SO VIRGINIA NATURAL GAS HAS SUBMITTED THE SPECIAL USE PERMIT APPLICATION PURSUANT TO THIS, TO, UH, SECTION 24.1 DASH 3 0 6, CATEGORY 17 NUMBER EIGHT OF THE YORK COUNTY ZONING ORDINANCE TO AUTHORIZE THE ESTABLISHMENT OF A GAS REGULATOR STATION ON AN APPROXIMATELY, UH, TWO TENTHS OF AN ACRE EASEMENT ON THE APPROXIMATELY 83 ACRE SENTARA WILLIAMSBURG REGIONAL MEDICAL CENTER PROPERTY.

THE PROPERTY IS ZONED EO FOR ECONOMIC OPPORTUNITY AND DESIGNATED ECONOMIC OPPORTUNITY IN THE COMPREHENSIVE PLAN.

SO THE EASEMENT WOULD BE LOCATED ON THE SOUTHEAST SIDE OF THE PROPERTY ALONG OLD MOTOWN ROAD.

APPROXIMATELY 800 FEET WEST OF WARNER LANE, UH, DIRECTLY ACROSS FROM OLD MOTOWN ROAD, OOP DIRECTLY ACROSS FROM OLD MOTOWN ROAD ARE UH, DETACHED SINGLE FAMILY DWELLINGS IN JAMES CITY COUNTY.

THERE WERE TWO APPLICATIONS, ONE FOR SPECIAL USE PERMIT AND THEN THE REZONING FOR ONE 11 FAULKNER ROAD TO MAKE THAT GENERAL BUSINESS.

THIS WAS FOR OUTDOOR RV STORAGE.

YOU CAN SEE ACROSS THE STREET HERE THAT'S IN GREEN.

SO THIS IS WHERE THE MAIN RV STORAGE IS AND THEY'RE DOING STORAGE HERE ON THESE LOTS.

SO THAT'S WHAT THE 2023 ACTION WAS.

TO AUTHORIZE THIS, AGAIN, IT WAS BOTH OF THESE 69 0 9 69 0 3 AND THEN ONE 11 FAULKNER.

AGAIN THAT WAS A USE PERMIT REZONING.

BOTH WERE APPROVED BY THE BOARD IN 2023.

FAULKNER ROAD USED TO BE ZONED R 20, THEN IT WAS REZONED TO GB CONDITIONAL WITH THAT CONDITIONAL SET OF PROFFERS.

UM, AS A REMINDER, AND FOR THOSE OF YOU WHO WEREN'T ON THE COMMISSION, THIS WAS KIND OF THE OVERALL DEVELOPMENT PLAN AND THAT WAS PROVED WITH THE SEP.

SO THIS IS THAT FAULKNER ROAD PARCEL.

IT HAS A SINGLE FAMILY HOME AND SOME OUT STRUCTURES THAT WERE GONNA BE MAINTAINED AND USED FOR STORAGE.

AND THEN IN THE APPLICANT'S SKETCH PLAN, THEY WERE GONNA HAVE SOME PARKING HERE.

AND THEN THESE ARE THE GEORGE WASHINGTON PARCELS HERE AGAIN PARKING A NEW BUILDING AND THEN A BMP.

SO TO MOVE INTO THE CURRENT APPLICATION, THIS IS ACTUALLY A PRETTY SIMPLE APPLICATION.

UM, IT'S TO AMEND THE PROFFERS TO DO TWO THINGS.

SO YOU NOTICE, AND I HAVE THAT EXISTING PROFFER STATEMENT THAT WAS ACCEPTED BY THE BOARD THAT WAS IN YOUR PACKET.

AND ONE OF THE PROFFERS ON THERE WAS TO VACATE THE SHARED PROPERTY LINE BETWEEN ONE 11 FAULKNER AND 69 0 3 GEORGE WASHINGTON TO MAKE IT ALL ONE PARCEL, WHICH AT THE TIME, UM, MADE SENSE FOR THE APPLICATION.

'CAUSE THIS IS ALL GONNA BE, YOU KNOW, ONE DEVELOPMENT.

YOU'LL NOTICE ON THE AMENDED PROFFER STATEMENT THAT THAT HAS BEEN REMOVED.

AND THE REASON FOR THAT IS THE APPLICANT, UM, ESSENTIALLY 69 0 3 AND THEN ONE 11 FAULKNER HAVE TWO DIFFERENT MORTGAGES.

AND SO WHEN YOU'RE VACATING A PROPERTY LINE AND THERE'S A PRETTY GOOD WRITEUP IN THE MEMO FOR YOU ON THAT, BUT IT KIND, THE UNDERLYING NEEDS TO BE CHANGED.

AND SO THERE WAS KIND OF A SUBSTANTIAL FINANCIAL BURDEN FOR THE APPLICANT, UH, TO VACATE THAT PROPERTY LINE.

AND SO THE PROPOSAL THERE IS AGAIN TO AMEND THE PROFFERS TO ALLOW THEM TO KEEP THE PROPERTY LINE AND NOT REQUIRE THEM TO VACATE IT.

RELATED TO THAT, YOU'LL NOTICE THE DIFFERENT, ANOTHER DIFFERENCE BETWEEN THE ACCEPTED PROFFERS AND THEN THE PROPOSED PROFFERS.

UM, THE ACCEPTED PROFFERS HAD A STATEMENT ABOUT VACATING A 50 FOOT ACCESS EASEMENT FROM FAULKNER TO ONE 11 FAULKNER.

IT WOULD CROSS 69 0 3 GEORGE WASHINGTON.

SINCE THIS PROPERTY LINE MIGHT NOT BE VACATED, THIS EASEMENT NEEDS TO BE RETAINED.

SO IT'S LANDLOCKED.

AND SO THE ACCESS, SO AGAIN, IN REMOVING THAT PROPOSED PROFFER OR ACCEPTED PROFFER AS WELL.

SO THAT'S JUST KIND OF A QUICK RECAP OF REALLY WHAT THE BASIS OF THE CHANGE HERE.

IT'S NOT THAT COMPLICATED, FORTUNATELY.

AND WANNA REITERATE, NO, THERE'S GONNA BE NO CHANGE IN THE GBS DONATING CLASSIFICATION ON ONE 11 FAULKNER.

IT'S REALLY JUST REMOVING THOSE PROFFERS FROM THE PREVIOUS PROFFER STATEMENT.

I WANNA NOTE THAT THE PROPERTY LINE VACATION BETWEEN ONE 11 FAULKNER AND 69 0 3 GEORGE WASHINGTON IS NOT REQUIRED.

UM, THERE ISN'T ANY BUILDINGS OR ANYTHING THAT CROSS PROPERTY LINES THAT WOULD LIKE LEGALLY CAUSE THAT TO HAPPEN.

IF ONE 11 FAULKNER STAYS ITS OWN PARCEL, THEN SOME THINGS WILL CHANGE.

THERE'S LIKE CERTAIN LIKE LANDSCAPE YARDS AND THIS CURRENTLY THERE'S A SITE PLAN UNDER REVIEW FOR THIS DEVELOPMENT.

SO THAT CAN BE ADDRESSED AT THE SITE PLAN STAGE BEFORE IT'S APPROVED.

AGAIN, THESE ARE JUST MINOR ADJUSTMENTS TO THE PROFFERS.

THEY DON'T CHANGE CHARACTER TO THE REZONING AND THEY DON'T CHANGE THE USE OR NOT ALLOW THE USE THAT IS APPROVED TO HAPPEN THERE.

AND AGAIN, WE'RE KEEPING THAT ACCESS EASEMENT RETAINED TO ENSURE ACCESS TO ONE 11 FAULKNER.

SO THEY'RE NOT JUST GONNA BE LANDLOCKED IN A LITTLE ISLAND PARCEL WITH NO ACCESS.

SO FOR ALL THAT COMBINED, WE'RE RECOMMENDING APPROVAL OF THIS APPLICATION.

WHAT HAPPENS IS THE, THE TWO BANKS THAT WE ARE WORKING WITH RIGHT NOW, WE EV EVERYBODY KNOWS THE ECONOMIES HAVE CHANGED AND WE'RE REALLY LOOKING FOR WHEN WE GO INTO THE DEVELOPMENT STAGE, COMBINING ALL OF THIS INTO ONE FINANCING.

THE ONLY REASON THAT THE EASEMENT, YOUR CONCERN ABOUT THE EASEMENT IS BECAUSE IF A BANK WAS TO FORECLOSE AND THE PROPERTY'S LANDLOCKED, WE THEN DIMINISHED THEIR VALUE OF THEIR PROPERTY.

WE DO NOT INTEND TO MAKE UTILIZATION OF ANY EASEMENT ACROSS THE PROPERTY.

THESE ARE TWO UNIFORM PROPERTIES NOW.

AND IF YOU WERE BACK IN THE PAST, THAT HOUSE WAS BUILT AND LANDLOCKED IS A RESIDENTIAL PROPERTY BEHIND COMMERCIAL PROPERTY.

SO IT WAS A NATURAL PROGRESSION FOR IT.

SO REALLY ALL WE'RE DOING RIGHT NOW IS TRYING TO MAKE AN ECONOMIC SHIFT IN THE, IN THE STRUCTURE.

WE WILL ADMIT THAT WE'VE HAD DELAYS.

OBVIOUSLY MOST PEOPLE DON'T REALIZE THAT PROPERTY IS LOCATED AS PART AS THE WATERSHED.

SO THE RETENTION POND ISSUES AND ALL THOSE OTHER ISSUES WERE BEEN A LITTLE MORE COMPLICATED THAN WE ORIGINALLY THOUGHT.

ADD TO THAT, THE FACT THAT, YOU KNOW, WE HAD THE COVID AND ALL THIS STUFF THAT WAS EFFECTIVE US, BUT BOTTOM LINE IS, UH, WE'RE STILL ABANDONING THE LOT LINES FOR THE TWO THAT ARE UNDER THE OTHER FINANCE AND WE JUST RETAINING THIS LINE TO COMPLY WITH THE BANK LOANS.

I DON'T THINK IT'S UH, UM, AN ISSUE THAT WOULD AFFECT ANYTHING.

THE DEVELOPMENT IS STILL PLANNED TO GO AS PREVIOUSLY DONE, AND OBVIOUSLY THE LOT LINE WILL PROBABLY NEVER BE EFFECTIVE ON THESE PROPERTIES SINCE THEY'VE NOW BEEN COMBINED AS GENERAL BUSINESS.

AND, UH, THE PERSON DIDN'T DO IT OF COURSE, BUT UM, IT WAS INTERESTING THAT THEY BASICALLY JUST PULLED EVERYTHING OFF THEIR WEBSITE, THEIR NAME, THEIR A, YOU KNOW, ADDRESS, PHONE NUMBER, EMAIL, ALL THAT STUFF.

SO, UH, WE HAVE STARTED REDACTING ALL OF THAT INFORMATION SO THAT WE CAN PROTECT OUR APPLICANTS WHEN THEY ARE, YOU KNOW, HEAR BEFORE US IN A PUBLIC HEARING SETTING SO THAT THEY, THEIR INFORMATION JUST ISN'T OUT THERE IN THE PUBLIC.
