAND WAS ADDED TO THE COUNTY.

THE FIRST STEP AFTER ADDING NEW LAND TO THE COUNTY IS TO ADJUST THE COUNTY'S COMPREHENSIVE PLAN, CHARTING THE COURSE 2040 BY GIVING A FUTURE LAND USE DESIGNATION TO ALL AFFECTED PARCELS.

THIS 2040 UH, USE DESIGN, LAND USE DESIGNATION MAP SHOWS THE NEWLY ADDED LAND THAT DOESN'T HAVE A COLOR TO INDICATE ITS FUTURE LAND USE DESIGNATION.

THE CODE STATES THAT ANY LAND AREA ANNEXED OR ADJUSTED INTO THE JURISDICTIONAL BOUNDARIES OF YORK COUNTY SHALL AUTOMATICALLY BE CLASSIFIED RC FOR RESOURCE CONSERVATION UNTIL SUCH TIME AS THAT CLASSIFICATION MAY BE CHANGED THROUGH A SPECIFIC REZONING ACTION APPROVED BY THE BOARD OF SUPERVISORS.

ACCORDINGLY, THE COUNTY IS PROPOSING TO AMEND THE ZONING MAP BY RECLASSIFYING THESE PROPERTIES TO MATCH THE ADJACENT ZONING.

THIS APPLICATION ENCOMPASSES 27 PARCELS OF LAND WITH 18 PROPERTY OWNERS, ALL OF WHOM HAVE BEEN NOTIFIED DUE TO THE LAND'S PROXIMITY TO ADJOINING LOCALITIES.

NOTICES WERE ALSO SENT TO THE CITIES OF POCOS AND HAMPTON.

THE PROPOSED AMENDMENT TO THE COMPREHENSIVE PLAN WOULD AMEND THE LAND USE 2040 AND LAND USE 2040, UH, TAB SUBAR MAPS TO INCLUDE THE NEWLY ACQUIRED LAND AND ASSIGN IT A FUTURE LAND USE DESIGNATION.

FURTHERMORE, A NEW PARAGRAPH OUTLINING THE REASONING FOR THE AMENDMENT HAS BEEN PROPOSED FOR THE TAB EAST SECTION.

SO PRIOR TO THE EXECUTION OF THE BOUNDARY LINE ADJUSTMENT IN DECEMBER, 2023, THE MAJORITY OF THE AFFECTED PARCELS EXTENDED ACROSS THE BOUNDARY BETWEEN YORK COUNTY IN THE CITY OF POCOS.

AS A RESULT AND PURSUANT TO THE CODE, WHICH REQUIRES NEWLY INCORPORATED LAND TO BE AUTOMATICALLY CLASSIFIED AS RESOURCE CONSERVATION, WHICH IS SHOWN HERE IN GREEN, MOST OF THE EFFECTIVE PARCELS ARE CURRENTLY SPLIT ZONED.

UM, THE PROPOSED REZONINGS WOULD REMOVE THE EXISTING SPLIT ZONE CLASSIFICATIONS FOR ALL OF THESE PARCELS.

27, UH, PARCELS IN PART OR WHOLE.

AND A COMBINED AREA OF APPROXIMATELY 27 ACRES ARE PROPOSED TO BE REZONED PARCELS PREVIOUSLY DIVIDED BY THE JURISDICTIONAL BOUNDARY BETWEEN YORK COUNTY AND THE CITY OF THE COSAN WILL BE ASSIGNED A COMPREHENSIVE PLAN LAND USE DESIGNATION MATCHING THE PORTION OF THE PARCEL ALREADY LOCATED WITHIN THE COUNTY PARCELS ENTIRELY OUTSIDE OF THE COUNTY WILL BE ASSIGNED A COMPREHENSIVE PLAN LAND USE DESIGNATION MATCHING THE SURROUNDING PARCELS.

FOUR OF THE 27 PARCELS ARE CURRENTLY SPLIT ZONED AS RURAL RESIDENTIAL OR RR AND RESOURCE CONSERVATION OR RC AND ARE PROPOSED TO BE REZONED TO RR.

THREE OF THOSE FOUR PARCELS ARE PROPOSED TO BE DESIGNATED LOW DENSITY RESIDENTIAL IN THE COMPREHENSIVE PLAN.

AND THE FOURTH HAS PROPOSED TO BE DESIGNATED MEDIUM DENSITY RESIDENTIAL.

THE PROPERTY AT 100 KRINER LANE IS, UH, IS THE ONLY PARCEL THAT IS NOT PROPOSED TO BE REZONED IN CONFORMANCE WITH THE, UH, COMPREHENSIVE PLAN AT THE PROPERTY OWNER'S REQUEST.

STAFF PROPOSES TO REZONE THE PARCEL FROM RRR AND RC TO RR 18 PARCELS ARE SPLIT ZONED R 20 AND RC.

THEY'RE ALL PROPOSED TO BE REZONED TO R 20 AND DESIGNATED MEDIUM DENSITY.

IN THE COMPREHENSIVE PLAN.

THE REMAINING FIVE PARCELS ARE ZONED TO RC AS THEY WERE PREVIOUSLY OUTSIDE THE COUNTY'S JURISDICTIONAL BOUNDARIES.

ALL FIVE PARCELS ARE PROPOSED TO BE REZONED TO R 20 AND DESIGNATED MEDIUM DENSITY IN THE COMPREHENSIVE PLAN IN CONFORMITY WITH THE SURROUNDING PARCELS.

PROPOSED RESOLUTION, UH, NUMBERS P PC 26 DASH OH FOUR AND PC 26 DASH OH FIVE PROPOSED TO GIVE THE NEWLY ACQUIRED LAND A FUTURE LAND USE DESIGNATION, ELIMINATE SPLIT ZONING AND ALIGN ZONING CLASSIFICATIONS WITH A COMPREHENSIVE PLAN.

HOWEVER, IT HAS HISTORICALLY BEEN THE PRACTICE IN YORK COUNTY TO ZONE MOST PROPERTY FOR ITS INTENDED USE AS SET FORTH IN THE COMPREHENSIVE PLAN.

THIS IS BASED ON THE PRINCIPLE THAT PROPERTY OWNERS SHOULD NOT HAVE TO GO TO THE EFFORT AND EXPENSE OF APPLYING FOR A REZONING IN ORDER TO DEVELOP THEIR LAND IN ACCORDANCE TO THE COMPREHENSIVE PLAN.

THEREFORE, BASED ON THE CONSIDERATIONS AND CONCLUSIONS, AS NOTED, STAFF RECOMMENDS APPROVAL OF THE PROPOSED OF PROPOSED RESOLUTION NUMBERS PC 26 DASH OH FOUR AND PC 26 DASH OH FIVE.
