THIS RESPONSIBILITY IS EXERCISED THROUGH RECOMMENDATIONS CONVEYED BY RESOLUTIONS OR OTHER OFFICIAL MEANS AND ALL ARE MATTERS OF PUBLIC RECORD.

IT'S FOR ACCESSORY FUEL DISPENSING AND ONE IS FOR MINI STORAGE WAREHOUSES.

SO YOU'LL SEE THERE, UM, I'VE OUTLINED THE PARCEL IN THAT BRIGHT BLUE HIGHLIGHT.

THAT'S 9 0 5 DENBY BOULEVARD, THE SUBJECT PARCEL, IT'S ALMOST SIX ACRES.

UM, AND YOU'LL SEE ALSO IT ACTUALLY ABUTS THE CITY OF NEWPORT NEWS.

I'VE SHOWN THE JURISDICTIONAL BOUNDARY IN THAT SORT OF LIKE DASHED PINK HIGHLIGHT THERE.

THE PARCEL ZONE GENERAL BUSINESS, IT'S SURROUNDED BY GENERAL BUSINESS PROPERTIES.

IT'S ALSO ZONED COMMERCIAL IN THE COMPREHENSIVE PLAN.

UM, AND YOU KIND OF SEE THAT IT'S A TRANSMISSION EASEMENT.

SO YOU SEE IT CLEARED THROUGH A STRAIGHT DOWN THROUGH THE PROPERTY AND THEN THROUGH DANBY.

UM, THE CONCEPT PLAN SHOWS A NUMBER OF USES THAT LITTLE MORE THAN WHAT'S COVERED BY THESE TWO APPLICATIONS.

SO I'M GONNA KIND OF BREAK THAT DOWN.

SO THE SUBJECT OF THE TWO APPLICATIONS TONIGHT ARE THE TWO PROPOSED SPECIAL USES.

AGAIN, THERE'S THAT ACCESSORY FUEL PUMPS.

THERE'S GONNA BE SIX PUMPS ON THREE FUEL ISLANDS.

AND THE OTHER ONE IS THAT MINI STORAGE WAREHOUSING THAT'S GONNA BE LOCATED BEHIND THE CONVENIENCE STORE.

AND THEY'RE PROPOSING EIGHT WAREHOUSE BUILDINGS WITH 225 UNITS OF VARYING SIZES.

SO THAT'S A VIEW OF THAT CONCEPT PLAN.

UM, I WILL MAKE THAT LARGER IN THE NEXT SLIDE FOR THE GAS PUMPS, 'CAUSE I KNOW IT'S A LITTLE HARD TO SEE, BUT I TRIED TO SORT OF HIGHLIGHT CC IN THE REAR THERE, THE PROPOSED MINI STORAGE BEHIND THE CONVENIENCE STORE.

IT'S GONNA BE GATED.

AND THEN TO THE FRONT THERE, THE GAS PUMPS, THOSE ARE GONNA BE LOCATED IN FRONT OF THE CONVENIENCE STORE.

UM, PRETTY CLOSE TO THE TWO DRIVEWAYS ON DENBY.

AND THERE'S SOME LITTLE CANOPY OVER THOSE GAS PUMPS AS WELL.

YOU ALSO NOTICE ON THAT CONCEPT PLAN THERE'S SOME BUYRIGHT USES AS WELL.

SO THERE IS A TWO STORY COMMERCIAL BUILDING PROPOSED TO BE RIGHT NEXT TO THE CONVENIENCE STORE.

THEY HAVEN'T IDENTIFIED LIKE A SPECIFIC USE OR USER IN THAT COMMERCIAL BUILDING YET.

CURRENTLY IT'S SORT OF THE PARKING WAS CALCULATED, I'LL GET INTO THAT LATER.

WAS CALCULATED, IS IT LIKE A WHOLESALING OFFICE SORT OF USE, BUT AGAIN, NO SOLID IDENTIFIED USE OR USER.

THE OTHER USE IS A DRIVE THROUGH THAT'S GONNA BE ATTACHED TO THE CONVENIENCE STORE.

NOW I WANNA POINT OUT THE DRIVE THROUGH ITSELF IS BY RIGHT.

HOWEVER, TO ACCOMMODATE THE DRIVE THROUGH THE CONVENIENCE STORE IS GONNA BE EXPANDED.

NOW THE CONVENIENCE STORE IS LEGALLY NON-CONFORMING AS A USE.

SO TO EXPAND THEY'RE GONNA HAVE TO GET A SPECIAL EXCEPTION AND THAT GOES DIRECTLY TO THE BOARD OF SUPERVISORS FOR APPROVAL.

SO THAT WILL BE GOING IN MAY, HOPEFULLY IN TANDEM WITH THESE TWO APPLICATIONS TO THE BOARD MEETING.

SO AGAIN, JUST KIND OF VISUALLY SHOWING YOU ON THE CONCEPT PLAN, CIRCLED IN BLUE IS THE PROPOSED COMMERCIAL BUILDING.

AND THEN I'VE HIGHLIGHTED THAT'S THE EXPANSION AREA OF WHERE THE EXISTING CONVENIENCE STORE IS GONNA BE BUMPED OUT A LITTLE BIT AND WHERE THE DRIVE THROUGH IS GONNA GO.

SO IN YOUR PACKET YOU'LL SEE THAT A TRAFFIC IMPACT ANALYSIS WAS SUBMITTED AS PART OF THESE APPLICATIONS.

UM, WON'T GO THROUGH THE WHOLE THING 'CAUSE IT'S A LITTLE LENGTHY, BUT TO BREAK DOWN THE IMPACTS ON THIS SITE.

SO THIS SECTION OF DENBY CARRIES ABOUT 12,700 TRIPS DAILY BASED ON VDOT NUMBERS.

SO WHAT THE CONSULTANT DID FOR THE TIA IS ESSENTIALLY SHE TOOK ESPECI ALL THE COMBINED USES ON SITE.

SO EITHER THE, THE SPECIALLY PROPOSED USES, THE MINI STORAGE AND THE GAS PUMPS THAT ARE PROPOSED, THE APPLICATION, THE EXISTING USE OF THE CONVENIENCE STORE.

AND THEN SHE ALSO LOOKED AT THE COMMERCIAL BUILDING AS WELL.

SO COMBINING ALL THOSE TOGETHER, AS FOR TRIP GENERATION, WE GET ABOUT 2,500 DAILY TRIPS FOR ALL THE PROPOSED LAND USES.

COMBINED.

I WANNA POINT OUT, UM, FOR CONVENIENCE STORES AND GAS STATIONS, TYPICALLY, UM, WHEN YOU'RE DOING A TRAFFIC ANALYSIS, THEY'LL APPLY WHAT'S CALLED A PASS BY REDUCTION.

UM, THE ASSUMPTION IS THAT, YOU KNOW, TRIPS WOULD LESSEN BECAUSE PEOPLE WOULD PASS BY THE USE IN THE INTEREST OF BEING CONSERVATIVE FOR THIS ANALYSIS, THOUGH, THE CONSULTANT DID NOT DO THAT.

SO KIND OF THE CULMINATIVE IMPACT OF THE ANALYSIS OF THIS DEVELOPMENT.

ALSO, THE CONSULTANT ALSO TOOK INTO ACCOUNT WHAT'S GOING ON WITH HUNTINGTON AND TOOK INTO ACCOUNT THEIR TRAFFIC AND PAST ANALYSIS THAT WAS SUBMITTED AND THE EVENTUAL INTENDED SIGNALIZATION OF THE INTERSECTION OF INDEPENDENCE IN DENBY WHEN BUILD OUT OCCURS, CONCLUDED THAT THE APPROPRIATE TR APPROPRIATE, UM, TRAFFIC IMPROVEMENTS.

SO STRIP A LEFT TURN LANE ON DENBY THAT WOULD HAVE 200 FEET OF STORAGE ADDING TAPER TO THE EXISTING RIGHT TURN LANE.

THEY DID A TURN LANE WARRANT IN THE REVISED ANALYSIS.

AND THEN

ANOTHER PORTION IS, SO DENBY MIGHT MAYBE BE WIDENED EVENTUALLY SOMEDAY TO A FOUR LANE DIVIDED HIGHWAY.

IT'S NOT IN THE PHYSICALLY CONSTRAINED LONG RANGE TRANSIT PREVENTATION PLAN RIGHT NOW, THOUGH.

SO AS TO LIKE, REALISTICALLY WHEN THAT OCCUR, WE CAN'T REALLY SAY.

SO THE CONSULTANT OFFERED WHICH STAFF AGREES WITH THAT TO JUST LEAVE THE EXISTING SITE ENTRANCES ALONE FOR RIGHT NOW INSTEAD OF CONVERTING THEM TO LIKE A, YOU KNOW, RIGHT OUT ONLY RIGHT IN ONLY SITUATION TO BRIEFLY TOUCH ON PARKING.

SO YOU SEE ON THE CHART THERE PROVIDED YOU FOR EACH LAND USE, PROPOSED ON SITE THE REQUIRED PARKING.

AND THEN WHAT'S PROVIDED ON THE CONCEPT PLAN.

ONE, EXPLAIN A COUPLE DISCREPANCIES.

FIRST IS, SO THIS ISN'T REALLY A DISCREPANCY, BUT FOR THE COMMERCIAL BUILDING YOU'LL SEE NUMBER 15, AGAIN, THAT MIGHT CHANGE WHEN THIS GOES TO SITE PLAN BASED ON LIKE AN ACTUAL, LIKE CERTAIN RETAIL USE THAT'S IDENTIFIED FOR THAT BUILDING RIGHT NOW.

AGAIN, IT'S KIND OF ASSUMED AT BEING, UM, WHOLESALE OFFICE.

SO THAT'S WHERE THAT 15 NUMBER COMES.

AGAIN, THAT COULD CHANGE.

UM, FOR THE MINI STORAGE WAREHOUSE FACILITY.

I'VE SHOWN THIS ON THIS SIDE, THERE'S 12 SPACES SHOWN.

THE OFFICE IS GONNA GENERATE TWO SPACES BY ITSELF.

SO AN ADDITIONAL TWO SPACES ARE GONNA NEED TO BE PROVIDED ON THE SITE PLAN FOR THIS, THE MINI STORAGE.

AND THAT'S JUST ANOTHER MORE ZOOMED IN VIEW OF THE CONCEPT PLAN AND WHERE THE PARKING'S ALL GOING TO BE LOCATED.

AGAIN, YOU'LL NOTE THAT DUE TO THE DOMINION EASEMENT, PARKING'S PRETTY TIGHT ON THE SITE.

IF THERE NEEDS TO BE ADDITIONAL PARKING, I'M NOT SURE WHERE IT WOULD GO.

I WANTED TO BRIEFLY TOUCH ON THE SIGN.

SO YOU'LL SEE THAT IN THE PHOTO, THAT IS THE OLD RIP SIGN.

IT'S BEEN REPURPOSED FOR THE CURRENT USER THERE.

ASSUMING THE APPLICANT'S PROBABLY GONNA WANT TO ADVERTISE ALL OF THEIR BUSINESSES, UM, WE PROPOSE A CONDITION THAT'S GONNA REQUIRE MONUMENT SIGN ONE SINGLE MONUMENT SIGN FOR ALL THE COMBINED USES ON SITE.

SO I'M GONNA BRIEFLY GO OVER SOME PROPOSED CONDITIONS.

UM, THIS IS FOR THE GAS PUMP SPECIFICALLY.

WE'RE RECOMMENDING THAT THE RIGHT OF WAY IMPROVEMENTS BE INSTALLED.

GREEN BELT BUFFER.

SO DEBY BOULEVARD IS A GREEN BELT ROAD.

UM, THE SITE'S DEVELOPED RIGHT NOW AND UNFORTUNATELY DUE TO KIND OF WHERE THE VDOT RIGHT AWAY IS, AND THEN HOW THE SITE WAS PREVIOUSLY DEVELOPED, THERE'S NO, THERE'S, YOU'LL SEE THIS LIKE LITTLE GRASSY MEDIAN STRIP, UM, IN THE FRONT YARD.

IT'S NOT VERY BIG.

SO TAKING THAT INTO CONSIDERATION STAFF IS REQUIRING A RESTORATION OF THE GREEN BELT BUFFER AS IS FEASIBLE FOR WHAT CAN BE PLANTED THERE TO JUST KIND OF RESTORE IT.

UM, REITERATING A CONDITION THAT THE GAS PUMPS AND THE TANKS CANOPY, EVERYTHING ASSOCIATED WITH IT.

THE ISLANDS, IF THE USE CEASES FOR NINE CONSECUTIVE MONTHS, THOSE ARE GONNA HAVE TO GO AWAY AND BE REMOVED.

THAT SINGLE MONUMENT SIGN FOR ALL USES I MENTIONED EARLIER.

AND THEN FIRE CODE COMPLIANCE, LIKE SUBMITTING A HAZMAT PLAN AND THEN SOME PROPOSED CONDITIONS OF APPROVAL.

THIS IS MORE SPECIFIC TO THE MINI STORAGE, UM, FENCING.

WE'D LIKE THAT TO BE A BLACK ROT, IRON MATERIAL.

UM, AND PROHIBITING LIKE RAZOR WIRE OR BARBED WIRE FROM GOING ON TOP OF IT.

NOX BOX FOR THE GATES.

SO THE FIRE DEPARTMENT CAN HAVE ACCESS TO THE STORAGE UNITS.

THERE'S A CONDITION THAT REGARDING THE STORMWATER POND.

SO YOU'LL SEE IN THE CONCEPT PLAN THE BMPS LOCATED IN THE DOMINION EASEMENT.

AND DONALD DAVIS COULD CORRECT ME IF I'M WRONG ON THIS, BUT WE, MY UNDERSTANDING IS WE DON'T HAVE SPECIFIC PERMISSION YET FROM DOMINION TO PUT THE BMP IN THE DOMINION EASEMENT.

SO IN THE CASE OF THIS GOING TO SITE PLAN AND THEM COMING BACK AND SAYING, HEY, CAN'T PUT YOUR BMP IN OUR EASEMENT, THE CONDITION ESSENTIALLY SAYS STORMWATER INFRASTRUCTURE AND ASSOCIATED IMPROVEMENTS ARE GONNA NEED TO BE LOCATED ELSEWHERE ON SITE AND ACCOMMODATED TYPE 25 TRANSITIONAL BUFFER.

SO YOU CAN SEE IF WE'RE GONNA BE PUTTING THIS MINI STORAGE IN, THERE ARE APARTMENTS TO THE NORTH.

WE WANNA BUFFER THOSE.

SO WHEN YOU HAVE A JURISDICTIONAL BOUNDARY, A TYPE 25 BUFFER IS REQUIRED.

IF THE ADJACENT PARCELS IN THE OTHER JURISDICTION ARE RESIDENTIALLY ZONED OR UTILIZED RESIDENTIAL IN THIS CASE, YES, THERE ARE, THERE'S APARTMENTS.

SO WE'RE GONNA INCLUDE THAT AS A CONDITION OF APPROVAL.

AND AGAIN, THAT SINGLE MONUMENT SIGN FOR ALL USES.

SO STAFF FEELS THAT THIS APPLICATION DOES PRESENT AN OPPORTUNITY TO RESTORE THE GREEN BUTT BUFFER ON DENBY TO PUT IN A TRANSITIONAL BUFFER BETWEEN THE COMMERCIAL USE AND THE APARTMENTS AND REALLY OFFERS AN OPPORTUNITY ALSO RESTORE THE PROPERTY A LITTLE BIT.

THERE ARE SOME CONCERNS A LOT OF TIMES WITH, ESPECIALLY WITH GAS STATIONS, WITH BLIGHT OR DEGRADATION OF KIND OF THE CONDITION OF THE PROPERTY.

HOWEVER, WE FEEL THAT THE ZONING ORDINANCE HAS A LOT OF STANDARDS TO PREVENT THAT.

AND OUR PROPOSED CONDITIONS ARE A KIND OF AN ADEQUATE SAFEGUARD TO PREVENT FURTHER BLIGHT.

THIS IS COMPATIBLE WITH THE SURROUNDING LAND USES, AGAIN, THIS WHOLE KIND OF CORRIDOR ZONE GENERAL BUSINESS, AND THAT'S KIND OF THE INTENT OF THE AREA.

THIS WOULD SERVE USERS IN HUNTINGTON'S SUPPOSEDLY AS WELL.

AND THEN ULTIMATELY A SITE PLAN'S GONNA HAVE TO BE APPROVED FOR THIS.

SO, AND IT'S KIND OF THINKING OF THE PARKING QUESTIONS AGAIN, THEY'LL STILL HAVE TO SUBMIT A SITE PLAN THAT'S GONNA HAVE TO GO THROUGH AND BE APPROVED.

SO, UH, THE TOP ITEM THERE ON SHORT TERM RENTALS, WHICH WAS ZT 1 94 22, UH, STAFF HAS BEEN MEETING WITH THE BOARD DURING THEIR WORK SESSIONS THE LAST TWO MONTHS TO KIND OF GO OVER CHANGES THAT THEY WANT TO SEE.

UM, IF YOU'RE VERY, IF YOU'RE INTERESTED IN THAT DISCUSSION, THE LAST WORK SESSION IS ONLINE AND I WOULD SAY, TAKE A LOOK AT THAT.

UM, THEY HAVE REQUESTED, UM, THINGS LIKE, UM, NO SHORT TERM RENTALS WITHIN A HALF MILE AND A QUARTER MILE OF EACH OTHER MILE.

AND THEN I THINK THERE WAS LIKE FOR RF SEVEN 50 FEET.

IT WOULD BE THINGS THAT THEY WOULD, WOULD APPROVE.

SO WE'VE GOT A COUPLE ROUTES THAT WE CAN GO DEPENDENT ON, UM, HOW SB 5 44 GETS MOVED THROUGH THE HOUSE AND SENATE.

UH, SOME, SOME LANDSCAPING AMENDMENTS THERE ALONG THEIR FRONTAGE.

UM, OTHER ONES THAT YOU HAVE APPROVED THAT HAVE BEEN SUBMITTED IS LIKE THE PANDA EXPRESS, WHICH WAS UP ON, UP IN THE LIGHTFOOT UP IN ON MOTOWN ROAD.
