THE SUBJECT PROPERTY IS LOCATED ON ROUTE 17 AND IS ZONED GENERAL BUSINESS WITH A DESIGNATION FOR GENERAL BUSINESS IN THE COMPREHENSIVE PLAN.

THE SITE IS BORDERED TO THE WEST AND NORTH BY EDGEHILL, WHICH IS ZONED R 20 OR MEDIUM DENSITY SINGLE FAMILY RESIDENTIAL DISTRICT.

AND LASTLY, TO THE SOUTH IS CLIFF'S TIRE AND AUTO CENTER.

IT'S AN AUTO REPAIR GARAGE BUSINESS.

SO THE APPLICANT IS REQUESTING REAUTHORIZATION OF A SPECIAL USE PERMIT ORIGINALLY APPROVED IN 2022, UH, FOR AN HVAC CONTRACTOR SHOP WITH OUTDOOR STORAGE.

THE PROPOSAL NOW INCLUDES A 13,200 SQUARE FOOT BUILDING WITH OFFICE AND WAREHOUSE SPACE TO SUPPORT DAILY OPERATIONS ALONG WITH A 6,000 SQUARE FOOT GRAVEL LAY DOWN AREA ENCLOSED BY A PRIVACY FENCE AND CONNECTED TO THE MAIN STRUCTURE.

A SITE PLAN WAS SUBMITTED FOLLOWING THE ORIGINAL SUP APPROVAL AND WAS APPROVED BY DEVELOPMENT SERVICES ON APRIL 1ST, 2024.

UM, AND BUILDING PERMITS WERE ISSUED THIS PAST JULY.

LAND DISTURBANCES HAVE ALREADY BEGUN FOR THE CONTRACTOR SHOP, WHICH IS PERMITTED BY RIGHT.

THIS SEP REQUEST APPLIES STRICTLY TO THE OUTDOOR STORAGE YARD.

MOST OF THE LAND USE CHARACTERISTICS AND CONSIDERATIONS REVIEWED DURING THE ORIGINAL SEP PROCESS REMAIN UNCHANGED.

AND AS A RESULT, MANY OF THE ORIGINAL CONDITIONS ARE CARRIED FORWARD, UH, INTO THE

NEW REQUEST.

ACCORDING TO THE APPROVED SITE PLAN, THE STORAGE YARD WILL BE LOCATED TO THE REAR OF THE PROPOSED BUILDING AND ASSESSED, UH, ACCESS THROUGH A 20 FOOT WIDE GATE ON THE BUILDING'S LEFT SIDE FACING COLTON ROAD.

UM, AN EIGHT FOOT TALL CHAIN LINK FENCE SCREENED WITH EVERGREEN PLANTINGS WILL PROVIDE VISUAL BUFFERING FOR THE OUTDOOR STORAGE AREA.

VEHICULAR ACCESS TO THE SITE WILL BE PROVIDED BY TWO DRIVEWAYS CONNECTING THE PARKING AREA TO COCKLE TOWN ROAD.

THE APPROVED SITE PLAN SHOWS BOTH DRIVEWAYS MEASURING 35 FEET AND 33 FEET, UH, MEET VDOT ENTRANCE STANDARDS AND OUR DESIGNED FOR TWO-WAY TRAFFIC TO PREVENT TRUCK TRAFFIC FROM ENTERING NEARBY RESIDENTIAL AREAS.

SIGNAGE AT EACH ENTRANCE, UH, WILL RESTRICT RESTRICT LEFT TURNS FOR TRUCKS AND IN ACCORDANCE, UH, WITH THE ZONING ORDINANCE REQUIREMENTS, A MINIMUM OF 12 PARKING SPACES IS REQUIRED FOR THE THE COMBINED USES.

THE APPLICANT'S SITE PLAN PROVIDES 38 SPACES IN TOTAL, INCLUDING TWO A DA COMPLIANCE SPACES.

ACCORDING TO THE TRIP GENERATION MANUAL PUBLISHED BY THE INSTITUTE OF TRANSPORTATION ENGINEERS, THE PROPOSED FACILITY IS EXPECTED TO GENERATE ABOUT 82.5 VEHICLE TRIPS PER WEEKDAY.

UM, USING VDO T'S 2023 TRAFFIC DATA STAFF DOES NOT EXPECT ANY NOTICEABLE IMPACTS ON TRAFFIC IN THE AREA.

SINCE MOST VEHICLES TRAVELING TO THE SITE WOULD USE THE SECTION OF COLTON ROAD BETWEEN ROUTE 17 AND THE BUSINESS ENTRANCES.

NOW TO GO INTO VISUAL IMPACTS, UH, THE ZONING ORDINANCE REQUIRES THAT OUTDOOR STORAGE YARDS FOR CONTRACTOR SHOPS BE DESIGNED AND LOCATED SO AS TO MINIMIZE VISUAL IMPACTS ON ADJACENT PROPERTIES AND PUBLIC RIGHTS OF WAYS.

ACCORDING TO THE APPROVED SITE PLAN, THE STORAGE YARD WILL BE LOCATED BEHIND THE BUILDING AND ENCLOSED BY OPAQUE FENCING AT LEAST EIGHT FEET TALL AND FURTHER SCREENED BY EVERGREEN CHEESE WITH, WITH FULL TO THE GROUND BRANCHING PLANTED OUTSIDE THE FENCE.

THE APPLICANT HAS ALSO CONFIRMED THAT NO STORED MATERIALS WILL EXTEND ABOVE THE FENCE LINE AND STAFF HAS INCLUDED A PROPOSED CONDITION OF APPROVAL TO REINFORCE THIS REQUIREMENT.

A 35 FOOT TRANSITIONAL BUFFER IS REQUIRED ALONG THE NORTHERN AND WESTERN PROPERTY LINES WHERE THE SITE ADJOINS THE R 20 DISTRICT TO PROVIDE ADDITIONAL SCREENING FOR HOMES ACROSS COLTON ROAD.

STAFF HAS RECOMMENDED A CONDITION REQUIRING THAT THE BUFFER PLANTINGS ALSO EXTEND ALONG THE PROPERTY'S FULL COLTON ROAD FRONTAGE.

THIS 35 FOOT BUFFER IS REFLECTED ON THE SITE PLAN AND IT SATISFIES THE APPROVAL CONDITIONS.

AND LASTLY, BECAUSE THIS PROPERTY LIES WITHIN THE ROUTE 17 CORRIDOR OVERLAY DISTRICT, THE PROJECT IS ALSO SUBJECT TO STANDARDS FOR BUILDING DESIGN MATERIALS AND COLORS.

UPDATED RENDERING SUBMITTED AND APPROVED BY DEVELOPMENT SERVICES IMPROVE UPON THE APPLICANT'S ORIGINAL 2022 SUBMITTAL AND COMPLY WITH ALL OF ROUTE 17 OVERLAY REQUIREMENTS.

THE BUSINESS ALSO OBTAINED A FEDERAL FIREARMS LICENSE OR AN FFL FROM THE BUREAU OF ALCOHOL, TOBACCO FIREARMS AND EXPLOSIVES OR A TF.

THERE IS NO STATEWIDE LICENSING REQUIREMENT FOR SALES AND SERVICE OF FIREARMS IN VIRGINIA.

DURING AN ANNUAL INSPECTION CONDUCTED BY THE A TF IN JUNE OF 2025, AN INVESTIGATOR FROM THE BUREAU CONTACTED THE PLANNING DIVISION TO DETERMINE WHETHER ZONING APPROVAL HAD BEEN OBTAINED FOR FIREARM SALES.

AND IT WAS AT THIS POINT THAT STAFF LEARNED THAT THE APPLICANT WAS ENGAGING IN THE SALE AND SERVICE OF FIREARMS WITHOUT ZONING APPROVAL.

THE APPROVAL OF THIS APPLICATION WOULD BRING THE APPLICANT INTO COMPLIANCE WITH THE ZONING ORDINANCE.

A CONDITION OF APPROVAL HAS BEEN PROPOSED THAT WOULD REQUIRE THE APPLICANT TO OBTAIN A NEW BUSINESS LICENSE THAT INCLUDES THE SALE AND SERVICE OF FIREARMS. ACCORDING TO THE APPLICANT'S NARRATIVE, THE BUSINESS SECURES ITS STOCK OF FIREARMS IN LOCKED GUN CASES USING STEEL CABLES, UM, WITH PADLOCKS AND IN TWO LARGE SAFES.

THE NARRATIVE ALSO INDICATES THAT THE PROPERTY IS SECURED BY AN A DT SECURITY SYSTEM AND 12 RING CAMERAS POSITIONED TO BOTH INSIDE AND OUTSIDE OF THE BUILDING.

THE APPLICANT STATES IN HIS NARRATIVE THAT HE PERSONALLY MONITORS THE CAMERAS 24 HOURS A DAY, SEVEN DAYS A WEEK.

DURING THE SITE VISIT, STAFF NOTED BARS ON THE WINDOWS AND DOORS AND THE SHERIFF'S OFFICE, UH, REVIEWED THE APPLICATION AND INDICATED THAT THEY HAVE NO CONCERNS ABOUT THE PROPOSED USE.

THE COUNTY'S DEPARTMENT OF FIRE AND LIFE SAFETY OR FLS ALSO REVIEWED THE APPLICATION AND REQUESTED THAT THE APPLICANT BE COMPELLED TO PROVIDE A HAZARDOUS MATERIALS MANAGEMENT PLAN FOR APPROVAL.

PER THE VIRGINIA STATEWIDE FIRE PREVENTION CODE, THE APPLICANT WILL BE REQUIRED TO SUBMIT TO INITIAL AND ANNUAL FIRE INSPECTIONS, WHICH WOULD BE, WHICH WOULD BE CONDUCTED BY FLS STAFF.

THE PROPOSED FIREARMS SALES AND SERVICES ESTABLISHMENT WOULD NOT HAVE ANY ADVERSE IMPACTS ON NEARBY BUSINESSES OR PROPERTIES.
