THE CODE OF VIRGINIA REQUIRES LOCAL GOVERNMENTS TO HAVE A PLANNING COMMISSION, THE PURPOSE OF WHICH IS TO ADVISE THE BOARD OF SUPERVISORS ON LAND USE AND PLANNING ISSUES AFFECTING THE COUNTY.

THIS RESPONSIBILITY IS EXERCISED THROUGH RECOMMENDATIONS CONVEYED BY RESOLUTIONS OR OTHER OFFICIAL MEANS AND ARE ALL MATTERS OF PUBLIC RECORD.

THE COMMISSION IS COMPRISED OF SEVEN CITIZEN VOLUNTEERS APPOINTED BY THE BOARD WITH ONE REPRESENTATIVE FROM EACH VOTING DISTRICT, AND TWO AT LARGE MEMBERS.

THE SUBJECT PROPERTY IS ZONED GENERAL BUSINESS AND IS DESIGNATED GB IN THE COMPREHENSIVE PLAN.

NORTH OF THE PROPERTY IS THE YORK ASSEMBLY OF GOD CHURCH AND THE FUTURE CLUBHOUSE FOR, FOR YORKTOWN CRESCENT, BOTH ZONED PLAN DEVELOPMENT EAST IS AN UNDEVELOPED LOT PROPOSED FOR 43 ADDITIONAL TOWNHOUSES FOR YORKTOWN CRESCENT ZONED PD AND SOUTH IS AN UNDEVELOPED LOT ZONE GB WEST OF THE WEST OF THE SITE.

ACROSS ROUTE 17 IS PROPERTY ZONE GB, WHERE JAY AND CA HEATING AND COOLING IS LOCATED.

THE SOUTHERLY BUILDING CONTAINS THE ARMY NAVY TATTOO SHOP AND THE NORTHERLY BUILDING HOUSES THE APPLICANT'S PSYCHIC CHAKRA SHOP.

IN A VACANT RETAIL UNIT, THE APPLICANT IS SEEKING AUTHORIZATION TO OPERATE A PSYCHIC CHAKRA SHOP.

FOR THOSE OF YOU WHO DON'T KNOW WHAT A A PSYCHIC CHAKRA SHOP IS, IT'S A BUSINESS THAT OFFERS SERVICES SUCH AS PSYCHIC READINGS THROUGH TAROT CARD READINGS, OR A MEDIUMSHIP AND CHAKRA BALANCING A SPIRITUAL HEALING PRACTICE FOCUSED ON ALIGNING THE BODY'S ENERGY CENTERS.

THE APPLICANT HAS BEEN OPERATING UNDER A BUSINESS LICENSE SINCE 2021.

THAT ALLOWS FOR THE SALE OF RETAIL CANDLES, STONES, JEWELRY, CLOTHING, AND SERVICES FOR A CHOCOLATE HEALING SESSION.

A RECENT SITE REVIEW FOUND THE ADDITION OF FORTUNE TOWING SERVICES, WHICH REQUIRES A SPECIAL USE PERMIT IN THE GENERAL BUSINESS DISTRICT.

THIS REQUEST SEEKS TO BRING THE BUSINESS INTO ZONING COMPLIANCE.

SO SERVICES OFFERED, UM, WITH THE BUSINESS INCLUDE CHAKRA BALANCING PSYCHIC READINGS, TAROT CARD READINGS, MEDITATION SUPPORT, SPIRITUAL LIFE COACHING, AND ROCKY HEALING ENERGY.

THE SHOP WILL ALSO OFFER RETAIL SALES OF METAPHYSICAL ITEMS SUCH AS CRYSTALS, INCENSE, CANDLES, AND NATURAL WELLNESS PRODUCTS.

THE BUSINESS OPERATES BY APPOINTMENT ONLY.

THE PROPOSED BUSINESS OFFERS A UNIQUE SERVICE TO

LOCAL RESIDENTS AND SUPPORTS THE COUNTY'S BROADER GOALS OF ENCOURAGING SMALL BUSINESS DEVELOPMENT.

ITS PRESENCE CONTRIBUTES TO DIVERSE LOCAL ECONOMY AND ALIGNS WITH THE COUNTY'S VISION OF WELCOMING ENTREPRENEUR ENTREPRENEURIAL ACTIVITY VIA THE COMPREHENSIVE PLAN.

THE PARKING REQUIREMENTS FOR THIS USE ARE A MINIMUM OF ONE OFF STREET PARKING SPACE PER 350 SQUARE FEET OF GROSS FLOOR AREA AND ONE OFF STREET LOADING SPACE.

THE APPLICANT'S BUSINESS OCCUPIES APPROXIMATELY 480 SQUARE FEET, RESULTING IN A MINIMUM REQUIREMENT OF TWO PARKING SPACES.

TO COMPLY WITH THESE REQUIREMENTS.

THE APPLICANT HAS PROPOSED TO STRIPE THE PARKING AREA TO INCLUDE FIVE STANDARD SPACES AND ONE HANDICAP SPACE.

THE APPLICANT HAS ALREADY STARTED THE STRIPING PROCESS.

AS FOR SIGNAGE, THE ORIGINAL DESIGN APPROVED UNDER THE PREVIOUS PERMIT IS NO LONGER IN USE AND THE CURRENT SIGNAGE HAS NOT BEEN PROPERLY APP APPROVED.

UM, TO ENSURE CONSISTENCY WITH THE COUNTY'S PERMITTING PROCEDURES, A NEW SIGNED PERMIT IS REQUIRED FOR THE EXISTING SIGN FACE, AND THE APPLICANT HAS BEGUN THE APPLICATION PROCESS FOR THAT.

SO IN CONCLUSION, THE APPLICANT IS REQUESTING A SPECIAL USE PERMIT TO OPERATE A PSYCHIC CHAKRA SHOP THAT WILL BRING THE OWNER INTO COMPLIANCE WITH THE ZONING ORDINANCE.

THE PROPOSED CONDITIONS OF APPROVAL MAKE THE BUSINESS IN COMPLIANCE WITH THE CODE BY INCLUDING THE OWNER OBTAINING AN UPDATED BUSINESS LICENSE THAT INCLUDES THE FORTUNE TELLING SERVICES OFFERED STRIPING OF PARKING SPACES AND OBTAINING A SIGNED FACE CHANGE PERMIT FOR THE CURRENT SIGN DESIGN.

DUE TO THE CONSIDERATIONS AND CONCLUSIONS, AS NOTED, STAFF RECOMMENDS APPROVAL OF THIS APPLICATION SUBJECT TO THE CONDITIONS SET FORTH IN THE PROPOSED RESOLUTION NUMBER PC 25 DASH 19.

NEW ARCHEOLOGICAL STUDY REVIEW FEES WERE APPROVED AND IT ADDED TO THE SECTION THIS PAST MAY, UH, WITH EXISTING RATES COVERING PHASE ONE THROUGH THREE STUDIES.

UH, THIS PROPOSED REVISION ADDS A FEE FOR OTHER REQUIRED STUDY TYPES.

THESE CHANGES ARE TO COMPLY WITH THE CODE OF VIRGINIA INITIAL PLAN OR PLA SUBMITTALS NOW MUST BE REVIEWED BY THE COUNTY WITHIN 40 DAYS, SECOND SUBMITTALS WITHIN 30 DAYS.

AND THE THIRD OR SUBSEQUENT SUBMITTAL MUST BE REVIEWED WITHIN 14 DAYS OF RECEIPT.

IN KEEPING WITH CURRENT SUBMITTAL PRACTICES, THIS PROPOSED CHANGE REDUCES THE NUMBER OF PRINTED PAPER COPIES OF A SUBDIVISION PLANNER PLAT THAT MUST BE SUBMITTED FOR REVIEW TO THE COUNTY FROM 13 TO THREE.

THESE SECTIONS HAVE BEEN UPDATED TO REQUIRE ONLY THREE PLAN SLASH PLATE PLA PAPER COPIES FOR SUBMITTAL AND OUTDATED REFERENCES TO BLUE LINE AND BLACK LINE INK PRINTS, UH, WHICH WERE ONCE USED BEFORE MODERN PLOTTER PRINTING HAVE BEEN REMOVED.

THIS REVISED TRANSIT OCCUPANCY DEFINITION FROM 90 TO 30 OR FEWER CONSECUTIVE DAYS ALIGNS WITH UPDATED VIRGINIA CODE DEFINITIONS.

JUST LIKE IN THE SUBDIVISION ORDINANCE, THIS PROPOSED REVISION ADDS A FEE FOR OTHER REQUIRED STUDY TYPES.

THIS CHANGE OF STATUS WAS AN EXPIRATION DATE FOR VOLUNTARILY DEFERRED APPLICATIONS.

UH, CURRENTLY SUCH APPLICATIONS CAN REMAIN IN LIMBO INDEFINITELY.

UM, EVEN AS CONDITIONS AND FACTORS INFLUENCING STAFF AND THE PLANNING COMMISSION RECOMMENDATIONS MAY HAVE CHANGED.

JUST LIKE IN THE SUBDIVISION CODE, THIS SECTION REMOVES EXPIRED COVID-19 RELATED APPROVAL EXTENSION PROVISIONS.

THIS SCREENING CHANGE CLARIFIES THAT FRONT YARD HVAC EQUIPMENT MUST BE SCREENED FROM VIEW FROM PUBLIC STREETS AND ADJACENT PROPERTIES.

AND FOR THE HOME OCCUPATIONS DIVISION IN THE CODE MINOR GRAMMATICAL ERRORS HAVE BEEN CORRECTED.

SEVERAL MODIFICATIONS HAVE BEEN MADE TO THE TABLE OF LAND USES WITHIN CATEGORY ONE RESIDENTIAL USES.

GROUP HOMES ARE NOW PROPOSED TO BE ALLOWED BY SPECIAL USE PERMIT AND EO IL AND IG ZONING DISTRICTS.

THIS IS TO ALLOW MORE OPTIONS OUTSIDE OF RESIDENTIAL COMMUNITIES FOR THEM TO LOCATE.

IN CATEGORY 10.

GROCERY STORES ARE PROPOSED TO BE ALLOWED IN THE LB DISTRICT BY SUP AS SMALLER STORES MAY BE APPROPRIATE IN CERTAIN LOCATIONS WITH CONVENIENT ACCESS FOR RESIDENTS.

CATEGORY 15 HAS BEEN MODIFIED TO CHANGE THE WORD SHOP TO FACILITIES AND PERMIT STANDALONE CONTRACTOR, UH,

STORAGE YARDS BY SUP AND GB AND EO DISTRICTS AND BUY RIGHT WITHIN THE INDUSTRIAL ZONING DISTRICTS.

CATEGORY 17 ADDS A NEW LAND USE BATTERY ENERGY STORAGE SYSTEMS, WHICH SUPPORT GRID RELIABILITY BY STORING AND RELEASING ELECTRICITY ON DEMAND.

GIVEN THE RANGE OF SIZES, COMPONENTS, AND APPLICATIONS, EACH PROPOSAL WILL BE REVIEWED CASE BY CASE BY THE PLANNING COMMISSION AND BOARD OF SUPERVISORS.

THEREFORE, BATTERY ENERGY STORAGE SYSTEMS ARE PROPOSED TO BE PERMITTED BY SUP AND EO IL AND IG DISTRICTS.

AND NOW I WILL LET JEAN TAKE OVER.

SO THIS SECTION CONTAINS LAND USES THAT ARE PROHIBITED IN THE COUNTY DUE TO THEIR HARMFUL IMPACTS ON HEALTH, SAFETY AND THE GENERAL WELFARE OF THE COMMUNITY.

CASINOS AND OFF TRACK BEDDING ESTABLISHMENTS ARE PROPOSED TO BE ADDED TO THIS LIST DUE TO THE, TO THE POTENTIAL NEGATIVE IMPACTS SUCH USES COULD CAUSE TO THE COMMUNITY.

TYPICAL ACCESSORY STRUCTURES ASSOCIATED WITH SINGLE FAMILY HOMES SUCH AS STORAGE SHEDS, DOG HOUSES, GARAGES, ET CETERA, ARE NOW SPECIFICALLY NOTED TO BE PERMITTED AS A MATTER OF RIGHT WITHIN THE YVA DISTRICT.

THIS SECTION DETAILS THE PROCEDURES AND STANDARDS FOR TEMPORARY TRAILERS.

THE ONLY CHANGE PROPOSED IS THE REMOVAL OF THE OPTION TO EXECUTE AN AGREEMENT WITH THE BUILDING OFFICIAL IN LIEU OF PROVIDING A SURETY TO GUARANTEE THE EVENTUAL REMOVAL OF A TEMPORARY TRAILER.

THE AGREEMENT OPTION HAS RARELY BEEN UTILIZED AND IS PROPOSED FOR REMOVAL FOR THIS REASON.

SO THIS NEW SECTION ESTABLISHES COMPREHENSIVE PERFORMANCE STANDARDS FOR BATTERY ENERGY STORAGE FACILITIES.

SPECIAL USE PERMIT APPLICATIONS FOR THE USE MUST INCLUDE A DETAILED NARRATIVE DESCRIBING THE PROJECT, ITS CAPACITY SPECIFICATIONS, A MAINTENANCE PLAN, ANY, ANY ANCILLARY FACILITIES AND POTENTIAL IMPACTS ON NATURAL AND HISTORIC RESOURCES WITH VISUAL RENDERINGS OF PROPOSED STRUCTURES AND LANDSCAPING TREATMENTS.

SO THIS IS A PHOTO OF DOMINION ENERGY'S DRY BRIDGE BATTERY ENERGY STORAGE SYSTEM IN CHESTERFIELD COUNTY TAKEN IN 2023.

MOST BATTERY ENERGY STORAGE FACILITIES CONTAIN AN AGGREGATION OF MANY INDIVIDUAL BATTERY CELLS AND RACKS CONTAINED IN MODULAR CONTAINERS, EIGHT TO 12 FEET IN HEIGHT, WHICH ARE GENERALLY NOT ARCHITECTURALLY ATTRACTIVE.

THEREFORE, THESE FACILITIES MUST BE, UH, VISUALLY SCREENED FROM PUBLIC VIEW THROUGH ARCHITECTURAL FEATURES, BERMS AND EVERGREEN LANDSCAPING THAT HARMONIZES WITH THE SURROUNDING AREA.

SO WE'VE GONE FROM A 60 DAY REVIEW FOR THE FIRST APPLICATION TO 40 DAYS AND FOR A SECOND REVIEW IT WENT FROM 45 DAYS DOWN TO 30 AND THEN THIRD AND SUBSEQUENT REVIEWS ARE NOW 14 DAYS.

SO WE ARE REALLY WORKING HARD TO IMPLEMENT THOSE CHANGES, UM, AND UH, WITH WHAT STAFF IS DOING.

UH, BUT I DID WANT TO JUST TELL YOU ALL THAT AS A, YOU KNOW, IN THE PUBLIC FORUM THAT UH, WE ARE WORKING TO IMPLEMENT THOSE CHANGES AND MAKE THOSE REVIEWS HAPPEN ON THOSE TIMELINES.

IT'S VERY TIGHT, BUT WE ARE WORKING HARD TO, TO MAKE IT HAPPEN AND STAFF IS DOING A VERY GOOD JOB RIGHT NOW TO KEEP UP WITH THAT.

UM, WE'RE PUTTING SOME THINGS IN PLACE THAT WILL MAKE IT A LITTLE MORE EASY FOR STAFF TO DO THOSE THINGS.

UM, AS WELL AS, UH, MAKE SURE THAT APPLICANTS ARE ACTUALLY SUBMITTING EVERYTHING THAT THEY HAVE TO SUBMIT IN THE FIRST GO ROUND RATHER THAN US KIND OF TAKING AN APPLICATION AND KIND OF WAITING FOR THEM TO SLOWLY FILTER IN THINGS AS WAY.

WE KIND OF HAVE DONE IT IN THE PAST.

UH, SO I WOULD GUESS WE NOT BEING NICE GUYS AS WE USED TO BE AND ACCEPTING EVERYTHING THAT COMES IN, BUT WE'RE MAKING SURE THAT THEY HAVE EVERYTHING BECAUSE THE SHORTER DEADLINE REALLY IMPACTS US WHEN WE DON'T HAVE ALL THE INFORMATION.
