UH, THIS PART OF THE USE WOULD BE LOCATED IN THAT AREA OF THE DETACHED GARAGE AND A SPACE IN THE SINGLE FAMILY HOME FOR THE CUSTOMER. CLIENT CONTACT THE APPLICANT IS NOT STATED THAT HE WOULD NOT DISCHARGE FARM FIREARMS OR SELL AMMUNITION, BUT, UH, WE AS STAFF FELT THAT THIS WAS A CONDITION THAT WE NEEDED TO INCLUDE IN THERE. SO A RESOLUTION. THE RESOLUTION DOES INCLUDE TWO CONDITIONS. ONE FOR NO DISCHARGE OF FIREARMS ON THE PROPERTY, AND NO AMMUNITION SALES. UM, SO, UH, WE ARE PROHIBITING THOSE IN THERE. AND ADDITIONALLY, THE APPLICANT WILL BE REQUIRED TO SECURELY STORE ANY CUSTOMER FIREARMS THAT ARE ON SITE, UH, THAT HE'S NOT WORKING ON AT THE TIME. ACCORDING TO THE SKETCH PLAN THAT HE SUBMITTED, THE, UM, PROPOSED HOME OCCUPATION WILL BE APPROXIMATELY 154 SQUARE FEET IN THE HOME, SHOWN IN THAT LITTLE RED BLOCK. AND THEN, UH, 240 SQUARE FEET IN THE SHOP AREA, WHICH IS ABOUT 390, WE'LL SAY 400 SQUARE FEET IN THERE. UM, THE, UH, ZONING ORDINANCE SPECIFIES THAT HOME OCCUPATIONS ARE NOT PERMITTED TO OCCUPY MORE THAN 25% OR 400 SQUARE FEET, WHICHEVER IS LESS. AND AS YOU CAN SEE, THE APPLICANT IS BELOW THE 400 SQUARE FEET. BUT JUST FOR REFERENCE, THE HOME IS ABOUT 1600 SQUARE FEET, AND THAT'S ABOUT 24%. THE 394 IS 24%. SO HE'S BELOW ON BOTH, BOTH CATEGORIES. SO, UM, IT CAN FIT IN THERE. I ALSO WANT TO NOTE, UM, I HAD MENTIONED THE CONDITION TO REQUIRE THE EVERGREEN SCREENING, SO I KIND OF HIGHLIGHTED THAT THERE FOR YOU NOW, JUST TO TALK A LITTLE BIT ABOUT PARKING AREA. THERE'S JUST A BLOW UP OF HIS PARKING AREA. UH, WE ARE REQUIRING HIM TO DO THE, UH, TREES THERE ALONG THE SIDE, UH, PLANT SOME TREES BECAUSE THE ORDINANCE SAYS, YOU KNOW, WHENEVER YOU'RE CLOSER THAN 10 FEET, YOU'VE GOTTA SUPPLEMENT WITH LANDSCAPING. UH, THE, THE APPLICANT HAS SAID THAT HE'S GONNA DO BY APPOINTMENT ONLY WITH NO MORE THAN ONE CUSTOMER. SO BASICALLY THAT'S ONE PERSON COMING IN WHILE ONE PERSON'S LEAVING THAT KIND OF SITUATION. UM, VERY, UM, AND, AND THEY CAN ACCOMMODATE IT THERE ON THEIR PARKING AREA. AND THERE I AM HIGHLIGHTING THE TREES AT THE END. UM, ZONING, ORDINANCE LIMITS, ALL LIMITS, ALL CUSTOMER CONTACT AND HOME OCCUPATIONS, UH, BETWEEN 8:00 AM AND 8:00 PM MONDAY THROUGH SATURDAY. UH, THE APPLICANT, UH, HAS STATED IN HIS NARRATIVE THAT HE'S ONLY GONNA OPERATE MONDAY THROUGH SATURDAY FROM NINE TO FIVE, SO IS A LITTLE BIT LIMITED FROM WHAT THE ZONING ORDINANCE GIVES HIM BY APPOINTMENT ONLY. AND NO MORE THAN ONE CUSTOMER AT A TIME. UH, SIGNAGE IS ALLOWED FOR HOME OCCUPATIONS. YOU CAN HAVE A THREE SQUARE FOOT SIGN THAT'S THREE FEET TALL. UM, THE APPLICANT HAS SAID HE DOES NOT WANT TO SIGN, HE DOES NOT WANT TO ADVERTISE, UM, HIS, UH, PARTICULAR USE. SO, UH, HE, WE DID CONCLUDE A CONDITION OF, UM, APPROVAL IN THE SPECIAL USE PERMIT THAT, UH, DOES NOT ALLOW SIGNAGE FOR THE PROPERTY. SEVERAL OTHER SPECIAL UNITS, HU EXCUSE ME, SPECIAL USE PERMITS HAVE BEEN AUTHORIZED TO ALLOW ONSITE CUSTOMER, UH, CONTACT IN CONJUNCTION WITH THE HOME OCCUPATION INVOLVING FIREARM SALES AND REPAIR. AND THIS LISTS ALL THE ONES THAT HAVE BEEN APPROVED SINCE 1984. I'LL NOTE THAT THE, UH, 19 84 1 IS INACTIVE. UM, AND SO IS THE, UH, ROBERT WILLIAMS, UH, 20 13 1. ALL THE OTHER ONES ARE STILL ACTIVE, UM, AND OPERATING HERE IN THE COUNTY. UM, ACCORDING TO ZONING AND CODE ENFORCEMENT STAFF, THERE HAVE BEEN NO COMPLAINTS OR ENFORCEMENT ACTIONS ON ANY OF THESE BUSINESSES. ADDITIONALLY, I SPOKE TO THE SHERIFF'S DEPARTMENT AND THEY HAVE RECEIVED NO COMPLAINTS REGARDING ANY OF THESE BUSINESSES OVER THE PAST FIVE YEARS. UH, THE PROPOSED HOME OCCUPATION IS CONSISTENT WITH OTHER APPROVED HOME OCCUPATIONS WHERE YOU HAVE CUSTOMER CONTACT. UM, AND WE DO NOT BELIEVE IT'S, UH, WOULD AFFECT, UH, OR GIVE ANY ADVERSE IMPACTS TO THE SURROUNDING AREA. PARKING IS LIMITED, UM, TO THE EXISTING DRIVEWAY AND THE GRAVEL AREA THAT'S ALREADY THERE. UM, AND THERE'S NO CHANGE IN THE EXTERIOR APPEARANCE OF THE RESIDENCE. IT IS, UH, IT HAS NOT BEEN THE COUNTY'S PRACTICE TO TIE SPECIAL USE PRINT APPROVALS TO SPECIFIC INDIVIDUALS BASED ON THE PRINCIPLE THAT IF YOU GIVE PERMISSION TO A USE, UM, IN A CERTAIN LOCATION, ANYBODY WHO COMES IN THERE SHOULD BE ABLE TO DO IT. HOWEVER, UH, COMMERCIAL ACTIVITIES IN RESIDENTIAL NEIGHBORS CAN BE SENSITIVE ISSUE, AND PEOPLE'S REACTION TO THESE PROPOSED [00:10:01] USES ARE OFTEN INFLUENCED BY THEIR KNOWLEDGE OF THE APPLICANT. SO WE HAVE RECOMMENDED A CONDITION OF APPROVAL IN THIS SITUATION THAT WOULD CAUSE THE USE PERMIT TO EXPIRE, UH, IF THE OWNERSHIP OF THE PROPERTY TRANSFERRED OUT OF MR. WYNN'S HANDS. THE PROPOSED CONDITIONS ARE SUFFICIENT TO ENSURE THAT THE PROPOSED USE REMAINS A SMALL SCALE OPERATION CONSISTENT WITH THE INTENT OF THE HOME OCCUPATION ZONING ORDINANCE REQUIREMENTS.
