TO AUTHORIZE AN EXISTING AUTOMOTIVE REPAIR SHOP TO RENT TRUCKS AT 8 4 2 7 GEORGE WASHINGTON MEMORIAL HIGHWAY.

THE SUBJECT PROPERTY, WHICH IS OCCUPIED BY CLIFFS AUTOMOTIVE, IS A 1.9 ACRE PARCEL LOCATED ON ROUTE 17 ACROSS THE YORKTOWN LIBRARY.

THE SUBJECT PROPERTY IS ZONED GB FOR GENERAL BUSINESS AND DESIGNATED GB IN THE COMPREHENSIVE PLAN.

THE SURROUNDING PARCELS ARE GB AND R 24.

MEDIUM DENSITY RESIDENTIAL TO THE NORTH IS A VACANT PARCEL, WHICH IS THE FUTURE SITE OF RIVERSIDE HEATING AND COOLING TO THE EAST IS ROUTE 17, AND THE YORKTOWN LIBRARY TO THE SOUTH IS CLAREMONT WAY AND A VACANT 12.5 ACRE PARCEL WITH A SINGLE FAMILY DETACHED HOME ZONED GB AND TO THE WEST IS A ONE SINGLE FAMILY DETACHED HOME.

THE APPLICANT, MR. FAIRBANKS, IS REQUESTING TO RENT THREE PENSKE TRUCKS, WHICH WOULD BE PARKED NEXT TO THE GOLF CARTS THAT WERE APPROVED IN THE PREVIOUS SPECIAL USE PERMIT.

THE ZONING ORDINANCE PERMITS HEAVY TRUCK RENTALS IN THE GB DISTRICT ONLY UPON THE ISSUANCE OF A SPECIAL USE PERMIT.

THE SPECIAL USE PERMIT REQUIREMENT RECOGNIZES THAT AUTO RELATED USES COULD HAVE ADVERSE EFFECTS ON THE CHARACTER AND AESTHETIC QUALITY OF THE COUNTY'S MAJOR CORRIDORS, AND THAT SOME AREAS MAY NOT BE SUITABLE FOR AUTO RELATED USES UNDER ANY CONDITIONS.

IN THIS CASE, THE AUTO RELATED USE AND AUTO REPAIR FACILITY HAS ALREADY BEEN ESTABLISHED AND THE APPLICANT, THE APPLICANT IS SIMPLY REQUESTING THE OPPORTUNITY TO OFFER TRUCK RENTALS.

STAFF HAS PROPOSED CONDITIONS OF APPROVAL LIMITING THE NUMBER OF TRUCK RENTALS THAT CAN BE DISPLAYED AT ANY ONE TIME TO THREE TO ENSURE THAT THE SCALE OF THE OPERATION REMAINS SMALL.

THE NARRATIVE SUBMITTED, UM, UM, WITH THE APPLICATION STATES THAT ALL TRUCKS WOULD BE PARKED OUTSIDE THE BUILDING DURING THE HOURS THAT CLIFF'S AUTOMOTIVE IS CLOSED AND THAT THE TRUCKS WOULD BE PARKED OUTSIDE, UH, AND WOULD BE USED FOR RENTAL PURPOSES LOCALLY.

AND ONE WAY THE TRUCKS MAY BE RETURNED TO THE LOCATION.

HOWEVER, TRUCKS MAY BE DROPPED OFF TO OTHER LOCATIONS OUTSIDE VIRGINIA.

STAFF HAS INCLUDED THIS AS A, UM, CONDITION OF APPROVAL AS MEMBERS OF THE COMMISSION WILL RECALL.

ON MAY 16TH, 2023, THE BOARD OF SUPERVISORS APPROVED A SPECIAL USE PERMIT APPLICATION TO ALLOW THE SALE OF GOLF CARTS ON THE SUBJECT PROPERTY.

SUBJECT TO CONDITIONS, THE PROPERTY HAS TWO EXISTING DRIVEWAYS, UH, ONE OF WHICH IS LOCATED APPROXIMATELY 85 FEET FROM THE INTERSECTION OF CLAREMONT WAY AND ROUTE 17.

THIS ENTRANCE DOES NOT MEET V DOT'S CURRENT ACCESS MANAGEMENT STANDARDS, AND THEY HAVE REQUESTED THAT THE COUNTY REQUIRE THIS ENTRANCE TO BE CLOSED AS A CONDITION OF APPROVAL.

CLOSING THIS DRIVEWAY WOULD REDUCE THE NUMBER OF CONFLICT POINTS AND IMPROVE SAFETY AT THAT INTERSECTION.

THEREFORE, STAFF HAS PROPOSED A CONDITION OF APPROVAL REQUIRING THE ENTRANCE TO BE CLOSED AND CONVERTED INTO A LANDSCAPE YARD THAT MEETS THE REQUIREMENTS OF THE ZONING ORDINANCE.

TO FURTHER ENHANCE THE PROPERTY, STAFF HAS PROPOSED AN ADDITIONAL CONDITION OF APPROVAL REQUIRING THE APPLICANT TO PLANT FOUR EVERGREEN SHRUBS, SHRUBS OF AT LEAST TWO FEET IN HEIGHT IN FRONT OF THE PROPOSED GOLF CART DISPLAY AREA.

UH, NOTE THAT MR. BANKS IS WORKING WITH A LANDSCAPE COMPANY TO COMPLY WITH THESE REQUIREMENTS.

THE ZONING ORDINANCE REQUIRES THAT TRUCK RENTAL AREA BE PAVED OR GRAVELED AND DOES NOT ALLOW ANY VEHICLES DISPLAYED

FOR RENT TO BE PARKED OR GRASS ON GRASS OR LANDSCAPE PORTIONS OF THE PROPERTY.

THE APPLICANT'S PROPOSAL TO PARK THE TRUCKS IN THE PAVED AREA MEETS THIS REQUIREMENT.

VDOT HAS REQUESTED THAT THE SOUTHERN ENTRANCE BE CLOSED AND CONVERTED INTO A LANDSCAPE YARD, AND THE APPLICANT SHALL PLANT FOR EVERGREEN SHRUBS OF AT LEAST TWO FEET.

AGAIN, MR. FAIRBANKS IS DILIGENTLY WORKING TOWARDS THESE REQUIREMENTS.

IN STAFF'S OPINION, ALLOWING AN EXISTING AUTO REPAIR FACILITY TO HAVE ACCESSORY TRUCK RENTALS REPRESENTS A FAIRLY SMALL INCREASE IN INTENSITY OF USE.

GIVEN THE SMALL SCALE OF THE PROPOSED USE.

STAFF BELIEVES IT IS UNLIKELY TO HAVE ANY ADVERSE IMPACTS ON THE SURROUNDING AREA, AND STAFF BELIEVES ANY IMPACT ON TRAFFIC WOULD BE NEGLIGIBLE.

IN ADDITION, THE SPECIAL USE PERMIT PRESENTS AN OPPORTUNITY TO BOTH MAKE THE NEARBY INTERSECTION SAFER AND IMPROVE THE APPEARANCE OF THE PROPERTY WITH LANDSCAPING.

FOR THESE REASONS, STAFF RECOMMENDS APPROVAL OF THIS APPLICATION SUBJECT TO THE CONDITION SET FORTH IN PROPOSED RESOLUTION NUMBER PC 24 DASH ONE.

UH, AS FAR AS RECENT ACTIONS BY THE BOARD AT THEIR DECEMBER 19TH MEETING, THEY APPROVED THE TWO YORKTOWN VILLAGE ACTIVITY APPLICATIONS FOR THE RESTAURANT ON WATER STREET AND REED STREET AND THE BOARDWALK DECK, UH, BETWEEN THE TWO RESTAURANTS.

SO THAT WAS APPROVED.

THEY ALSO APPROVED THE PANDA EXPRESS FAST FOOD RESTAURANT, UH, ON MOTOWN ROAD.

COMING UP AT THEIR MEETING NEXT, OR THIS TUESDAY, JANUARY 16TH, THEY

AND THEY'RE PROPOSING TO SET ASIDE, UH, APPROXIMATELY 3.7 ACRES, UH, OR I SHOULD SAY WHERE IT IS.

IT'S, IT'S ACROSS THE, FROM THE MARQUEE.

IT'S ON ROUTE 1 99 AND THAT LITTLE TRIANGLE BETWEEN 1 99 PENMAN ROAD AND WATER COUNTRY PARKWAY.

UH, LONG TIMERS WE'LL REMEMBER THAT THIS WAS A SITE THAT THE COUNTY HAD PLANNED TO PUT A MINOR LEAGUE BASEBALL STADIUM MANY YEARS AGO.
