IN ADDITION, THE APPLICANT STATED THAT THEY, THEY DO NOT WISH TO HAVE SIGNS ADVERTISING THE TOURIST HOME.
THEREFORE, STAFF HAS PROPOSED A CONDITIONAL OF APPROVAL THAT WOULD PROHIBIT THEM.
THE APPLICANT'S PROPOSAL MEETS THE STANDARD STANDARDS OF THE ZONING ORDINANCE AND IS CONSISTENT WITH THE TYPE AND INTENSITY OF PREVIOUSLY APPROVED TOURIST HOMES.
STAFF BELIEVES THE ADDITION OF ANOTHER TOURIST HOME IN THIS AREA IS NOT LIKELY TO DEGRADE THE CHARACTER OF THE VILLAGE.

DURING THE SEPTEMBER MEETING, WE PRESENTED, UH, YOU WITH A REVISED RESOLUTION THAT CONTAINED A NUMBER OF STANDARDS PROVIDED BY THE COUNTY'S DEPARTMENT OF FIRE AND LIFE SAFETY OR FLS FOR SHORT.
SINCE THEN, THE PLANNING DIVISION AND FLS WORKED TOGETHER TO REFINE THE PROPOSED TEXT AMENDMENTS.
UH, SINCE YOU ALREADY HEARD THE FULL PRESENTATION IN SEPTEMBER, I'M ONLY GONNA DISCUSS THE SUBSTANTIAL CHANGES THAT WERE MADE IN THE INTERIM.
SO RETURNING TO THE SAFETY PROVISION, SECTION FLS PUBLISHED A SET OF STANDARDS FOR DATA CENTERS TITLED YORK COUNTY DEPARTMENT OF FIRE AND LIFE SAFETY STANDARDS FOR DATA CENTERS.
A COPY OF WHICH YOU RECEIVED IN YOUR PACKET, FLS AGREED TO MOVE THE STANDARDS FROM THE PROPOSED ORDINANCE TO A SEPARATE GUIDELINES DOCUMENT, WHICH THEY WILL PUBLISH ON THE COUNTY'S WEBSITE.
DATA CENTER DEVELOPERS WOULD BE REQUIRED TO PROVIDE DOCUMENTATION DESCRIBING HOW THE PROPOSED DATA CENTER WOULD ADDRESS THE GUIDELINES.
THERE ARE A COUPLE OF PROVISIONS WE AGREED SHOULD REMAIN IN THE ORDINANCE, INCLUDING SECTION H TWO, WHICH PROHIBITS PARKING SPACES FROM BEING LOCATED WITHIN 30 FEET OF THE BUILDING TO ALLOW FIRE APPARATUS UNOBSTRUCTED ACCESS.
AND SECTION H THREE, WHICH REQUIRES DRY VIALS TO BE DESIGNED WITH THE MINIMUM TURNING RADIUS OF 33 FEET TO ACCOMMODATE ALL YORK COUNTY DEPARTMENT OF FIRE AND LIFE SAFETY APPARATUS.
SO IN CLOSING, THE PROPOSED ORDINANCE ALLOWS DATA CENTERS ONLY BY SPECIAL USE PERMIT IN THE ECONOMIC OPPORTUNITY, LIMITED INDUSTRIAL AND GENERAL INDUSTRIAL ZONING DISTRICTS, AND MAKES THEM SUBJECT TO PERFORMANCE STANDARDS THAT WOULD ADDRESS THE POTENTIAL IMPACTS A DATA CENTER MIGHT HAVE ON THE SURROUNDING AREA.
THE PROPOSED PERFORMANCE STANDARDS, UH, ADDRESS, ENERGY AND WATER USAGE, NOISE GENERATION, SETBACKS AND BUFFERS, ARCHITECTURAL STANDARDS AND SAFETY PROVISIONS.
SO STAFF RECOMMENDS APPROVAL OF RESOLUTION NUMBER PC 24 DASH NINE R TWO.
