THE SUBJECT SITE IS LOCATED AT 3 25 YU ROAD ON THE CORNER OF YU ROAD AND MOTOWN ROAD.
THERE ARE FOUR SINGLE STORY BUILDINGS ON THE SUBJECT PROPERTY.
TWO BUILDINGS ARE USED FOR HOUSING RESIDENCE, WHICH ARE 3 25 DASH A YUE ROAD AND 3 25 DASH BU ROAD.
ONE BUILDING SERVES AS AN ADMINISTRATION AND COUNSELING OFFICE AND THE LAST BUILDING IS USED AS A CHAPEL AND FOR OTHER COMMUNAL ACTIVITIES.
THE SITE IS ZONED LIMITED INDUSTRIAL AND IS DESIGNATED LIMITED INDUSTRIAL IN THE COMPREHENSIVE PLAN.
THE SITE IS LOCATED ON MUELL ROAD AND ALTHOUGH IT IS ZONED IL, IT IS IN AN AREA WITH BOTH COMMERCIAL AND RESIDENTIAL USES.
NORTHWEST OF THE PROPERTY IS COLONIAL GARDENS LANDSCAPING COMPANY WITH TWO PARCELS, UM, THAT HAVE RESIDENTIAL HOUSING.
IL NORTHEAST IS COLLISION CORRECTION, WHICH IS A CAR COLLISION REPAIR FACILITY ZONED IL EAST IS AN UNDEVELOPED PROPERTY OWNED BY THE CITY OF WILLIAMSBURG, ZONED FOR RESOURCE CONSERVATION AND SOUTH IS COLONIAL CARTS A GOLF CART.
SALES AND REPAIR FACILITY ZONED IL WEST AND SOUTH WEST IN JAMES CITY COUNTY ARE SINGLE FAMILY HOME OWNED RURAL RESIDENTIAL OR R EIGHT.
UM, A BUSINESS CALLED FIVE BROTHERS LANDSCAPES AND THE WILLIAMSBURG JEHOVAH'S WITNESS KINGDOM HALL, BOTH ZONE LIMITED BUSINESS SLASH INDUSTRIAL.
SINCE 2023, THE APPLICANT HAS BEEN OPERATING TWO RECOVERY RESIDENCES ON THE PROPERTY.
THE BUILDING AT 3 25 DASH A U ROAD HAS SIX OCCUPANTS CURRENTLY AND THE BUILDING AT 3 25 DASH BU ROAD WITH EIGHT OCCUPANTS.
THE APPLICANT HAS STATED THAT BOTH BUILDINGS ARE LICENSED WITH THE VIRGINIA DEPARTMENT OF BEHAVIORAL HEALTH AND DEVELOPMENT SERVICES, OTHERWISE KNOWN AS D-B-H-D-S AS RECOVERY RESIDENCES THAT PROVIDE CASE MANAGEMENT AND COUNSELING TO THOSE LIVING IN THE HOMES.

THE APPLICANT HAS EXPRESSED THAT THERE HAS BEEN AN INCREASING NEED FOR SAFE HOUSING AND ADDICTION RECOVERY SERVICES.DUE TO THIS, THEY ARE REQUESTING THE BUILDING AT 3 25 DASH B YOU'LL ROAD TO HAVE AN INCREASE IN OCCUPANCY FROM EIGHT TO 13.
THE APPLICANT STATES THAT THERE IS ENOUGH ROOM IN THE RESIDENCE TO MEET THE D-B-H-D-S REQUIREMENT OF 50 SQUARE FEET OF BEDROOM SPACE PER RESIDENT TO BE ABLE TO ACCOMMODATE THE OCCUPANCY INCREASE.
AN ANALYSIS OF THE SUBMITTED FOUR PLAN CONFIRMS THAT THE 886 SQUARE FEET AVAILABLE FOR BEDROOM SPACE CAN ACCOMMODATE THE 13 RESIDENTS.
THE REQUEST FOR AN INCREASE IN OCCUPANCY WILL NOT CHANGE THE SURROUNDING AREA IN THEIR NARRATIVE.
THE APPLICANT STATED THAT DURING THE TWO YEARS THE RECOVERY PROGRAM HAS BEEN IN OPERATION, THERE HAS BEEN NO COMPLAINTS OR ISSUES WITH THE SURROUNDING PROPERTIES.
THE APPLICANT INDICATED THAT THE BUILDING AT 3 25 DASH B ROAD HAS SPACE TO ACCOMMODATE THE ADDITIONAL FIVE OCCUPANTS AND THUS PROPOSES NO CHANGES TO THE OUTSIDE OF THE BUILDING OR PROPERTY.
THEREFORE, THE SURROUNDING PROPERTIES WILL EXPERIENCE MINIMAL TO NO IMPACT FROM THIS INCREASE.
RECOVERY RESIDENCES ARE CONSIDERED GROUP HOMES AND VIRGINIA CODE GROUP HOMES OR A RESIDENTIAL FACILITY DESIGNED FOR THOSE.
RECOVERING FROM SUBSTANCE USE DISORDERS ARE REGULATED AS RECOVERY RESIDENCES AS DEFINED IN VIRGINIA CODE SECTION 37.2 DASH 4 31 0.1 A RECOVERY RESIDENCE IS A HOUSING FACILITY THAT PROVIDES ALCOHOL-FREE AND ILLICIT DRUG-FREE HOUSING TO INDIVIDUALS WITH SUBSTANCE ABUSE DISORDERS AND INDIVIDUALS WITH CO-OCCURRING MENTAL ISSUES AND SUBSTANCE ABUSE DISORDERS.
THAT DOES NOT INCLUDE CLINICAL TREATMENT SERVICES EXCLUDING CLINICAL COUNSELING.
KEY FEATURES OF RECOVERY RESIDENCES OR ALSO KNOWN AS SOBER LIVING HOMES, ARE THAT RESIDENTS MUST REMAIN ALCOHOL AND ILLICIT DRUG FREE.
THE RESIDENTS ARE MENTORED THROUGH A PEER-LED SUPPORT WITH STRUCTURAL ACCOUNTABILITY AND NO CLINICAL TREATMENT SERVICES PROVIDED ONSITE.
HOWEVER, THIS DOES EXCLUDE CLINICAL COUNSELING.
RECOVERY RESIDENCE IS ARE SUBJECT TO SECTION 24.1 DASH 4 0 8 OF THE ZONING ORDINANCE, WHICH ESTABLISHES PERFORMANCE STANDARDS FOR GROUP HOMES IN TRANSITIONAL HOMES.
THE SECTION STATES THAT THE MAXIMUM NUMBER OF PERSONS ACCOMMODATED IN ANY GROUP OR TRANSITIONAL HOME SHALL NOT EXCEED 12 EXCLUSIVE OF RE RESIDENT STAFF.
HOWEVER, THE BOARD MAY SPECIFY A GREATER OR LESSER NUMBER IN CONSIDERATION OF THE DENSITY, UM, AND CHARACTER OF THE SURROUNDING AREA AND THE CHARACTERISTICS OF THE SITE ITSELF.
THE APPLICANT HAS REQUESTED THROUGH THE SPECIAL USE PERMIT PROCESS TO EXCEED THE LIMIT AND PROPOSES A TOTAL OF 21 RESIDENTS.
THE DENSITY AND CHARACTER OF THE SURROUNDING AREA AS WELL AS THE CHARACTERISTICS OF THE SITE ITSELF LENDS VERY WELL TO THE USE.
THEREFORE, THE SUBJECT PROPERTY IS APPROPRIATE FOR THE PROPOSED INCREASE.
THE EXTERNAL APPEARANCE AND ARRANGEMENT OF SUCH FACILITY SHALL BE OF A FORM AND CHARACTER WHICH IS COMPATIBLE WITH THE APPEARANCE AND ARRANGEMENT OF OTHER RESIDENTIAL USES IN THE GENERAL AREA.
GIVEN THE VARIETY OF USES, INCLUDING RESIDENTIAL AS WELL AS THE RESIDENTIAL APPEARANCE OF THE BUILDINGS ON THE SUBJECT SITE, THE FACILITY IS COMPATIBLE WITH THIS STANDARD.
FAITH RECOVERY SHALL REMAIN COMPLIANT, UM, WITH ALL APPLICABLE, APPLICABLE
UH, FAITH RECOVERY IS A CERTIFIED RECOVERY RESIDENCE BY ACCREDITATION THROUGH THE VIRGINIA ASSOCIATION OF RECOVERY RESIDENCES, UM, ALSO KNOWN AS VAR AND VIRGINIA OXFORD HOUSE.
THEREFORE, THE FACILITY IS A CERTIFIED RECOVERY RESIDENCE BY THE VIRGINIA DEPARTMENT OF BEHAVIORAL HEALTH AND DEVELOPMENT SERVICES.
THE PERFORMANCE STANDARDS STATE THAT SUCH A FACILITY SHALL BE UNDER 24 HOUR A DAY CARE AND SUPERVISION OF A PROFESSIONAL STAFF PERSON OR PERSONS, ONE OR MORE OF WHOM MAY ALSO RESIDE IN THE FACILITY.
UM, THE REQUIRED PROFESSIONAL QUALIFICATION QUALIFICATIONS OF THE SUPERVISORY STAFF SHALL BE SUBMITTED FOR THE REVIEW.
UM, AS PART OF THE ZONING AUTHORIZATION PROCESS.
THE APPLICANT'S NARRATIVE DID NOT ADDRESS THIS.
THEREFORE, A CONDITION OF APPROVAL HAS BEEN INCLUDED TO SUBMIT THIS INFORMATION DURING THE BUILDING PERMIT REVIEW.
AND LASTLY, THE MINIMUM LOT SIZE FOR SUCH FACILITY SHALL BE BASED ON THE NUMBER OF RESIDENTS EXCLUSIVE OF STAFF PROPOSED TO BE HOUSED IN THE FACILITY.
UM, BASED OFF OF STAFF'S CALCULATIONS, THE LOT SIZE MEETS THIS REQUIREMENT.
SO NEXT WE GO INTO PARKING AND TRAFFIC ANALYSIS.
UH, THE PARKING REQUIREMENTS FROM SECTION 24.1 DASH 6 0 6 FOR GROUP HOMES ARE THREE SPACES PLUS ONE SPACE FOR EVERY TWO BEDS.
THERE ARE CURRENTLY SIX BEDS AVAILABLE IN 3 25 DASH A U BUILDING.
UM, EVEN THOUGH TWO MORE BEDS COULD BE ADDED, UH, ONE SUFFICIENT SQUARE FOOTAGE IS AVAILABLE, UM, AND EIGHT BEDS IN THE 3 25 DASH BU ROAD BUILDING.
THERE WILL BE THE ADDITION OF FIVE MORE BEDS IN THE 3 25 DASH BEAL BUILDING.
SO THEREFORE A TOTAL OF, UM, 21 BEDS, WHICH WILL REQUIRE A TOTAL OF 14 PARKING SPACES

ACCORDING TO THE APPLICANT.THE SUBJECT PROPERTY CURRENTLY HAS 16 PARKING SPACES AVAILABLE MEETING THIS REQUIREMENT AND BASED ON THE ANALYSIS, UM, FROM THE INSTITUTE OF TRANSPORTATION ENGINEERS TRIP GENERAL MANUAL AND THE VDOT 2024 TRAFFIC VOLUME DATA, THE INCREASE IN OCCUPANCY IS NOT LARGE ENOUGH TO IMPACT EVERYDAY TRAFFIC PATTERNS.
SO THEREFORE, UH, THE USE WILL HAVE LITTLE IMPACT ON EXISTING PATTERNS IN THE VIC VICINITY OF THE FACILITY.
AND AS FOR SAFETY, AT THE RECOMMENDATION OF THE DIVISION OF BUILDING SAFETY STAFF HAS PROPOSED A CONDITION OF APPROVAL THAT WOULD REQUIRE THE APPLICANT TO OBTAIN A NEW CER CERTIFICATE OF OCCUPANCY FOR THE CHANGE OF BUILDING USE AND AN AUTOMATIC SPRINKLER SYSTEM INSTALLED IN ACCORDANCE WITH THE 2021 VIRGINIA CONSTRUCTION CODE.
AT THE RECOMMENDATION OF THE DEPARTMENT OF FIRE AND LIFE SAFETY STAFF HAS INCLUDED A PROPOSED CONDITION OF APPROVAL THAT WOULD REQUIRE THE BUSINESS TO BE INSPECTED, UM, AND SUBMIT AN EMERGENCY PLAN TO BE APPROVED BY FIRE AND LIFE SAFETY PRIOR TO THE CHANGE OF USE.
SO IN CONCLUSION, THE APPLICANT IS SEEKING AUTHORIZATION TO INCREASE THE NUMBER OF OCCUPANTS IN AN EXISTING RECOVERY FACILITY FROM 16 TO 21 TO SATISFY AND EXPRESS THE NEED FOR SAFE HOUSING AND ADDICTION RECOVERY SERVICES.
DUE TO THIS, THEY'RE REQUESTING THE BUILDING AT 3 25 DASH B YIELD ROAD TO HAVE AN INCREASE IN OCCUPANCY FROM EIGHT TO 13 RESIDENTS.
THE APPLICANT HAS STATED THAT FAITH RECOVERY HAS MAINTAINED COMPLIANCE WITH THE D-B-H-D-S AND CONDITIONS OF APPROVAL ARE PROPOSED THAT WOULD REQUIRE THE FACILITY TO MAINTAIN COMPLIANCE WITH THE STATE AND COUNTY CODE.
THIS REQUEST FOR AN INCREASE IN OCCUPANCY WILL NOT CHANGE THE SURROUNDING AREA AND WILL PROVIDE SERVICES FOR THE COMMUNITY DUE TO THE CONSIDERATIONS AND CONCLUSIONS.

AND THEN LASTLY, UH, THE ONLY, UM, REALLY INTERESTING ITEM OF CURRENT DEVELOPMENT, UH, THE BOARDWALK DOWN HERE AT THE BEACH FRONT GOT THEIR, UH, LAND DISTURBING ACTIVITY PERMIT, UM, RECENTLY THEY GOT IT ON OCTOBER 30TH.
SO THEY'RE PLANNING TO START WORK ON THAT IN THE NEXT COUPLE WEEKS I THINK.
SO THEY'LL START, UM, CONSTRUCTION BETWEEN THE PUB AND COASTAL THIRST.
THEY'LL BE BUILDING THAT BOARDWALK THAT GO, WILL FILL THAT SPACE AND CLEANING UP THE PARKING AREA IN FRONT, PUTTING UP A SIDEWALK AND THOSE KINDS OF THINGS.
SO WHAT'S THE TIMELINE ON THE PUB'S EXPANSION? UM, THE PUB THE PUB ITSELF WON'T BE EXPANDING.
ARE YOU TALKING ABOUT THE OTHER RESTAURANTS THAT THEY YES, YES.
UM, THEY HAVE NOT BROUGHT FORWARD ANY PLANS FOR THAT.
