UH, WE WILL CALL TO ORDER THE FEBRUARY 12TH MEETING OF THE YORK COUNTY PLANNING COMMISSION.

THE CODE OF VIRGINIA REQUIRES LOCAL GOVERNMENTS TO HAVE A PLANNING COMMISSION, THE PURPOSE OF WHICH IS TO ADVISE THE BOARD OF SUPERVISORS ON LAND USE AND PLANNING ISSUES AFFECTING THE COUNTY.

THIS RESPONSIBILITY IS EXERCISED THROUGH RECOMMENDATIONS CONVEYED BY RESOLUTIONS OR OTHER OFFICIAL MEANS, AND ALL ARE MATTERS OF PUBLIC RECORDS.

THE COMMISSION IS COMPRISED OF SEVEN CITIZEN VOLUNTEERS APPOINTED BY THE BOARD OF SUPERVISORS WITH ONE REPRESENTATIVE FROM EACH VOTING DISTRICT, AND TWO AT LARGE MEMBERS.

ON TO OUR FIRST PUBLIC HEARING AND OUR ONLY PUBLIC HEARING.

AND SO WE'LL ASK, UH, STAFF TO, UH, MAKE THE PRESENTATION.

OKAY.

SO THIS APPLICATION IS TO CONSIDER AMENDMENTS TO THE PERFORMANCE STANDARDS WITHIN SECTION 24.1 DASH FOUR 14.1 OF THE YORK COUNTY ZONING ORDINANCE STANDARDS FOR DOMESTIC CHICKEN KEEPING AS AN ACCESSORY ACTIVITY ON RESIDENTIAL PROPERTY.

SO I'M GONNA START WITH SOME BACKGROUND INFORMATION.

THE YORK COUNTY ZONING ORDINANCE HAS ALLOWED DOMESTIC CHICKEN KEEPING AS AN ACCESSORY ACTIVITY ON PROPERTIES WITH AN OCCUPIED DWELLING AND WITH LESS THAN TWO USABLE ACRES AN AREA IN THE RESOURCE CONSERVATION.

RC AND RURAL RESIDENTIAL ARE OUR ZONING DISTRICTS SINCE 2014.

THE SAME HAS BEEN TRUE ON PROPERTIES WITH AN OCCUPIED DWELLING IN THE LOW DENSITY SINGLE FAMILY RESIDENTIAL, WHICH IS R 33, MEDIUM DENSITY, SINGLE FAMILY RESIDENTIAL R 20, HIGH DENSITY SINGLE FAMILY RESIDENTIAL R 13 AND WATER ORIENTED COMMERCIAL AND INDUSTRIAL WCI ZONING DISTRICTS.

OVER THAT TIME, 143 ADMINISTRATIVE PERMITS HAVE BEEN ISSUED FOR RESIDENTIAL CHICKEN KEEPING, AND STAFF HAS RECOGNIZED A VARIETY OF CHANGES REQUESTED BY CITIZENS, WHICH HAVE BEEN NOTED FOR CORRECTION.

AND NOW LET'S MOVE ON TO STAFF'S CONSIDERATIONS AND CONCLUSIONS.

THESE PROPOSED TEXAS AMENDMENTS INCLUDE THREE MAJOR ALTERATIONS.

THE FIRST IS THE REMOVAL OF DUCKS FROM THE PROHIBITED SPECIES LIST.

THE SECOND WOULD ALLOW, UH, RESIDENTS WHO LIVE IN DETACHED SINGLE FAMILY DWELLINGS IN THE PLANNED DEVELOPMENT PD ZONING DISTRICT TO KEEP CHICKENS AND OR DUCKS IN THEIR BACKYARDS.

AND THE LAST WOULD REMOVE THE OPTION TO APPLY FOR A SPECIAL USE PERMIT TO REDUCE SETBACKS FOR PENS, COOPS, AND CAGES.

ADDITIONALLY, MINOR CHANGES TO THE ORDINANCE, UH, LANGUAGE ARE PROPOSED FOR CLARIFICATION AND MODERNIZATION PURPOSES.

SO I'M GONNA START, UH, BY DISCUSSING THE REMOVAL OF DUCKS FROM THE PROHIBITED SPECIES LIST WHILE SECTION 24.1 DASH FOUR 14.1 ALLOWS CITIZENS TO KEEP DOMESTIC, UH, CHICKENS ON RESIDENTIAL PROPERTY.

THE CURRENT REGULATIONS PROHIBIT THE KEEPING OF GAME BIRDS, DUCKS, GEESE, PHEASANTS, GUINEA FOUL, AND SIMILAR FOUL OR POULTRY.

THE PROPOSED AMENDMENT WOULD ALLOW CITIZENS TO KEEP DUCKS IN ADDITION TO CHICKENS BY STRIKING DUCKS FROM THE PROHIBITED SPECIES LIST.

SO JUST AS BACKYARD CHICKEN KEEPING HAS, UH, RISEN IN POPULARITY, UH, IN RECENT YEARS, SO IS DUCK KEEPING.

MANY PEOPLE REPORT THAT CARING FOR DUCKS IS SIMILAR TO CARING FOR CHICKENS AND PEOPLE OFTEN CARE FOR BOTH SPECIES.

FOR, UM, EGG PRODUCTION.

DUCKS ARE ALSO SIMILAR, UH, ALSO PRODUCE SIMILAR NOISE AND ODOR LEVELS TO CHICKENS, UH, DEPENDING ON THE SEX AND SUBSPECIES OF EACH FOWL.

SO THE CURRENT ZONING ORDINANCE LIMITS THE NUMBER OF CHICKENS PERMITTED ON A RESIDENTIAL LOT TO ONE CHICKEN

PER 2,500 SQUARE FEET OF LOT AREA NOT TO EXCEED A MAXIMUM OF 16 CHICKENS.

THE PROPOSED AMENDMENTS WOULD NOT CHANGE THE MAXIMUM NUMBER OF BIRDS PERMITTED.

RATHER, IT WOULD ALLOW ONE CHICKEN OR DUCK PER 2,500 SQUARE FEET OF LOT AREA NOT TO EXCEED A MAXIMUM OF 16 CHICKENS AND OR DUCKS COMBINED.

THE SECOND, UH, PROPOSED AMENDMENT ADDRESS IS CHICKEN AND DUCK KEEPING IN THE PD UH, ZONING DISTRICT.

SO THE CURRENT REGULATIONS ALLOW CITIZENS TO KEEP CHICKENS AS AN ACCESSORY USE ON OCCUPIED RESIDENTIAL PROPERTIES IN THE R 33, R 20 R 13, AND WCI ZONING DISTRICTS AND UNOCCUPIED RESIDENTIAL PROPERTIES THAT HAVE LESS THAN TWO USABLE ACRES IN AREA IN THE RC AND RR DISTRICTS.

CITIZENS LIVING IN SINGLE FAMILY HOMES IN THE PD ZONING DISTRICT HAVE EXPRESSED THEIR DISAPPOINTMENT IN BEING BARRED FROM RESIDENTIAL CHICKEN KEEPING.

IN THE PAST, THE PROPOSED TAX AMENDMENTS WOULD ADD PD AS A PERMITTED DISTRICT FOR BACKYARD CHICKEN OR DUCK KEEPING, AND CLARIFY THAT BACKYARD CHICKENS AND DUCKS ARE ONLY ALLOWED ON PROPERTIES WITH OCCUPIED DETACHED SINGLE FAMILY DWELLINGS BECAUSE THE PROPOSED TAX AMENDMENTS REQUIRE CITIZENS TO CONDUCT THEIR CHICKEN OR DUCK KEEPING ACTIVITIES ON PROPERTIES WITH AN OCCUPIED, DETACHED SINGLE FAMILY DWELLING IN ALL ALLOWABLE DISTRICTS, THERE'S NO REASON TO EXCLUDE THE PD ZONING DISTRICT, THOUGH THE LAST PROPOSED AMENDMENT REMOVES THE REQUIREMENT TO APPLY FOR A SPECIAL USE PERMIT TO REDUCE THE SETBACK FOR A CHICKEN OR DUCK ENCLOSURE.

SO THE CURRENT REGULATIONS UNDER SECTION 24.1 DASH FOUR 14.1 ALLOW CITIZENS TO APPLY FOR A SPECIAL USE PERMIT IF THEY WISH TO PLACE A CHICKEN ENCLOSURE CLOSER TO THEIR PROPERTY LINES THAN THE STANDARDS PERMIT.

NORMALLY, IF A CITIZEN WISHES TO BUILD A STRUCTURE OR ACCESSORY STRUCTURE CLOSER TO A LOT LINE THAN THE ZONING ORDINANCE PERMITS, THEY WOULD REQUEST A VARIANCE FROM THE BOARD OF ZONING AND SUBDIVISION APPEALS NOT AS SPECIAL USE PERMIT.

ACCORDINGLY, A REQUEST TO OBSERVE A LESSER SETBACK FOR CHICKEN AND OR DUCK ENCLOSURES SHOULD BE HANDLED THE SAME WAY SINCE THE REQUEST IS NOT FOR AN APPROVAL OF A PARTICULAR LAND USE, BUT FOR AN EXCEPTION FROM THE LOCATION STANDARD PRESCRIBED BY THE ZONING ORDINANCE.

THEREFORE, THE PROPOSAL REMOVES THE REQUIREMENT TO APPLY FOR A SPECIAL USE PERMIT TO OBSERVE SETBACKS OF A LESSER DIMENSION.

FROM THIS SECTION, THE SECTION WOULD STILL ALLOW A CITIZEN TO APPLY FOR A VARIANCE AND THEIR REQUEST TO BE CONSIDERED AT A PUBLIC HEARING.

I'M GONNA CLOSE WITH STAFF'S RECOMMENDATION.

SO THE PROPOSED TEXT AMENDMENTS WOULD REMOVE, UH, DUCKS FROM THE PRO, EXCUSE ME, REMOVE DUCKS FROM THE LIST OF PROHIBITED FOWL, ALLOW CHICKEN AND OR DUCK KEEPING ON PROPERTIES WITH OCCUPIED, DETACHED SINGLE FAMILY HOMES IN THE PD ZONING DISTRICT, AND REMOVE THE OPTION TO APPLY FOR A SPECIAL USE PERMIT TO LOCATE A CHICKEN AND OR DUCK ENCLOSURE CLOSER TO THE PROPERTY LINE THAN THE CODE PERMITS.

THE ADDITION OF DUCKS AS A BACKYARD POULTRY KEEPING ACTIVITY WOULD NOT HAVE ANY MORE IMPACT ON THE COUNTY'S NEIGHBORHOODS THAN CHICKEN KEEPING ALONE BECAUSE ALL RESIDENTIAL POULTRY KEEPING OPERATIONS MUST OCCUR ON PROPERTIES WITH OCCUPIED, UH, SINGLE FAMILY DETACHED DWELLINGS.

NO NEGATIVE IMPACTS ARE ANTICIPATED BY ALLOWING THE KEEPING OF CHICKENS AND DUCKS IN THE PD DISTRICT.

FINALLY, THE REMOVAL OF THE OPTION TO APPLY FOR A SPECIAL USE PERMIT TO OBSERVE A CHICKEN AND OR DUCK ENCLOSURE, UH, SETBACK OF A LESSER DIMENSION REPRESENTS A SIMPLE PROCEDURAL CHANGE TO BRING THIS SECTION INTO CONFORMANCE WITH HOW SUCH ZONING VARIANCE REQUESTS ARE CONSIDERED AND APPROVED.

THEREFORE, STAFF RECOMMENDS APPROVAL THROUGH THE ADOPTION OF PROPOSED RESOLUTION NUMBER PC 25 DASH OH THREE.

WHEN IT COMES TO THE SETBACK IS IF THE, UM, OCCUPANT DECIDES TO PUT THIS RIGHT UP AGAINST THE PROPERTY LINE, IS THAT APPROVED ADMINISTRATIVELY OR DOES HE AUTOMATICALLY HAVE THE RIGHT TO DO THAT? NO.

SO, UH, OUR ORDINANCE, UH, REQUIRES THAT A CHICKEN COOP BE SET BACK 10 FEET FROM THE PROPERTY LINE, UH, AS THE STANDARDS EXIST.

NOW, THEY WOULD APPLY FOR A SPECIAL USE PERMIT IF THEY WANT TO OBSERVE A LESSER SETBACK, IF THEY WANTED TO PUT THAT RIGHT BY THE FENCE.

HOWEVER, WHAT WE'RE PROPOSING IS THAT, UM, THEY, THEY DON'T GET A SPECIAL USE PERMIT.

INSTEAD THEY APPLY FOR A, A VARIANCE WITH THE BZA, THE BOARD OF ZONING AND SUBDIVISION APPEALS.

FROM THAT THEY ALSO APPROVED THE SEXUALLY ORIENTED BUSINESSES.

UH, THE, OR NO, NOT THE BUSINESSES.

THE ORDINANCE FOR THE SEXUALLY ORIENTED BUSINESSES WAS APPROVED ON THE 21ST.

UM, SO THAT HAS NOW GONE INTO EFFECT.

SO ANY ADULT BUSINESSES THAT WOULD COME INTO THE COMMUNITY WOULD HAVE TO FOLLOW THOSE, UH, REGULATIONS.

NOW THE BOARD IS, UM, SET TO HEAR NEXT WEEK AT THEIR FEBRUARY 18TH MEETING, THE CRUISE SHIP ZONING ORDINANCE CHANGES THAT'LL BE ON THAT AGENDA.

AND ALSO THE LANDSCAPING AND BUFFERING REGULATIONS WILL ALSO BE ON THAT AGENDA.

WHAT WILL NOT BE ON THAT AGENDA, WHICH YOU ALL REVIEWED AT YOUR LAST MEETING, WAS THE PAND EXPRESS SIGN INCREASE THAT THEY HAD REQUESTED.

SO THAT AFTER THAT MEETING, THERE WERE SOME DISCUSSIONS WITH THE APPLICANT AND THE APPLICANT DECIDED TO WITHDRAW THEIR APPLICATION.

SO THEY DID WITHDRAW AND THERE, I BELIEVE THEY'RE CHANGING THE SIZE OF THEIR SIGNS SO THAT THEY BETTER MATCH UP WITH WHAT THEY WANT, BUT AT A SMALLER SIZE.

AND THEN LET'S SEE, YOU REVIEW, YOU REVIEW THE CHICKEN KEEPING TONIGHT.

UH, YOU'LL SEE THAT WE ALSO HAVE SEVERAL SPECIAL USE PERMITS.

UH, WE HAVE A MINI STORAGE AND RECREATIONAL VEHICLE STORAGE FACILITY THAT'S GOING IN WHERE THE OLD, UM, DUTIES, UH, JUNKYARD IS ON 17.

UM, THEY'RE LOOKING TO BUY THAT PROPERTY AND PUT A MINI STORAGE AND RECREATIONAL VEHICLE STORAGE FACILITY THERE.

SO AN IMPROVEMENT TO THAT PROPERTY, UH, THAT'LL BE A TWO SPECIAL USE PERMITS BEFORE YOU NEXT TIME.

AND THEN KIND OF IN RELATION TO THE ORDINANCE WE HAD TONIGHT, UH, WE HAVE HAD SOMEONE WHO HAS APPLIED TO HAVE THEIR CHICKEN COOP ONE FOOT FROM THEIR PROPERTY LINE.

AND SO THAT WILL BE BEFORE YOU AT THE NEXT, AT YOUR NEXT MEETING.

AND THEN LASTLY, UM, ONCE SITE PLAN THAT I THINK YOU'D PROBABLY BE INTERESTED IN IS IN THE KMART, THE OLD KMART STRUCTURE IN KILN CREEK.

SO THE FAR END WHERE THE LITTLE GARDEN CENTER IS.

UM, THAT'S, UH, WE GOT A, UH, SITE PLAN FOR AN ADVANCE OR NO AUTO ZONE RETAIL SPACE.

SO THEY PLAN TO RENOVATE THAT SPACE AND PUT AN AUTO ZONE ON THAT SIDE OF THE, THE K WHERE THE KMART USED TO BE.

AND THEN I THINK THE MIDDLE PART POSSIBLY MIGHT BE GOING TO KROGER.

WE HAVEN'T HEARD ANYTHING FUTURE FROM THEM, BUT THEY MAY BE EXPANDING THERE

SO THAT WILL BE COMING BEFORE YOU EVENTUALLY, UH, FOR YOU TO REVIEW THE PARK, UM, GOING IN THERE.

OTHER THAN THAT, THE ONLY OTHER NEWS I HAVE IS A LITTLE UNFORTUNATE AND SAD NEWS.

UM, UM, ELGI ROMAN, WHO HAS BEEN WITH OUR OFFICE FOR, UM, A LITTLE A YEAR AND A HALF, I BELIEVE.

UM, SHE HAS TAKEN A JOB AT ANOTHER PLACE.

UM, SHE'S GOING BACK TO THE NONPROFIT SHE USED TO WORK WITH, UH, ABOUT FOUR YEARS AGO.

I THINK THAT'S WHAT YOU TOLD ME ABOUT FOUR YEARS AGO.

AND SO SHE'LL BE LEAVING US THE END OF THIS MONTH.

SO THIS IS HER LAST PLANNING COMMISSION MEETING WITH US.

AND, UH, SO WE'LL HAVE A NEW FACE HOPEFULLY SOON, BUT WE WILL MISS, UM, ELGI AND, UM, ALL THE GREAT THINGS THAT SHE BRINGS TO THE OFFICE AND, UH, HER PERSONALITY AND, UH, FRIENDLINESS AND HARD, HARDWORKING RESEARCH THAT SHE DOES ALL THE TIME.

SO WE REALLY APPRECIATE HER AND WE THANK HER FOR, FOR, UH, COMING TO WORK WITH US FOR THE TIME THAT SHE'S BEEN HERE.
