SECOND IS, UH, SECOND S U AMENDMENT TO ADD AUTO AND LIGHT TRUCK SERVICE ON THE PROPERTY.

AND THE THIRD IS, UH, NEW USE HEAVY TRUCK AND EQUIPMENT SALES, RENTAL AND SERVICE AT 5 25 EAST RO SHEMBO DRIVE.

THERE'S BEEN SEVERAL, UM, ZONING APPROVALS, UH, FOR THIS PROPERTY OVER TIME.

SO I WANNA TAKE A MINUTE JUST TO GO GO THROUGH THE BACKGROUND.

UM, OF APPROVALS ON THE PROPERTY.

GREAT.

IN 1997, THERE WAS A SPECIAL USE PERMIT PERMIT ISSUED FOR A CONTRACTOR SHOP AND CONSTRUCTION EQUIPMENT.

AND A REPAIR BUSINESS CONTRACTOR SHOP WAS ACTUALLY A, UH, YARD WASTE RECYCLING AND MULCH FACILITY, WHICH WOULD BE NON-CONFORMING NOWADAYS.

IN THAT ZONING DISTRICT 2002, THE BUILDING, UH, EXISTING BUILDING AND STORAGE AREA, PAVED AND GRAVEL AREAS WERE CONSTRUCTED.

2010.

THERE WAS A SPECIAL USE PERMIT FOR AUTO AND LIGHT TRUCK SALES AND SERVICE FACILITY, AND, UH, AT THAT POINT IN TIME, THE, UH, PREVIOUS, UM, CONSTRUCTION EQUIPMENT REPAIR SERVICE AND REPAIR USE HAD CEASED.

2016.

THE CONTRACTOR SHOP USE, UH, NONCONFORM USE WAS REPLACED BY ANOTHER NONCONFORMING USE, UH, TOWING SERVICE AND AUTO IMPOUND YARD PROVISIONS IN THE ZONING ORDINANCE FOR NONCONFORMING USES ALLOWS FOR AN EXISTING NONCONFORMING USE TO BE REPLACED BY ANOTHER NONCONFORMING USE, PROVIDED THAT THE NEW USE, UM, IS OF EQUAL OR LESS INTENSITY.

SO THAT WAS, UH, THAT WAS APPROVED UNDER ZONING ADMINISTRATOR LETTER AT THE TIME.

ALSO, THAT YEAR, THERE WAS A SPECIAL USE PERMIT GRANTED FOR RECREATIONAL VEHICLE STORAGE FOR UP TO 40 SPACES ON THE PROPERTY IN 2018.

AN AMENDMENT TO THE AUTO LAKE TRUCK SALES AND SERVICE, UM, USE TO EXPAND THE SALES DISPLAY AREA IN THE FRONT OF THE BUILDING AND DISCONTINUE THE AUTO SERVICE PART, UH, PORTION OF THE USE.

SO CURRENT PERMITTED USES SELLING APPROVALS ON THE PROPERTY, AUTO, AND LIGHT TRUCK SALES WITHOUT SERVICE RV STORAGE FOR UP TO 40 SPACES WITH AN APPROVED SITE PLAN.

THEY STILL NEED TO GET THAT, AND THEY'RE WORKING ON THAT.

AND NON-CONFORMING, CONFORMING TOWING AND, UH, IMPOUND YARD THAT IS LIMITED TO ONE OFFICE AND OUTSIDE PARKING AND STORAGE AREA, THAT'S EQUIVALENT TO APPROXIMATELY 18 COMMERCIAL PARKING SPACES.

UH, PROPERTY ALSO HAS BEEN, UM, UNDER VIOLATION NOTICES, UM, FOR ESTABLISHING THE RVS WITHOUT SITE PLAN, UM, WHICH IS IN THE WORKS, UH, MOTOR VEHICLE DETAILING BUSINESS WITHOUT UPDATING, UM, AMENDING THAT SPECIAL, THE ORIGINAL SPECIAL USE PERMIT.

AND, UM, HEAVY TRUCK AND EQUIPMENT SALES AND SERVICE OUT THERE.

APPLICANTS AND PROPERTY OWNER HAVE BEEN, ARE MADE AWARE OF THAT AND, AND, UM, THEY'VE BEEN TAKING CARE OF THAT.

APPROVAL OF THIS SPECIAL USE PERMIT WOULD RESOLVE ALL OF THOSE ISSUES.

IT'S A VICINITY MAP OF THE PROPERTY OUTLINED IN RED, UM, SURROUNDED BY, UM, THE WOODED AREA TO THE NORTH, EXCEPT FOR A, UH, TELECOMMUNICATIONS TOWER.

THE VACANT LAND IS THE APPLICANT'S PROPERTY.

ON THE OTHER SIDE OF OAK TREE ROAD IS, UH, THREE SINGLE FAMILY DETACHED HOMES TO THE NORTH, UH, VACANT LAND.

AND ACROSS RO SHEMBO IS I 64 AND FENTON MILL ROAD AND VACANT LAND.

BEYOND THAT ZONING OTHER PROPERTY, ITS OWN GENERAL BUSINESS ACROSS OAK TREE ROAD ARE OUR RURAL RESIDENTIAL, WHICH IS ALSO ON THE OTHER SIDE OF 64 AND DOWN THE ROAD A LITTLE BIT ECONOMIC OPPORTUNITY.

SO THE, UH, PROPERTY AS IT EXISTS IS NONCONFORMING WITH RESPECT TO MONUMENT SIGNAGE, WHICH WOULD BE, UH, REQUIRED TODAY.

LANDSCAPING, UH, ALONG FRONT YARD FENCING AND OPAQUE SCREENING OF THIS, UH, SMALL PORTION OF THE STORAGE AREA FROM EAST RO SHAMBO, UH, ROAD FRONTAGE, AND I'LL DISCUSS THAT FURTHER.

COMPREHENSIVE PLAN DESIGNATES THE PROPERTY FOR GENERAL BUSINESS.

IT'S AN OVERALL AERIAL, UH, OF THE SITE THAT PROPERTIES OUTLINED IN BLUE.

I NOTE THAT HEAVILY WOODED AREA COMPLETELY SURROUNDING THE SITE, EXCEPT FOR BY THE FRONT DRIVEWAY.

THE APPLICANT IS NOT PROPOSING ANY, UH, CHANGES TO THE SIGN STRUCTURE, SO THAT WON'T NEED TO BE UPGRADED.

SO THE FRONT OF THE BUILDING, UM, IN STRAIGHT IN FRONT OF THE BUILDING WOULD BE PARKING, UM, FOR, UM, CUSTOMERS.

THE APPLICANT'S PROPERTY IS THE, UH, POP PROPERTY BOUNDARIES IS, UH, THE BLUE DASH LINE.

EXISTING ON THE SITE IS THE 6,625 SQUARE FOOT, UH, OFFICE.

AND, UH, MOTOR VEHICLE SERVICE BUILDING, EXISTING PAVED AND GRAVEL AREAS.

THERE'S NO EXPANSION PROPOSED OF THAT, OR ANY EXPANSION OF THE BUILDING.

THEY'RE GONNA ACCOMMODATE EVERYTHING ON, ON THE SITE AS IT IS SOLID BOARD FENCING ACROSS THE ENTIRE WIDTH, UH, OF OAKTREE ROAD.

AND ACROSS THE SOUTH SOUTHEAST SIDE OF THE BUILDING.

ACROSS THE FRONT SITE IS HEAVILY WOODED, UH, ALL THE WAY AROUND EXCEPT FOR A SMALL AREA OUT IN FRONT OF THE BUILDING BY THE DRIVEWAY.

AND THERE IS AN ESTABLISHED 35 FOOT TRANSITIONAL BUFFER, UH, AGAINST ALONG OAK TREE ROAD THAT WAS ESTABLISHED, UH, IN ACCORDANCE WITH CONDITIONS OF PREVIOUS SPECIAL USE PERMITS.

PROPOSED USES INCLUDE ADDITIONAL LANDSCAPING, UH, ACROSS THE FRONT THERE THAT WOULD BRING THE SITE INTO CONFORMANCE WITH CURRENT TOURIST QUARTER MANAGEMENT OVERLAY LANDSCAPING REQUIREMENTS, CHANGES IN EXPANSION OF THE STORAGE AREA WHERE THE D IS UP FRONT.

THAT IS EXPANDED DISPLAY AREA.

UH, THE TWO SECTIONS OF E IS WHERE, UH, HEAVY TRUCK AND EQUIPMENT STORAGE WOULD BE, AGAIN, ON EXISTING, UH, GRAVEL AREAS.

AND AN EXPANSION OF 10 RV SPACES OFF THE END OF WHERE THE EXISTING, UH, 40TH SPACE IS.

FIRE DEPARTMENT IS REQUIRING AN EMERGENCY ACCESS GATE IN THE FENCING, UH, ON OAK TREE, UH, FOR SERVICE TO THE HYDRANT.

THERE ISN'T ANY HYDRANTS NEARBY ON, UM, ESTRO SHAMBO.

SO, UH, THIS WOULD BE JUST NOT FOR VEHICLE SERVICE.

IT WOULD JUST BE SO THEY COULD, THEY WOULD PARK, THERE'S A, UH, FIRE, FIRE LANE, PROPOSED FIRE LANE, TWO OF THE SPACES THERE.

SO THEY WOULD PARK THERE AND THEN JUST OPEN THE GATE TO GET ACCESS FOR THE HOSES TO THE HYDRANT.

AND THE WASH AREA I MENTIONED, UH, MOBILE WASH, RECYCLE AREA, UM, BY THE ORDINANCE ARE REQUIRED TO RECYCLE, WASH, WASH WATER FROM CAR WASHES.

SO THEY'VE GOT A CAR WASH PART OF THE BUSINESS FOR THE DETAILING.

WHAT THEY DO IS PUT A TEMPORARY BOOM DOWN, UM, TO GATHER THE WATER, KIND OF LIKE A BOOM YOU PUT FOR, UH, OIL, OIL SPILLS ON THE OCEAN.

THEN THEY WOULD VACUUM THE WATER AND OVER BY THE, UM, DUMPSTER IS A, UH, WASTEWATER STORAGE TANK THAT WOULD BE EMPTIED PERIODICALLY.

ALSO ACROSS, UH, THE GATE, AS I MENTIONED, ACROSS THE DRIVEWAY THERE, UH, IS NOT OPAQUE.

THERE'S SOME, UH, FABRIC LIKE AROUND TENNIS COURTS ON THERE, BUT THAT'S NOT A HUNDRED PERCENT OPAQUE, WHICH WOULD BE REQUIRED AS PART OF THE TOUR SCORE OR OVERLAY.

SO A CONDITION FOR JUST THAT SECTION OF FENCE TO BE OPAQUE MATERIAL.

PLAN OF THE EXISTING BUILDING INCLUDES 806 SQUARE FEET OF OFFICES FOR THE DETAILING, UH, TOWING BUSINESS, RV, UM, OFFICE AND THE SALES OFFICE, CAR SALES OFFICE, 546 SQUARE FEET OF, UH, RETAIL AREA, AND, UH, SHOWROOM FOR THE DETAILING BUSINESS.

AND 44,364 SQUARE FEET OF, UH, SERVICE AREA FOR SERVICING OF VEHICLES AND EQUIPMENT.

THERE'D BE, UH, NO EXPANSION TO THE BUILDING.

THE ONLY CHANGES THEY'RE MAKING, THEY'RE GONNA TAKE DOWN A FEW OF THE INTERIOR WALLS.

JUST TO EXPAND A COUPLE OF THE, UM, WORK BASE IS PARKING AND STORAGE ALLOCATION PLAN IN ACCORDANCE, UM, WITH THE INFORMATION SUPPLIED BY THE APPLICANT.

AND THIS IS MENTIONED IN THE APPROVAL CONDITIONS.

VEHICLE, UH, DISPLAY FOR VEHICLES, UH, SALES, SALES DISPLAY UP FRONT, AND THEN PARKING, REQUIRED PARKING FOR CUSTOMERS AND EMPLOYEES.

CARS WAITING TO BE STORED WOULD BE BEHIND THE GATED AREA AS, AS WELL AS, UM, ANY OTHER STORAGE OF EQUIPMENT, TOWING AND SERVICE PARKING AREA.

IMPOUND AREA WOULD BE IN THE BACK CORNER.

AND THEN THE BLUE AREA'S, RV STORAGE AND TWO BROWN AREAS THERE.

THE EQUIPMENT STORAGE, REQUIRED PARKING, UH, THEY'RE REQUIRED TO HAVE 21 SPACES.

THEY'RE ACTUALLY SHOWING 40, SO THEY'VE GOT MORE THAN ENOUGH SPACES, UH, TO ACCOMMODATE ORDINANCE REQUIREMENTS FOR THAT.

STAFF DOESN'T FEEL THAT, UH, THERE'D BE ANY ADVERSE TRAFFIC ISSUES IN ACCORDANCE WITH THE INSTITUTE OF TRANSPORTATION ENGINEERS.

AVERAGE VEHICLE TRIP GENERATION FOR THE, THE, UH, COMBINED USES WOULD BE APPROXIMATELY 96 AVERAGE WEEKDAY TRIPS.

THE APPLICANT'S ESTIMATE, GIVEN THE CURRENT TENANTS WOULD BE, UH, APPROXIMATELY 25 AVERAGE DAILY TRIPS, WHICH PROBABLY MORE ACCURATE.

THE, UH, IT MANUAL ALWAYS LOOKS AT THE MOST INTENSIVE, UM, ASPECT OF, OF USES ACCORDING TO VDOT 2020.

UM, VEHICLE TRIP COUNTS.

EAST ROW SHAMBO DRIVE IN THIS SECTION TAKES AN AVERAGE DAILY VEHICLE COUNT OF 9,300 CARS.

SO WE DON'T FEEL THERE'LL BE ANY ADVERSE TRAFFIC IMPACTS FROM WHAT THEY'RE PROPOSING.

APPROVAL CONDITIONS INCLUDE ALL STORAGE WITHIN THE FENCED AREA AND PARKING, STORAGE AND DISPLAY IN ACCORDANCE WITH THE SEP PLANS AND THE ALLOCATION PLAN.

OPAQUE FENCING ACROSS THE SECTION OF GATE, ACROSS THE MAIN DRIVEWAY, THEY'RE ON A SEPTIC SYSTEM, SO CERTIFI CERTIFICATION OF, UH, ADEQUACY OF THE SEPTIC SYSTEM AND FIRE AND LIFE SAFETY REQUIREMENTS.

SINCE EVERYTHING IS EXISTING OUT THERE, WE HAVE INCLUDED IN THE CONDITION OF APPROVAL THAT THIS BE TAKEN CARE OF WITHIN 60 DAYS OF APPROVAL OF THE S U P.

AND THAT WOULD INCLUDE, UH, THE GATE I MENTIONED IN OAK TREE ROAD FOR ACCESS TO THE HYDRANT, ADEQUATE ONSITE EMERGENCY VEHICLE AND APPARATUS ACCESS FIRE EXTINGUISHERS WITHIN THE BUILDING, AND A HAZARDOUS MATERIALS CONTINGENCY PLAN, UH, FOR REVIEW SUBMISSION AND REVIEW AND APPROVAL BY THE FIRE DEPARTMENT.

UH, THUS THE CONDITION OF APPROVAL HAS BEEN, UH, PROPOSED, UH, TO REQUIRE THE APPLICANT TO PROVIDE SUCH DOCUMENTATION TO THE VDH.
