ASHLEY ANDERSON, BEFORE WE PROCEED, UH, I HAVE A COUPLE THINGS I WANT TO TALK ABOUT, AND I WANNA MAKE SURE EVERYBODY UNDERSTANDS THE RULES.

UH, THIS IS A LITTLE BIT OF A, UH, KIND OF A STRANGE APPLICATION.

SO WHAT WE'RE DOING TONIGHT, SO I JUST WANNA MAKE SURE EVERYBODY UNDERSTANDS IT AND I'LL MAKE IT VERY CLEAR.

HOW DID WE GET, UH, TO THIS POINT FOR A SPECIAL USE APPLICATION AS DESCRIBED ON JANUARY THE 17TH, 2023, AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS, THE BOARD HELD A PUBLIC HEARING TO CONSIDER AN APPLICATION OF ASHLEY ANDERSON FOR SPECIAL USE PERMIT TO AUTHORIZE A TOURISTS HOME AND AN EXISTING DWELLING AT 1 41 WEST EPEL ROAD, WHICH IS ROUTE 7 26, UP IN THE WELLS DISTRICT.

AFTER, AFTER DELIBERATION, THE BOARD DENIED THE APPLICATION ON A VOTE OF THREE TO TWO SUPERVISOR GREEN RON, SUPERVISORS GREEN.

RON AND ZAREMBA VOTED TO DENY THE APPLICATION AND SUPERVISOR SHEPHERD AND NOEL VOTED TO APPROVE.

AND THIS IS IMPORTANT EVERYBODY CAN REMEMBER THE ORDER.

OVER THE COURSE OF SEVERAL DAYS, SEVERAL SUPERVISORS CONTACTED THE COUNTY ATTORNEY ON THE SUBJECT OF ASHLEY AN, UH, EXCUSE ME, OF ANDERSON'S APPLICATION COMING BACK TO THE BOARD FOR RECONSIDERATION.

IT IS WELL KNOWN AMONG THE SUPERVISORS THAT A ONE YEAR WAITING PERIOD IS REQUIRED BEFORE SU BEFORE SUBSTANTIALLY THE SAME PETITION CAN BE RECONSIDERED BY THE BOARD COUNTY ORDINANCE 24.1 DASH 1 33.

UH, WHICH TITLE RECONSIDERATION STATES THAT WHEN THE BOARD HAS OFFICIALLY ACTED ON A PETITION FOR AMENDMENT, NO OTHER PETITION, AND THE WORD I'M STRESSING HERE IS PETITION OR SUBSTANTIALLY THE SAME CHANGE, UH, SHALL AGAIN BE CONSIDERED UNTIL ONE YEAR FROM THE DATE OF OFFICIAL ACTION.

I'M HIGHLIGHTING THE WORD PETITION BECAUSE THE COUNTY ATTORNEY READS THE ORDINANCE AS PREVENTING THE APPLICANT IN THIS CASE, MS. ANDERSON, FROM BRINGING THE PETITION AGAIN FOR ANOTHER YEAR, BUT NOT PREVENTING THE BOARD, THE BOARD OF SUPERVISORS FROM RECONSIDERING ITS VOTE UNDER PROPOSED PROCEDURES, THE COUNTY ATTORNEY PROVIDED GUIDANCE IN WHICH HE NOTED THAT YORK COUNTY BOARD SUPERVISOR'S RULE OF PROCEDURES, JANUARY 3RD, 2023, SECTION THREE POINT, EXCUSE ME, THREE DASH 12 AND IN QUOTES, A CALLED RECONSIDERATION OF MOTION, CETERA, UPON WHICH VOTE HAS BEEN ANNOUNCED, PROVIDES AN OPPORTUNITY FOR RECONSIDERATION SECTION THREE DASH 12 OF THE PROCEDURE STATE.

AND A QUOTE MAY BE, AND THIS IS, UH, JUST KIND OF A, UH, NOT THE WHOLE PARAGRAPH, BUT, BUT IT BASICALLY, IT SAYS THAT THE RECONSIDERATION MAY BE CONSIDERED RECONSIDERED, OR THE MOTION CAN BE RECONSIDERED ON A MOTION OF ANY MEMBER WHO VOTED WITH THE PRO PREVAILING SIDE IN THIS PARTA IN THIS CASE WOULD BE GREEN, UH, RON AND ZAREMBA, AND PROVIDED THAT SUCH MOTION SHALL BE MADE AT THE SESSION OF THE BOARD AT WHICH IT WAS DECIDED SINCE THE BOARD HAS A, UH, HAS ADJOURNED.

THE JANUARY 17TH MEETING TO THE PUBLICLY ANNOUNCED BOARD RETREAT SCHEDULED FOR JANUARY THE 27TH, THE BOARD HAD THE OPTION OF RECONSIDERING ASHLEY ANDERSON'S APPLICATION AT THE RETREAT.

THE ADJOURN THE ADJOURNMENT BASICALLY MEANS THE RETREAT OF JANUARY 27TH IS A CONTINUATION OF THE JANUARY 17TH MEETING.

AND AN EMAIL DATED JANUARY 20, JANUARY 20, 20, 23.

TO THE BOARD, MR. ZAREMBA OFFERED TO RE-LOOK APPEAL OF THE ANDERSON APPLICATION.

HIS STATEMENT OF APPEAL WAS PRECEDED BY AN EMAIL FROM THE CHAIRMAN, WHICH IS ME STATING THAT A RECONSIDERATION OF ANDERSON'S APPLICATION SHOULD NOT BE HELD AT THE RETREAT, BUT AT A REGULAR MEETING WHERE THE PUBLIC WOULD BE MADE AWARE OF THE POTENTIAL CHANGE ON JANUARY 20TH, BASED ON MR. ZARUS OFFER TO APPEAL, I DIRECTED THE STAFF TO PLACE THE ACTION ON ON, ON FEBRUARY 7TH, 2023 AGENDA.

THAT'S THE DAY SINCE THE FEBRUARY 7TH MEETING IS CONSIDERED A SEPARATE MEETING FROM THE JANUARY 17TH JANUARY 27TH MEETINGS, THE BOARD WOULD NEED TO FOLLOW PROCEDURES STATED IN SECTION THREE DASH 13.

IT'S CALLED SUSPENDING RULES.

SO HERE WE ARE IN CONSULTATION WITH THE COUNTY ADMINISTRATOR, COUNTY ATTORNEY, AND IN SEPARATE CONVERSATIONS WITH MY FELLOW SUPERVISORS, I WILL CONDUCT A MEETING AS FOLLOWS.

FIRST, I WILL ASK FOR A MOTION TO SUSPEND THE RULES.

THIS MOTION WILL BE MADE BY SUPERVISOR NOEL OKAY.

AND REQUIRES A UNANIMOUS APPROVAL BY THE BOARD.

AFTER THAT MOTION, THEN I'LL HAVE A SECOND ACTION.

I WILL ASK SUPERVISOR ZAREMBA FOR A MOTION TO RECONSIDER THE ANDERSON SPECIAL USE PERMIT.

UM, ASSUMING THERE'S NO DISCUSSION AT THAT POINT ON THAT PROCEDURE.

THIRD, I WILL ASK SUPERVISOR GREEN TO APPROVE RESOLUTION 23 DASH FIVE, WHICH IS A RESOLUTION TO RECOMMEND APPROVAL OF AN APPLICATION TO AUTHORIZE A TOURIST HOME IN, UH, THEN EXISTING DWELLING AT 4 1 41 WEST ROAD.

AFTER THE MOTION HAS BEEN MADE, WE WILL THEN FOLLOW PROCEDURES, WHICH I WILL THEN ASK FOR BOARD DISCUSSION, AND THIS IS WHERE THEN EVERYBODY WILL SAY WHAT THEY WANT TO SAY.

I WOULD JUST LIKE TO SAY, UM, I'M NOT GONNA CHANGE MY VOTE FROM LAST TIME, BUT, UH, I'M IN RECEIPT OF A LETTER, AND I BELIEVE ALL OF THE OTHER SUPERVISORS HAVE IT FROM JUNE, UH, OF 22 FROM THE HOUSE.

AND IN THIS LETTER, THEY DID A VERY NICE JOB IN OUTLINING, UH, THE OPPORTUNITIES AND THE COMMUNITY INTEREST THAT WE HAVE WITH SHORT TERM RENTALS.

UH, AND I'M JUST GONNA GO THROUGH A COUPLE OF 'EM.

AND THEY GAVE EIGHT RECOMMENDATIONS FOR WHAT WE SHOULD BE.

AND WE'RE, WE'RE GETTING CLOSE, UH, WE'RE GETTING CLOSE ON OUR PROCEDURE, BUT WE NEED TO STRIKE A BALANCE BETWEEN OPPORTUNITY AND PROTECTING THEIR COMMUNITIES.

PROVIDE A FIRM FITTING FOR DECISIONS, WHICH, UM, VERY GLAD THAT WE'RE TAKING THIS BACK UP.

AND WE CAN TALK ABOUT IT AS THEIR PURVIEW IS ALLOW PUBLIC INPUT FOR THE BOARD OF SUPERVISORS DECISION PROCESS, WHICH WE DID ALLOW TIME AND CO AND THE COST FRUSTRATION TO THE APPLICANTS SO THAT THEY DON'T FIT, THAT WE CAN MAKE ALLOWANCES AND ALSO MAKE ALLOWANCES FOR PREVIOUSLY APPROVED OPERATIONS.

THEY ALSO GAVE US EIGHT RECOMMENDATIONS FOR THE GENERAL RULES.

WE SHOULD ALIGN THESE WITH THE HOME OCCUPANCY, THE OCCUPATION BASICS.

WE SHOULD HAVE THE WHOLE HOUSE AS SHORT TERM RENTALS.

WE SHOULD HAVE OWNER OCCUPANT AND RESIDENCE.

WE SHOULD GRANDFATHER SOME OF THESE.

THE YORKTOWN VILLAGE ACTIVITIES SHOULD BE EXEMPT FROM IT.

WE SHOULD ALWAYS ALLOW COMMUNITY INPUT.

AND WE SHOULD LOOK AT THE DENSITY OF THESE, UH, WHERE WE PLACE THESE.

AS FAR AS, YOU KNOW, WE'RE NOT PUTTING FOUR OR FIVE NEXT TO EACH OTHER, UH, AND HOW MANY SHOULD BE, UH, IN NEIGHBORHOODS.

AND WE SHOULD CONSOLIDATE THE COUNTY PROCESS ON THE SHORT TERM APPLICATIONS.

I THINK THESE ARE GOOD GUIDELINES.

I THINK WE'RE GETTING THERE.

I THINK WE'RE DOING A GOOD JOB IN MAKING STRIDES TO MAKE THIS PROCESS MORE STREAMLINED.

UH, SO I JUST WANTED TO CALL THAT ATTENTION AND, UH, WITH THAT I USE, OKAY, THANK YOU.

UM, JUST WANNA POINT OUT THAT I DID RECEIVE A LIST OF, UH, OF, UH, PROPOSALS FOR HOW TO APPROACH, UH, UM, YOU KNOW, TERM, UH, SHORT TERM RENTALS AND, UH, YOU KNOW, TOURIST HOMES.

UH, AND I APPRECIATE THAT FROM STEVE AND, UH, WHAT I WAS GONNA DO, UH, SOMETIME LATER, UH, OR EARLIER THIS YEAR.

BUT AFTER THE MEETING, I WILL THEN CONTACT EACH OF YOU AND HAVE YOU TRY TO ADD TO IT SO THAT WHEN WE COME BACK, HOPEFULLY THAT WILL GIVE US SOME BASIS AND WE CAN TAKE OTHER INPUTS LIKE YOU HAVE.

IS THERE ANY OTHER FURTHER DISCUSSION? YEAH.

I'M WANNA MAKE A COMMENT ON THE, UH, THESE SO-CALLED STANDARDS.

OVER TWO YEARS AGO, THIS BOARD PUT IN MOTION A TASKING TO THE PLANNING COMMISSION TO DEVELOP A SET OF STANDARDS FOR SHORT TERM RENTALS.

TWO YEARS.

OKAY.

GAVE THEM LICENSE TO GO OUT, LOOK AT OTHER ORGANIZATIONS JURISDICTION TO SEE WHAT THEY'RE DOING FOR SHORT TERM RENTALS.

TO THIS DATE, THEY HAVE NOT BEEN ABLE TO COME TO THE BOARD WITH A RECOMMENDED SET OF SHORT, SHORT TERM RENTAL STANDARDS.

OKAY.

SO WITHOUT THESE STANDARDS, WHAT WE'VE BEEN FORCED TO DO FOR THE LAST TWO YEARS ALRIGHT, IS TAKE THEM UPON CASE BY CASE BY CASE, LISTENING TO THE APPLICANT'S ARGUMENT OR THE SPECIAL USE PERMIT, AND LISTENING TO ANYBODY ELSE WANT, WHO WANTS TO SAY SOMETHING TO DENY THAT SPECIAL USE PERMIT.

BUT THE FACT OF THE MATTER IS, YOU KNOW, HERE WE ARE.

AND FRANKLY, I THINK IT'S AN EMBARRASSMENT OF THE COUNTY TO BE THIS FAR ALONG, THAT THEY'D HAVE TO TRY TO PUT TOGETHER A SET OF STANDARDS.

SO PEOPLE, WHOEVER THEY MIGHT BE, IF THEY HAVE THE OPPORTUNITY TO RENT THEIR HOUSES OUT, A SHORT TERM RENTALS WILL HAVE FAILED MISERABLY.

NOW THAT ASIDE THIS APPLICATION, AND I'LL BE THE FIRST TO SAY I AM AT FAULT FOR NOT THOROUGHLY UNDERSTANDING WHAT THE READER HAD WAS FOR THE 3RD OF JANUARY WHEN WE TOOK THIS UNDER CONSIDERATION.

AGAIN, THERE'S NOTHING SUBSTANTIALLY DIFFERENT.

SO I DON'T KNOW HOW MABO CAN CHANGE, CHANGE FROM THAT.

NOW, I KNOW THAT WE CAN ARGUE THAT WE ALREADY HAD THAT, THOSE PUBLIC COMMENTS AND WE HAD, BUT THAT WAS MET UPON.

WE HAD COMMENT, PERIOD.

WE VOTED ON IT, CLOSE, CLOSE THE DOOR ON IT.

WE'RE, WE'RE DONE WITH THAT.

THIS IS A WHOLE NEW, FOR ME, A WHOLE NEW CYCLE.

SO IF WE WANNA DO THIS, I THINK THE RIGHT THING TO DO IS TO CARRY THIS FORWARD INTO A PUBLIC HEARING AS PROPER AS WE HAVE DONE FOR ALL OF THESE IN THE PAST, SO THAT WE CAN GET BACK INTO THAT SAME CYCLE.

SO THE PUBLIC HAS AN OPPORTUNITY TO STEP UP, SHARE THEIR THOUGHTS, AND THEN WE HAVE ANOTHER VOTE ON IT AND GO FROM THERE.

THAT'S KIND OF WHERE I'M STANDING.

UM, I DUNNO WHAT THE PLEASURE OF THE BOARD IS, BUT I THINK THAT IS A PROPER, PROPER THING TO DO.

UM, SO IN LIEU AT THIS POINT OF A MOTION TO TABLE, WHICH WOULD THEN TAKE US TO A PUBLIC HEARING AT AN, AT A LATER MEETING, UM, ESSENTIALLY IS WHAT I'M TRYING TO GET A SENSE FROM THE BOARD OF WHETHER YOU WOULD HAVE, YOU'D FEEL GOOD ABOUT TABLING IT AND NO, I DON'T.

AND DOING THAT, OR WE JUST, WE CAN PROCEED.

WELL, I DON'T MIND TABLING IT IF THAT WOULD GET US SOMEPLACE WHERE IN FACT, THE FINAL DECISION IS A MEANINGFUL THAT ENCOMPASSES WORK OR THE STANDARDS THAT WE SHOULD HAVE PUT IN PLACE TWO YEARS AGO, UH, THE RECOMMENDATION OF BOTH THE PLANNING COMMISSION SEVEN MEMBER BOARD, THE DAY THEY TOOK THE VOTE, THREE OF THOSE MEMBERS WORKED OUT.

AND SO THE TWO WHO VOTE RESULTED IN A RECOMMENDED DISAPPROVAL, WHICH IS KIND OF NONSENSE.

BUT THEN WE'LL GET A STRONG RECOMMENDATION BY THE COUNTY ADMINISTRATOR WITH ALL THE RIGHT ARGUMENTS MADE IN THAT, IN THAT WRITING TO APPROVE THE PETITION.

CUZ IT WAS SORT OF, UM, NOT, NOT QUITE AS FAR AS IT SAID.

UM, BUT THE ISSUE WAS PEOPLE WERE GETTING IN THERE NOT BEING ABLE TO TURN AROUND TRUCKS REALLY IS THE BIGGEST THING.

UM, SO IN, UM, WE DID A SPEED STUDY FOR COMMONWEALTH DRIVE.

UH, NO CHANGE TO THE SPEED LIMIT WAS RECOMMENDED, UH, BASED ON THAT 85TH PERCENTILE OF 40 AND 31.

UH, AND THE SPA PAY SPEEDS AT 32 TO 42 AND 22 TO 32, THEY REALLY WOULD LIKE THE SPEED LIMIT TO BE LOWERED ON.

I UNDERSTAND.

BUT, UM, AND THE COLLECTED CRASH DATA WAS CERTAIN, WASN'T ANY, UM, IT WAS NOT RECOMMENDED.
