THIS APPLICATION IS A REQUEST FOR A SPECIAL USE PERMIT TO AUTHORIZE AN EXISTING AUTOMOTIVE REPAIR FACILITY TO DISPLAY AND SELL GOLF CARTS.

THE SUBJECT PROPERTY, WHICH IS OCCUPIED BY CLIFFS AUTOMOTIVE, IS A 1.9 ACRE PARCEL LOCATED ON ROUTE 17 ACROSS FROM THE YORKTOWN LIBRARY.

THE SUBJECT PROPERTY IS ZONED GB FOR GENERAL BUSINESS AND DESIGNATED GB.

IN THE COMPREHENSIVE PLAN, THE SURROUNDING PARCELS ARE ZONED GB AND R 20.

FOR MEDIUM DENSITY RESIDENTIAL TO THE NORTH IS A VACANT PARCEL, UH, WHICH IS THE FUTURE SITE OF RIVERSIDE HEATING AND COOLING.

UH, TO THE EAST IS ROUTE 17 AND THE YORKTOWN LIBRARY BEYOND TO THE SOUTH IS CLAREMONT WAY AND BEYOND THAT IS A VACANT, UH, 12.5 ACRE PARCEL WITH AN ABANDONED SINGLE FAMILY DETACHED HOME ZONED GB.

AND TO THE WEST IS ONE SINGLE FAMILY DETACHED HOME.

HEY, THE APPLICANT, MR. CHRIS FAIRBANKS, SEEKS AUTHORIZATION TO SELL ELECTRIC GOLF CARTS AND DISPLAY UP TO FIVE AT A TIME ON THE SUBJECT PROPERTY.

AS AN ACCESSORY USE TO HIS EXISTING AUTO REPAIR FACILITY,

HE PROPOSES TO INSTALL A GRAVEL DISPLAY AREA MEASURING 15 BY 40 FEET IN THE NORTHERN CORNER OF THE PROPERTY ALLOW ALONG ROUTE 17.

HE ALSO STATED IN HIS PROPOSAL THAT THE GOLF CARTS WOULD BE STORED INSIDE THE BUILDING DURING THE HOURS THAT CLIFF'S AUTOMOTIVE IS NOT OPEN.

GOLF CART DEALERSHIPS ARE NOT EXPLICITLY ADDRESSED IN THE ZONING ORDINANCE.

HOWEVER, SINCE GOLF CARTS ARE VEHICLES, THE ZONING ADMINISTRATOR HAS DETERMINED THIS PROPOSED LAND USE TO BE SIMILAR TO AUTO OR LIGHT TRUCK SALES.

AUTO DEALERSHIPS ARE PERMITTED IN THE GB ZONING DISTRICT ONLY UPON THE ISSUANCE OF A SPECIAL USE PERMIT.

UM, THE SPECIAL USE PERMIT REQUIREMENT RECOGNIZES THAT AUTO-RELATED USES COULD HAVE ADVERSE, UH, EFFECTS ON THE CHARACTER AND AESTHETIC QUALITY OF THE COUNTY'S MAJOR CORRIDORS.

IN THIS CASE, THE AUTO RELATED USE AND AUTO REPAIR FACILITY HAS ALREADY BEEN ESTABLISHED, AND THE APPLICANT IS SIMPLY, UH, REQUESTING THE OPPORTUNITY TO DISPLAY AND SELL GOLF CARTS.

STAFF BELIEVE THE PROPOSED USE WOULD WOULD NOT HAVE A SIGNIFICANT IMPACT ON THE SURROUNDING AREA.

HOWEVER, STAFF HAS PROPOSED A NUMBER OF CONDITIONS TO ENSURE THE OPERATION REMAINS SMALL AND SCALE.

IN ACCORDANCE WITH THE APPLICANT'S PROPOSAL, STAFF HAS PROPOSED A CONDITION THAT WOULD REQUIRE ALL GOLF, GOLF CARTS ON THE PROPERTY TO BE SOLELY P SOLE, SOLELY POWERED BY ELECTRIC ENERGY TO ELIMINATE THE RISK OF GASOLINE LEAKING INTO THE GROUND.

PROPOSED CONDITIONS WOULD ALSO LIMIT THE NUMBER OF GOLF CARTS THAT CAN BE DISPLAYED ON THE PROPERTY AT ANY ONE TIME TO FIVE AND REQUIRE ALL GOLF CARTS TO BE STORED INSIDE DURING THE HOURS THAT CLIFFS IS NOT OPEN, UH, TO LIMIT THE VISUAL IMPACT OF THE OPERATION.

THE SUBJECT PROPERTY HAS TWO EXISTING DRIVEWAYS, ONE OF WHICH IS LOCATED APPROXIMATELY 85 FEET FROM THE INTERSECTION OF CLAREMONT WAY AND ROUTE 17.

THE ENTRANCE DOES NOT MEET, UH, VIDA'S CURRENT ACCESS MANAGEMENT STANDARDS, AND THEY'VE REQUESTED THAT THE COUNTY REQUIRED THIS ENTRANCE TO BE CLOSED AS A CONDITION OF APPROVAL.

CLOSING THIS DRIVEWAY WOULD REDUCE THE NUMBER OF CONFLICT POINTS AND IMPROVED SAFETY AT THE INTERSECTION.

THEREFORE, A STAFF IS PROPOSED A CONDITION OF APPROVAL REQUIRING THE ENTRANCE BE CLOSED AND CONVERTED INTO A LANDSCAPE YARD THAT MEETS THE REQUIREMENTS OF THE ZONING ORDINANCE.

TO FURTHER BEAUTIFY THE PROPERTY, STAFF HAS PROPOSED AN ADDITIONAL CONDITION OF APPROVAL REQUIRING THE APPLICANT TO PLANT FOUR EVERGREEN SHRUBS OF AT LEAST TWO FEET IN HEIGHT IN FRONT OF THE PROPOSED GOLF CART DISPLAY AREA.

THE ZONING ORDINANCE ALSO REQUIRES GOLF CART DISPLAY.

UH, THE GOLF CART DISPLAY AREA TO BE PAVED OR GRAVELED DOES NOT ALLOW ANY VEHICLES DISPLAYED FOR SALE TO BE PARKED ON GRASSED OR LANDSCAPED PORTIONS OF THE PROPERTY.

THE APPLICANT'S PROPOSAL TO INSTALL A 600 SQUARE FOOT GRAVEL PAD MEETS THIS REQUIREMENT.

STAFF HAS PROPOSED AN ADDITIONAL CONDITION OF APPROVAL LIMITING THE DISPLAY AREA TO THE 600 SQUARE FOOT AREA SHOWN ON THE SKETCH PLAN SUBMITTED BY THE APPLICANT.

THE COUNTY'S DEPARTMENT OF FIRE AND LIFE SAFETY HAS REQUESTED THE FOLLOWING CONDITIONS OF APPROVAL BE INCLUDED IN THE PROPOSED RESOLUTION.

NUMBER ONE, GOLF CARTS ARE NOT TO BE STORED ON THE PROPERTY UNTIL THE FIRE DEPARTMENT HAS COMPLETED AN INSPECTION OF THE BUSINESS TO ENSURE THERE ARE NO FIRE CODE VIOLATIONS.

NUMBER TWO, AN UPDATED EMERGENCY CONTACT FORM BE SUBMITTED TO THE EMERGENCY COMMUNICATION CENTER PRIOR TO THE COMMENCEMENT OF THE PROPOSED USE.

AND NUMBER THREE, A KNOX BOX BE INSTALLED ON THE PROPERTY PRIOR TO THE COMMENCEMENT OF THE PROPOSED USE TO ALLOW THE FIRE DEPARTMENT ACCESS IN CASE OF EMERGENCY.

THE INSTITUTE OF TRAFFIC ENGINEERS TRIP GENERATION MANUAL DOES NOT ADDRESS GOLF CART SALES.

IT DOES DISCUSS, UH, NEW CAR DEALERSHIPS, BUT ONLY ON, ON A MUCH LARGER SCALE THAN WHAT THE APPLICANT HAS PROPOSED.

REGARDLESS, GIVEN THE SMALL SCALE OF THE PROPOSED LAND USE, STAFF BELIEVE IT WOULD NOT GENERATE ANY SIGNIFICANT AMOUNT OF ADDITIONAL TRAFFIC TO THE LOCATION.

SO, IN STAFF'S OPINION, ALLOWING AN EXISTING AUTO REPAIR FACILITY TO HAVE ACCESSORY GOLF CART SALES REP REPRESENTS A FAIRLY SMALL INCREASE IN INTENSITY OF USE.

GIVEN THE SMALL SCALE OF THE PROPOSED USE, STAFF BELIEVE IT IS UNLIKELY TO PRODUCE ANY ADVERSE IMPACTS ON THE SURROUNDING AREA.

IN ADDITION, THIS SPECIAL USE PERMIT PRESENTS AN OPPORTUNITY TO BOTH MAKE THE NEARBY INTERSECTION SAFER AND IMPROVE THE APPEARANCE OF THE PROPERTY WITH LANDSCAPING.

FOR THESE THESE REASONS, STAFF RECOMMENDS APPROVAL OF THIS APPLICATION SUBJECT TO THE CONDITIONS SET FORTH IN PROPOSED RESOLUTION NUMBER PC 23 DASH FIVE.

THE EO ZONING PROVIDES FOR A RANGE OF RETAIL OFFICE, TOURIST ORIENTED AND LIGHT INDUSTRIAL USES, UH, EITHER AS A MATTER OF RIGHT OR WITH SPECIAL USE PERMIT.

UH, IN ADDITION, UH, BUFFERING REQUIREMENTS, UH, 20, THERE'D BE A 20 FOOT LANDSCAPE BUFFER ALONG ASHBY PARK DRIVE, UH, 14 AND HALF FEET, UH, TO THE EAST, ADJACENT TO, UH, WHAT'S A 35 FOOT, UH, BUFFER ON THE ARBORDALE SIDE OF THE PROPERTY.

AND THEN A 35 FOOT TRANSITIONAL PUFFER TO THE SOUTH.

SINCE THE PROPERTY IS ZONED EO, ANY FREESTANDING SIGNAGE WOULD HAVE TO BE MONUMENT TYPE, UH, MAXIMUM AREA 64 SQUARE FEET HEIGHT, MAXIMUM HEIGHT OF 10 FEET.

UM, SO YOU CAN SEE WHERE THEY'VE INDICATED, UH, CONCEPTUALLY, UH, LANDSCAPE, UH, PLANTINGS.

AND ONE OF THE ISSUES HERE IS WE HAVE A REQUIREMENT IN ZONING ORDINANCE THAT, UH, ANY, UH, BAY DOORS, UH, HAVE TO BE, UH, AT LEAST PARTIALLY SCREENED, UM, BY, UH, LANDSCAPING AND OR, UH, BERMS OR WHATEVER.

UH, WELL, THE WHOLE PROPERTY IS IN OUR WATERSHED MANAGEMENT PLANNING, OUR WATER MANAGEMENT PROTECTION OVERLAY DISTRICT.

UH, AND THIS LITTLE HALF ACRE CORNER OF THE PROPERTY IS ACTUALLY WITHIN 500 FEET OF A 200 FOOT WATERSHED BUFFER.

SO THERE'S A REQUIREMENT IN THE ORDINANCE THAT YOU CAN'T HAVE, UH, UNCOVERED, UM, TRASH DUMPSTERS, UH, WITHIN 500 FEET OF THE 200 FOOT WATERSHED BUFFER ALONG TRIBUTARY STREAM.

UH, SO AS I SAY, IT WOULD HAVE TO BE EITHER UNDER ROOF OR DESIGNED SO THAT LEACH SHADE CAN'T ESCAPE.

UM, AND, UH, THIS IS, UH, SORT OF AN OVERLAY OF THE SKETCH PLANT ONTO EXISTING DEVELOPMENT OUT THERE TO GIVE YOU AN IDEA OF THE ORIENTATION OF THE PROJECT, UH, TO ITS SURROUNDINGS.

UM, AS FAR AS THE EAST, UH, SIDE OF THE PROPERTY ADJACENT TO THE ARBORDALE TOWNHOUSES, UM, THE, UH, PARKING WOULD BE, UH, ABOUT JU JUST SLIGHTLY UNDER 50 FEET FROM THOSE, UH, TOWNHOUSE LOTS.

THERE IS A 35 FOOT TRANSITIONAL BUFFER ALREADY IN PLACE ON THE AR ARBORDALE SIDE OF THE PROPERTY.

UH, ON THE AUTO HOUSE SIDE, THEY WOULD BE ADDING ANOTHER 14 AND A HALF FEET, SO 49 AND A HALF FEET, UH, OF LANDSCAPING, AND PLUS THE, UH, OPAQUE FENCE.

AND, UH, HERE'S AN ELEVATION THAT, UH, RENDERING THAT WAS SUBMITTED BY THE APPLICANT, UH, THAT WOULD BE ATTRACTIVE BUILDING.

YOU CAN SEE IT IS RATHER SIMILAR TO THE, UH, UH, UH, GREEN DRIVE FACILITY, AND YOU CAN SEE THE FENCING TO THE REAR HERE.

AND THERE'S A FENCE DETAIL THAT WAS SUBMITTED BY THE APPLICANT.

WE HAVE A CONDITION OF APPROVAL IN THE PROPOSED RESOLUTION, UH, REQUIRING THE FENCING TO BE, UH, SIMILAR STYLE, SIMILAR TYPE.

ONE OF THEM WAS, UH, IN REGARDS TO LIGHTING ON ASHBY PARK, UH, DRIVE WITH THE, UM, WITH THE NUMBER OF VEHICLES INCREASE ON HERE, PARTICULARLY, UH, IT'S MORE THE WINTER HOURS WHEN YOU'RE, UH, WHEN YOU'RE LIMITED, UH, DAYLIGHT HOURS, THERE'S CONCERN THAT THERE'S SIMPLY NOT ENOUGH LIGHTING AS, AS YOU, UH, GO DOWN THE LENGTH OF ASHBY PARK.

IT IS A, IT IS A ROAD THAT A LOT OF THE RESIDENTS USE FOR WALKING.

UH, I'M WONDERING IF THERE'S SOMETHING THAT WE COULD DO FROM A COUNTY STANDPOINT TO LOOK AT LIGHTING ON THAT PARTICULAR STREET.

UH, SEE IF IT CAN'T BE IMPROVED.

WE CAN TAKE A LOOK AT THAT.

SECOND, UH, SECOND ITEM THAT CAME UP WAS, IS THIS INFAMOUS, UH, U-TURN ON MOTOWN ROAD.

NOW, I KNOW THAT, UH, THE IMPACT STUDY WAS NOT REQUIRED BASED ON THE VOLUME OF TRAFFIC, BUT THIS IS GOING TO BE A POTENTIAL PROBLEM, UH, AS WE GO FORWARD.

UH, IF YOU ARE COMING SOUTHBOUND ON MOTOWN, YOU HAVE TO ACTUALLY GO PAST ASHBY PARK BY ABOUT 200, 250 FEET BEFORE YOU CAN THEN MAKE A U-TURN ON AN EIGHT, UH, A FOUR-LANE ROAD.

UM, AND IT'S, IT'S COMING OFF A CURVE, UM, WHICH IS PROBLEMATIC IN ITSELF.

SO I, I'M WONDERING WHETHER WE COULD GO BACK TO VDOT AND AT LEAST EXAMINE WHETHER OR NOT A LEFT TURN LANE COULD BE MADE AT THE ASHBY PARK ENTRANCE.

WHILE WE'VE AGREED TO A CONDITION ON OPERATING HOURS FOR AUTO HOUSE, IT'S, IT'S NOT POSSIBLE FOR THE APPLICANT TO AGREE TO A CONDITION LIMITING CONSTRUCTION HOURS, BECAUSE THERE MAY BE THAT ODD EVENT WHERE A STEEL DELIVERY OR A CONCRETE POUR REQUIRES SOME ACTIVITY ON THE SITE AFTER THOSE HOURS.

BUT OUR CONTRACTORS ARE ASSURING US THAT PREDOMINANTLY THIS IS A SEVEN TO FOUR 30 CONSTRUCTION PROJECT.
