GOOD EVENING, MADAM CHAIR AND TWO BOARD MEMBERS ADMINISTRATION.

I NOW INVITE US ALL TO TURN TO GOD IN PRAYER.

LET US PRAY, DEAR, ALL PRESENT AND ALL MERCIFUL GOD.

AS WE GATHER THIS EVENING IN THIS CHAMBER TO DISCUSS THE MATTERS BEFORE THIS GOVERNING BODY THAT WILL AFFECT THE PEOPLE OF YOUR COUNTY.

WE COME TOGETHER IN THE MIDST OF NEW LIFE AND HAVE NEW HOPES, BLOSSOMING FLOWERS, AND BLOOMING TREES AND SHRUBS REVEAL THE WORK OF YOUR HAND AND CREATING NEWNESS OUT OF WHAT HAD PREVIOUSLY SEEMED TO VOID THE WARMER TEMPERATURE WHILE CONTINUING TO FLUCTUATE OR A REMINDER OF YOUR WARM SPIRIT.

THERE REMAINS WITH US AND IN US AGAIN, A SIGN OF NEWNESS.

AND ADDITIONALLY, WE RECOGNIZE NEW OPPORTUNITIES EVER BEFORE US AND THE WORK OF OUR RESIDENTS, OUR COUNTY ADMINISTRATION, AND THIS BOARD THROUGH THIS NEWNESS CREATES HOPE IN US ALL.

AND FOR THAT, WE GIVE YOU THINGS THIS EVENING.

WE BEGAN THIS GATHERING BY PRAISING YOU AND ASKING FOR YOUR MERCY TO CONTINUE TO BE OUR SHIELD AND OUR STRENGTH.

AND I PRAY THE LORD THAT YOU WILL BE WITH OUR BOARD OF SUPERVISORS, OUR COUNTY ADMINISTRATION, AND OUR RESIDENTS THIS EVENING, AS THEY DISCUSS MATTERS, THAT WILL AFFECT THE PEOPLE OF THIS COUNTY.

THAT WE'LL HAVE TONIGHT IS FROM THE VIRGINIA COURT CLERKS ASSOCIATION, AND IT IS A RESOLUTION OF APPRECIATION PRESENTED TO THE FAMILY OF LINDEMAN.

DEBER KRISTEN NELSON, YOUR COUNTY CLERK OF COURT WILL NOW PRESENT THAT CHRISTIAN.

ANYTHING? I THANK YOU FOR THE OPPORTUNITY TO BE HERE TONIGHT.

UM, I ASKED TO SPEAK THIS EVENING AND HONOR MY PREDECESSOR, LEN SCOTT AND .

IT IS TRADITION FOR THE VIRGINIA COURT CLERKS ASSOCIATION TO HONOR CLERKS WHO HAVE PASSED AWAY BY THE READING OF A RESOLUTION OF APPRECIATION SPECIFIC TO EACH CLERK IN EACH JURISDICTION AT OUR ANNUAL CONVENTION, LEN PASSED AWAY ON APRIL 3RD, 2020.

UH, THE CLERK'S ASSOCIATION DID NOT HAVE THEIR 2020 CONVENTION.

SO WE WERE CATCHING UP ON 2021.

SO WE, UM, IT WAS READ AT THE 2021 CONVENTION.

AND SO IT'S WITH GREAT RESPECT THAT I'M ABLE TO PRESENT THIS RESOLUTION TO THE FAMILY OF LEN WHO WERE SEATED TO THE RIGHT OF ME.

WOULD YOU ALL TAKE A MINUTE JUST TO STAND AND BE RECOGNIZED, TONY AND FAMILY? I'M SO APPRECIATIVE OF HAVING THE OPPORTUNITY OF WORKING WITH AND FOR LYNN FOR MANY YEARS.

AND I'M HONORED TO PRESENT THIS RESOLUTION TO YOU TONIGHT BEFORE DOING SO.

I WANT TO TAKE A MINUTE AND READ THE RESOLUTION.

VIRGINIA COURT CLERKS ASSOCIATION, RESOLUTION OF APPRECIATION FOR LYNN S MENOPUR, WHEREAS THE DEATH OF THE HONORABLE LEN S MENOPUR ON APRIL 3RD, 2020, THE VIRGINIA COURT CLERKS ASSOCIATION HAS SUFFERED THE LOSS OF A FRIEND AND DISTINGUISHED CLERK OF COURT.

WHEREAS LYNN IS PRE-DECEASED BY HER FATHER, HARRY T CONNICK JR.

AND SURVIVED BY HER HUSBAND, ANTONIO, AMANDA BURR, HER FOUR CHILDREN, DAVID

LAURA AUGUST AND CATHERINE LYNN AND HER MOTHER MARCIA AND STEPFATHER DAVID BROWN.

WHEREAS LYNN MENDELLA WAS BORN IN NEW YORK ON FEBRUARY 2ND, 1961, AND LIVED IN YORK COUNTY, VIRGINIA, THE REST OF HER LIFE.

SHE RECEIVED HER BACHELOR OF ARTS FROM RANDOLPH-MACON WOMAN'S COLLEGE IN 1983.

WHEREAS LYNN BEGAN WORKING IN THE CIRCUIT COURT CLERK'S OFFICE DURING SUMMERS, WHILE IN COLLEGE AND CONTINUED TO WORK IN THE OFFICE THEREAFTER.

WHEREAS WAS ELECTED AS INTO OFFICE, AS CLERK IN 1999, WHERE SHE SERVED AS CLERK UNTIL HER RETIREMENT IN 2014.

IN ADDITION TO HER RESPONSIBILITIES, SHE SERVED AS SECRETARY OF THE YORK COUNTY REPUBLICAN COMMITTEE VICE-PRESIDENT OF THE VIRGINIA COURT CLERKS ASSOCIATION, PRESIDENT OF THE GRAFTON QUANTIS CLUB, A MEMBER OF THE YORK VICTORY, YMCA MANAGEMENT BOARD, ANY REPRESENTATIVE TO THE LIBRARY BOARD OF TRUSTEES.

NOW, THEREFORE IT BE RESOLVED THAT WE PRESENT THIS RESOLUTION AS A FORMAL ACKNOWLEDGEMENT OF HER OUTSTANDING SERVICE TO THE CITIZENS OF THE COUNTY OF YORK AND THE CITY OF POQUOSON, THE VIRGINIA COURT CLERKS ASSOCIATION AND TO THE JUDICIAL SYSTEM OF THE COMMONWEALTH OF VIRGINIA.

AND IT BE FURTHER RESOLVED THAT THIS RESOLUTION BE SPREAD UPON THE MINUTES OF THE ASSOCIATION AND THE COPY OF THE RESOLUTION BE PROVIDED TO THE FAMILY AND GLEN ESSMAN NUMBER RESPECTFULLY SUBMITTED KRISTEN AND NELSON CLERK, YOUR COUNTY BECAUSE THE CIRCUIT COURT, I WOULD BE REMISS IN SAYING, AND NOT SAYING THAT LYNN'S MOTHER MARCIA BROWN HAS PASSED AWAY SINCE THE PREPARATION OF THIS RESOLUTION.

HOWEVER, SHE WAS VERY INSTRUMENTAL IN HELPING ME WITH A LOT OF THE CONTENT OF IT.

SO, UM, I CAN TELL YOU THAT SHE CLEARLY TOOK GREAT PRIDE IN DOING SO.

SO WITHOUT FURTHER ADO, IT IS MY HONOR TO PRESENT THIS RESOLUTION TO YOU ALL.

AND ON BEHALF OF, UM, THE VIRGINIA COURT CLERKS ASSOCIATION AND MYSELF AS THE CIRCUIT COURT CLERK FOR YOUR COUNTY AND POST, MY CLIENT FOR WILLING TO SAY IS THAT SHE WAS A BREEDING MOWER WHEN THE CHILDREN AND, UH, THANK YOU VERY MUCH.

ON MARK BELLAMY, DEPUTY COUNTY ADMINISTRATOR FOR CONSTRUCTION UPDATE.

WHAT WELL GREETINGS FOR THE SECOND TIME TODAY, I HOPE YOU ALL ENJOYED OUR, UH, GROUNDBREAKING OR OUTDOOR CEREMONY WE HAD.

THERE WERE VERY APPRECIATIVE.

THE CHIEF INCLUDED ALL OF US IN IT.

IT WAS A GOOD TIME.

SO A FEW WEEKS AGO, UH, MR. MORGAN AND I WERE TALKING ABOUT WHAT WE WOULD DO FOR TONIGHT, AND WE THOUGHT IT MIGHT BE APPROPRIATE GIVEN TODAY'S ACTIVITIES AND, UH, SOME OF YOUR ACTIONS AND DELIBERATIONS FOR THE REST OF THE EVENING TO TALK ABOUT CONSTRUCTION UPDATES.

SO BEFORE I DO THAT, I DO WANT TO MAKE A COUPLE POINTS.

WE DID NOTE THAT WE WOULD BE DOING THE GROUNDBREAKING TODAY.

AND SO IT WAS IMPORTANT TO INCLUDE THAT IN OUR CONSTRUCTION UPDATE.

ONE OF THE OTHER THINGS I WANT YOU TO BE AWARE OF AS WE WALK THROUGH THIS PRESENTATION IS, AND THE CONSENT CALENDAR TONIGHT, OUR FURNITURE AND FIXTURES FOR THE LIBRARY, WHICH IS ALSO ON OUR PRESENTATION TONIGHT, AND THEN THE BUDGET HEARING, WHICH YOU HAVE LATER, WHICH IS PRETTY IMPORTANT TO THIS WHOLE PROCESS.

SO WE WANTED TO MAKE SURE THAT WE MADE THE TIE FOR YOU AND ALL THAT.

SO THE THREE BUILDINGS THAT WE ARE SPECIFICALLY GOING TO TALK ABOUT TONIGHT ARE FIRE STATIONS, SEVEN THAT WE VISITED TODAY, UH, THE NEW YORK TOWN LIBRARY AND THE LAW ENFORCEMENT BUILDING.

A LITTLE BACKGROUND HERE.

THIS QUESTION HAS BEEN ASKED, UH, RECENTLY AT ONE OF YOUR MEETINGS, WE'VE TALKED ABOUT ARPA-E AND CARES AND WHERE DID ALL THAT MONEY GO? SO WHAT WE WANTED YOU TO BE AWARE OF IS THAT IT'S YOUR

SUPPORT OF THE CIP, BE IT FROM ARPA OR CARES OR A YEAR-END SURPLUS THAT ALLOWS THESE KINDS OF PROJECTS TO GO FORWARD.

JUST TO GIVE YOU A LITTLE EXAMPLE ABOUT WHERE THE ARPA MONEY AND SOME OF THE CARES MONEY WENT.

SO WE WERE ABLE TO PAY TOWARDS FIRESTATION SEVEN, A LITTLE OVER $4 MILLION BY INTERCHANGING, THAT MONEY WITH MONEY THAT WE CAN REIMBURSE OURSELVES FOR AND USE IT TOWARDS THIS CONSTRUCTION PROJECT WAS ALSO ROUGHLY $2 MILLION OF ARPA MONEY THAT WILL BE USED FOR THE CONSTRUCTION OF THE LAW ENFORCEMENT BUILDING.

SO THOSE ARE A COUPLE EXAMPLES OF WHERE SOME OF THAT MONEY HAS GONE.

SO WE WANTED TO MAKE SURE THAT YOU WERE AWARE OF THAT AS WE TALKED ABOUT THIS TONIGHT, YOU'VE SEEN THIS PHOTO BEFORE THIS RENDERING, RATHER OF THE FRONT OF THE LAW ENFORCEMENT BUILDING.

SO WE'LL BE ABLE TO SEE HOW THAT BUILDING RELATES TO EVERYTHING ELSE AROUND IT.

IF YOU LOOK UP IN THE TOP RIGHT CORNER, YOU CAN SEE THE VIPS PILES OF MULCH DIRECTLY BEHIND THE BUILDING.

YOU CAN SEE THE LANDSCAPE, A LANDFILL CAP THERE.

YOU CAN SEE THE TRANSFER STATION OFF ON THE LEFT.

IF YOU COULD SEE TO THE RIGHT OF THE FRAME, YOU'D SEE PUBLIC WORKS.

AND AS YOU CAN SEE, COMING INTO THE SHOT NOW IS THE THAT'S BEEN CONSTRUCTED FOR THAT SITE.

SO EVENTUALLY WE'LL COME BACK AROUND AND WE'LL BE FACING WEST AND FOR, UH, EXCUSE ME, 17, WE'LL BE IN FRONT OF YOU.

AND THIS IS GOOD WHEN KNACK ROAD ON YOUR LEFT DOWN THE LEFT SIDE OF THE BUILDING.

SO IN THE CENTER IS WHERE THE BUILDING WILL BE SITED TO THE BACK.

I'LL, UH, GO BACKWARDS HERE.

WHEN THERE, SO TO THE BACK BEHIND THE BUILDING, YOU'LL SEE A PARKING LOT, A SECURED PARKING LOT, UH, AND POSSIBLY ANOTHER BUILDING, A STORAGE BUILDING FOR SPECIALTY VEHICLES.

THAT'S WHAT WE'RE HOPING FOR IT.

OOPS.

SO THAT IS WHERE THAT SITS TODAY.

SO WHAT'S BEEN DONE OUT THERE.

THE SITE HAS BEEN PUT UP TO GRADE.

THE BNP HAS BEEN CONSTRUCTED ALONG WITH THE STORM WATER PIPING HAS BEEN INSTALLED.

THE SEWER LINES ARE INSTALLED AND THE WATER LINES ARE INSTALLED.

AND YOU SAW THE ROADS THAT HAVE BEEN GRAVELED AS WELL.

SOME OF THE THINGS THAT WE HAVE LEFT TO DO, UH, IS STILL TO BID THE BUILDING FOR ACTUAL CONSTRUCTION OF THE VERTICAL STRUCTURE THERE.

AND WE HOPE TO HAVE THAT READY IN MAY FOR AN AWARD SOMETIME, UH, LATE JUNE, EARLY JULY.

AND THEN OBVIOUSLY WE'LL BE COMING BACK TO YOU FOR APPROVAL OF THAT CONTRACT.

AND ASSUMING THAT YOU WERE TO APPROVE THAT CONTRACT, THE BUILDING WOULD START SOMETIME SEPTEMBER, OCTOBER WOULD BE OUR HOPE.

AND THEN EVERYBODY ALWAYS WANTS TO KNOW, WELL, WHEN WILL IT BE DONE? SO WHAT WE BELIEVE AT THIS TIME IS THIS ABOUT AN 18 MONTH CONSTRUCTION PERIOD.

SO WHAT WE'D BE LOOKING AT IF WE STARTED IN LATE SEPTEMBER, OCTOBER IS A FEBRUARY 20, 24, MOVE IN TIME.

THE NEXT BUILDING WE WANTED TO TALK TO YOU ABOUT WAS A YORKTOWN LIBRARY.

THIS IS A RENDERING THAT YOU'VE SEEN SOMETIME AGO.

HERE'S WHAT IT LOOKS LIKE TODAY.

THE INSIDE HAS BEEN GUTTED AND YOU SEE THE STRUCTURE, UH, THE NEW STRUCTURE ADDED TO THE BUILDING THERE ON THE LEFT.

SO SOME OF THE MILESTONES THAT HAVE BEEN ACCOMPLISHED SO FAR IN THE CONSTRUCTION OF THIS BUILDING IS OBVIOUSLY YOU SAW THE METAL STRUCTURE THAT'S IN PLACE.

THE ROOF IS IN THE PROCESS OF BEING PUT ON.

IT'S A SUBSTANTIALLY COMPLETE.

I BELIEVE THEY ARE WORKING ON ROUGH ELECTRICAL, PLUMBING AND FIRE SUPPRESSION.

AND THAT AIR CONDITIONING UNITS HAVE BEEN SET AS WELL.

WHAT YOU WOULD SEE NEXT, UH, IS THE BRICK FACADE COME TO THE BUILDING AND THEN THEY WOULD PUT THE GLASS WORK IN BECAUSE WHAT THEY TO DO IS GET THE BUILDING SEALED UP.

SO THEY CAN START DOING THAT SENSITIVE INTERIOR WORK, UH, THAT WE WOULD HAVE TO WORRY ABOUT HUMIDITY, WATER, MOISTURE,

THOSE KINDS OF THINGS.

SO INTERESTINGLY ENOUGH, AS YOU KNOW, DURING COVID, WE HAVE HAD PLENTY OF CHALLENGES AND I'LL MENTION THIS AGAIN LATER IN THE PRESENTATION, BUT IT TURNS OUT THAT STOREFRONT GLASS IS SOMETHING THAT IS ALSO AN ISSUE.

SO WE'RE ABOUT TWO MONTHS OUT FROM SEEING THE GLASS.

SO THAT IS SOMETHING THAT'S CREEPED UP ON US.

SO OCCASIONALLY WE DO SEE, UH, YOU KNOW, SOME THINGS LIKE THAT THAT WE DIDN'T ANTICIPATE TO START WITH, BUT WE'RE STILL HOPING FOR AN AUGUST COMPLETION.

SO I WON'T SPEAK FOR MR. SMITH, WHO I KNOW IS BEHIND ME THERE, BUT I KNOW HE'S ANXIOUS TO GET IN AND TRY TO BE THERE RIGHT AFTER FIRST OF THE YEAR.

AND SO THE REST OF THE INTERIOR WORK WOULD HAVE TO BE DONE DRY WALL, UH, ALL THE FINISHINGS THAT YOU WOULD EXPECT TO SEE IN A BUILDING LIKE THAT.

AND THEN, AS I MENTIONED EARLIER TONIGHT ON YOUR CONSENT CALENDAR, YOU'LL SEE FURNITURE AND FIXTURES FOR THIS FACILITY, FIRE STATION SEVEN, WHERE WE WERE AT TODAY, UH, THE BUILDING ON THE RIGHT EXISTS FOR THOSE OF YOU WHO MAY NOT KNOW THE BUILDING ON THE RIGHT EXISTS, THE BUILDING ON THE LEFT, IT DOES NOT, UH, THAT'S GOING TO BE A METAL BUILDING, THE ONE ON THE LEFT AND ALL THE PARTS AND PIECES ARE SITTING IN THAT PARKING LOT THERE ON THE RIGHT.

AND IT IS, UH, READY TO GET STARTED RIGHT THERE.

THERE'S A LITTLE PICTURE OF THAT.

SO YOU CAN, IF YOU WEREN'T THERE TODAY, YOU CAN IMAGINE WHAT THAT LOOKS LIKE.

DESIGN WORK HAS BEEN DONE.

AS I MENTIONED, THE STEEL BUILDING HAS ARRIVED AND WE HAD THE GROUNDBREAKING TODAY.

THE, UM, SITE WORK WOULD STILL NEED TO BE DONE.

THERE'S A BMP THAT WOULD HAVE TO BE INSTALLED THERE.

AND THEN THE CONSTRUCTION OF THE METAL BUILDING THE BAY AREA AND IN A CONVERSATION WE HAD LAST WEEK WITH THE CONTRACTOR, WE DO BELIEVE THIS WILL BE FINISHED BEFORE THE END OF THE YEAR.

AND WE HOPE TO SEE FIRE AND LIFE SAFETY MOVE IN, UH, DECEMBER OF THIS YEAR.

SO I MENTIONED A LITTLE BIT ABOUT THIS EARLIER.

THERE ARE A PLENTY OF CHALLENGES IN THE CONSTRUCTION BUSINESS RIGHT NOW.

I MENTIONED ABOUT THE STOREFRONT GLASS, UM, GENERATORS.

SO WITH THE LAW ENFORCEMENT BUILDING, UH, WE HAVE GONE AHEAD AND ORDERED THE GENERATORS.

YOU SAW THEM ON A CONSENT CALENDAR, A COUPLE OF MEETINGS AGO, AND THOSE GENERATORS HAVE MORE THAN A 12 MONTH LEAD TIME.

IT HASN'T BEEN THAT LONG AGO.

YOU COULD GET A GENERATOR AND A COUPLE MONTHS.

SO THAT'S A SIGNIFICANT CHANGE IN THAT BUSINESS BAY DOORS.

UM, AND THIS IS SOMETHING THAT, UH, WE'VE JUST RECENTLY BECOME AWARE OF BECAUSE OF FIRE STATION SEVEN, THAT SUBMIT ABOUT A SIX MONTH LEAD TIME TO GET BAY DOORS, ROLL UP GARAGE DOORS FOR THAT BUILDING.

SO WE ARE, UM, WE'RE TRYING TO DO WHAT WE CAN TO ALLEVIATE ALL THOSE PROBLEMS. IN SOME CASES WE CAN CHOOSE, UH, ALTERNATIVE MATERIALS, UM, INSTEAD OF HAVING ALL GLASS BAY DOORS, MAYBE WE COULD ORDER METAL BAY DOORS WITH ONLY SOME GLASS IN IT.

SO WE'RE TRYING TO MAKE CHANGES THAT DON'T HOLD UP OUR PROJECTS AS BEST WE CAN.

AND WE'RE LOOKING FOR SUPPLIERS THAT WE DON'T NORMALLY DO BUSINESS WITH.

SO THOSE ARE SOME OF THE THINGS THAT WE'RE WORKING ON AS WELL.

AND WE ARE TRYING TO RECOGNIZE THOSE ITEMS THAT REQUIRE LONG LEAD TIMES LIKE THOSE GENERATORS AND ORDER THOSE THINGS FAR IN ADVANCE, SO THAT WE'RE PREPARED FOR THAT WHEN THE TIME COMES.

AND, UH, THEN THE CONTRACTOR COMES BACK AND SAYS, WELL, YOU KNOW, THERE'S MATERIALS THAT USED TO BE $10, FOUR X ARE NOW $20 FOR X.

UH, AND BEFORE, YOU KNOW, IT, THE CONTRACT, IF WE DON'T MAINTAIN A ABSOLUTE, UH, OVERSIGHT IS TWICE WHAT WE THOUGHT IT WOULD BE OKAY.

THAT THAT IS NOT UNCOMMON IN A CONSTRUCTION BUSINESS.

BUT WHAT I WOULD TELL YOU IS, IS THAT, UH, MR. WOODWARD AND HIS ENGINEERING STAFF SPEND AN ENORMOUS AMOUNT OF TIME GOING THROUGH THE DRAWINGS BEFORE THEY'RE PUT OUT TO BID TO LOOK FOR THOSE KINDS OF ISSUES.

SO WE DO SPEND A LOT OF TIME ON QUALITY CONTROL ON THE, ON THE BID DOCUMENTS AND THE DRAWINGS THEMSELVES.

UM, I MEAN, I DON'T KNOW WHERE THEY THINK WE MUST HAVE A MONEY TREE DOWN HERE SOMEWHERE THAT THIS MONEY COMES FROM AND THINK THESE THINGS ARE LIKE, UH, SOMETHING YOU CAN BUY AT FIVE AND DIME OR WHATEVER THESE BILLS, THESE, UH, THESE ROADS STRUCK THE ROAD, CONSTRUCTION PROJECTS, COST HUNDREDS OF MILLIONS OF DOLLARS AND BILLIONS OF DOLLARS FOR THE TUNNEL.

AND, UH, THEY'VE GOTTA BE FUNDED.

PEOPLE WANTED THIS, UH, VAST FOR IT, AND WE'VE GOT IT IN THE BILL.

SO NOW TO HAVE A, A BANDAID OVER IT WITHOUT A GOOD ARGUMENT, UH, IS A PROBLEM.

ANOTHER GREAT LITTLE RESTAURANT THEN, UM, AND TREAT PLACE, UH, FOR FOLKS.

AND I NOTICED TOO THAT SOME MORE ACTIVITY WITH BILL'S RESTAURANTS PAST DAY AND AT BIG CRANE OUT THERE MOVING STEEL AROUND.

AND WE END UP WITH, UH, WITH A COUNTY GOVERNMENT, UM, THAT, UH, IS VERY FRUGAL AND ITS OPERATION.

UH, WE'RE ONE OF THE MOST WEALTHY COUNTIES, UH, IN THE UNITED STATES AND IN THE, IN THE ALL OF HAMPTON ROADS, I THINK BECAUSE CITY BICOASTAL HAS GOT A HIGHER, HIGHER, UM, UH, PER CAPITAL INCOME THAN US, BUT BY ONLY MAYBE A THOUSAND DOLLARS OR MORE AND WHERE WE ARE MOST, AND THIS IS THE THING, MOST COUNTIES HAVE A HAVE A, UM, A PER CAPITA INCOME AROUND 36 TO MAYBE $40,000.

AND HERE WE ARE SITTING UP AT AN 89,000 AND $90,000 AS PER CAPITA.

SO, I MEAN, YOU KNOW, THAT'S, THAT'S PRETTY AMAZING NOW, ALL THAT BEING SAID, PEOPLE STILL, AND WE, WE, WE, WE HAVE TO FIGHT AND UNDERSTAND WHAT WE'RE, WHAT WE'RE DOING.

NOW.

ONE OF THE, ONE OF THE COMPLAINTS I GET OFTEN IS THAT, WELL, YOU KNOW, WE DO A COMPARISON BETWEEN COUNTIES AND CITIES ON TAX RATES.

YEP.

GREAT.

AND WE, AND MOST PEOPLE KNOW THAT WE HAVE ONE OF THE LOWEST TAX RATES IN THE COUNTY YET OUR HOME VALUES SHOOT UP.

AND WHEN IT DOES, IS IT JUST, YOU END UP WITH A TAX INCREASE, SO WE TRY TO OFFSET IT WITH SOME SORT OF TAX REDUCTION.

UM, AND THEN ONE OF THE THINGS WE TALK ABOUT, HOW DO YOU COMPARE CITIES AND COUNTIES TOGETHER WITH COUNTY? THEY'RE EASY TO COMPARE, UH, CITIES AND COUNTIES ARE A LITTLE MORE DIFFICULT.

AND WHAT HAPPENS IS, IS THAT W W DOESN'T SOUND FAIR TO DO THAT.

AND SO WHAT HAPPENS IS THAT, UH, YEAH, WE, WHAT ARE WE, WHAT ARE THE BIG DIFFERENCES, ONE OF THE BIG DIFFERENCES, AND YOU CAN KIND OF PUT A SOCIAL, THE SOCIAL SIDE OF ISSUES, BUT WE, WE STILL, WE WORK LIKE WITH CITY OF NEWPORT NEWS AND WHATNOT ON HOMELESSNESS AND THOSE SORTS OF THINGS.

BUT ONE OF THE BIG DIFFERENCES IS ROAD PROJECTS.

WE DON'T OWN ROADS AND YOUR COUNTY CITIES OWN ROADS.

AND SO IF YOU HAVE TO DO A COMPARISON, AND I DIDN'T REALIZE WE HAD HAD, WE'VE DONE A STUDY SEVERAL YEARS AGO ABOUT THIS.

AND SO FOR US TO TAKE OVER ROAD OWNERSHIP, AND LET ME TELL YOU WHAT, THAT WOULD NOT BE AN EASY THING TO DO.

IN FACT, SOME ASPECTS OF IT, EVEN IF WE TOOK OVER PARTS OF IT WOULD BE VERY COMPLICATED AND BE VERY COSTLY, BUT IT WOULD JACK UP OUR TAX RATE AROUND 10 AND A HALF CENTS MORE.

BUT WHEN YOU ADD THAT TO OUR CURRENT TAX RATE, GUESS WHAT? YOU STILL SEE THAT OUR TAX RATES ARE LOWER THAN JURISDICTIONS AROUND US.

THE ONLY ONE IS THE SMALL, SMALL CITY OF WILLIAMSBURG, WHICH IS ABOUT THE SAME SIZE AS ONE OF OUR DISTRICTS.

AND IF YOU LOOK AT OUR EDUCATION SYSTEM, WHICH IS A MAJOR DRIVER FOR WHY OUR HOUSE VALUES ARE SO HIGH, WHY OUR CRIME RATE IS SO LOW AND WHY WE HAVE SUCH GREAT QUALITY IT'S BECAUSE PEOPLE WANT TO LIVE HERE BECAUSE WE HAVE BEEN SO SUCCESSFUL AND THE FUNDING OF OUR SCHOOLS.

AND WE'VE BEEN VERY SUCCESSFUL IN PRODUCING HIGH QUALITY EDUCATION IN THIS COMMUNITY.

SO UNDERSTANDING THESE THINGS IS VERY, VERY IMPORTANT, HOWEVER, THAT DOES NOT ANSWER THE MAIL AND EVERY CASE.

SO, UH, NEELA, YOU, YOU'RE GOING TO HAVE TO TALK ABOUT THIS AGAIN AND AGAIN, UNTIL WE GET THIS THING SQUARED AWAY, BUT WE MADE IT, YOU MADE A PROPOSAL AND YOU GAVE US SOME LOGIC, UH, TO WHY YOUR, YOUR PROPOSAL FOR YOUR BUDGET, UH, IS SUCH AS IT IS.

UM, THE SERVICE CONTRACTS, YOU KNOW, YOU TALKED ABOUT SERVICE CONTRACTS.

THAT'S A WAY WE CAN SAY WE'RE GOING TO SAVE MONEY, STRATEGIC LOANING, OR LEARNING WHAT BORROWING, OKAY.

THAT GIVES, I'M GONNA TELL YOU WHAT FOLKS I'VE HAD TO DEAL WITH THIS AT THE BILLION DOLLAR LEVEL, WITH THE HAMPTON ROADS, TACTICAL, UM, UH, TRANSPORTATION FINANCE COMMITTEE, WHICH I'M ON.

AND, YOU KNOW, TODAY WE WERE LOOKING AT A BILLION AND A HALF OKAY.

OF HOW TO STRATEGICALLY BORROW.

UH, AND SO WE'RE KIND OF DOING THE SAME THING THAT THEY'RE DOING.

IT'S A PRETTY STANDARD OPERATION.

HOWEVER, IT'S EXTREMELY COMPLICATED AND NOT EASY TO UNDERSTAND OUR CITIZENS.

SOMEHOW WE GOT TO COMMUNICATE THAT, UM, YOU KNOW, WHEN YOU GO PURCHASE NEW NEW VEHICLES, HOW'S PURCHASING NEW VEHICLES GOING TO SAVE US MONEY.

THESE ARE THINGS THAT CITIZENS STILL NEED TO UNDERSTAND.

AND WE HAVE GOT TO BE ABLE TO EXPLAIN THAT, OR WE'VE GOT TO GO TAKE ANOTHER ROUTE.

OKAY.

RIGHT NOW THE PROPOSAL IS TO REDUCE IT, REDUCE OUR TAX RATE.

BUT THAT AGAIN DOES NOT LOWER OUR TAXES TO WHAT IT IS BEFORE THIS EIGHT.

NOW, WHAT ARE WE? EIGHT ELVIN STATE PERCENT OVER 8% AND INFLATION HAS TAKEN PLACE.

AND FOR THOSE OF US THAT HAVE LIVED THROUGH HIGH INFLATION, LEAVE ME, IT DOESN'T GET ANY BETTER.

IT GETS WORSE.

AND WITH SOME OF US HAVE SEEN WHERE THE INFLATION RATE WAS HIGH AS 18%.

AND THAT WASN'T TOO MANY YEARS AGO OR TOO MANY DECADES AGO.

SO THIS THING IS PRETTY COMPLICATED AND WE JUST NEED TO BE ABLE TO EXPLAIN IT TO OUR CITIZENS AS BEST WE CAN.

AND, AND ONE ASPECT OF THIS FOR THE CITIZENS, I'M GONNA TRY TO EDUCATE YOU ON THIS VERY QUICKLY.

IF SOMEBODY TELLS YOU THAT THEY'RE GOING TO CUT TAXES AND INCREASED SERVICE, YOU BETTER PAY, BETTER PAY YOUR, YOUR RADAR BETTER GO UP AND YOU BETTER BE PAYING CLOSE ATTENTION, BECAUSE WHAT THEY'RE SAYING MAKES NO SENSE.

EVERYTHING'S COSTING US.

THE CITIZENS AND EMPLOYEES, STEEL, CONCRETE, ANYTHING WE BUY, EVERYTHING WE DO IS JUST LIKE ON THE OUTSIDE WORLD, THE PRICE IS GOING UP.

TRANSPORTATION, FUEL COSTS.

EVERYTHING IS GOING UP JUST LIKE, AS IT DOES FOR YOU AT HOME, IT GOES UP FOR OUR COUNTY.

AND WE'VE GOTTA BE ABLE TO BALANCE THAT OUT IF WE'RE GOING TO TAKE ANYTHING AWAY.

UM, SO TONIGHT ARE THE BUDGET PUBLIC HEARINGS, AND IT'S, I'VE ALWAYS THOUGHT IT'S A LITTLE STRANGE, AS FAR AS I'M CONCERNED, IT'S ALL ABOUT THE BUDGET BECAUSE IT'S ALL EITHER MONEY COMING OR GOING.

UH, BUT THE WAY, UH, OUR POLICY AND LAW IS SET UP, UH, WE HAVE THREE DISTINCT PUBLIC HEARINGS.

AND SO THE FIRST ONE IS ON THE BUDGET, WRIT LARGE, EVERYTHING IN THE BUDGET.

UH, THE SECOND ONE, UH, IS SEPARATELY REQUIRED BY THE STATE.

UH, AND THIS IS WHERE, UH, YOU ANNOUNCE, UH, WHAT THE EFFECTIVE TAX RATE IS.

IN OTHER WORDS, WITHOUT TAKING INFLATION INTO ACCOUNT, UH, HOW MUCH, UH, THE, UH, REVENUE IS GOING UP COMPARED TO, UH, WHAT IT WOULD HAVE IF YOU CUT THE TAXES AND ENOUGH TO MAKE IT NOMINAL.

AND THEN THE THIRD ONE IS THE ACTUAL, UH, PROPOSED RATE, UH, THAT WAS ADVERTISED, UH, FOR THE PUBLIC HEARING, UH, WHICH IS OF COURSE THE, THE NUMBER OF THE 78 CENTS THAT WE DISCUSSED.

SO I'M JUST MAKE A FEW COMMENTS AT THE BEGINNING OF THE FIRST ONE.

AND THEN AS THE CHAIRMAN GOES THROUGH THE PUBLIC HEARINGS, THEY'LL JUST BE SORT OF A PROMPT SLIDE FOR THE SECOND AND THE THIRD ONE, BUT I, YOU KNOW, UNLESS THE BOARD HAS QUESTIONS OF ME, I WON'T HAVE ANYTHING ELSE TO SAY AFTER THE FIRST ONE.

SO THIS, UH, YOU KNOW, THE, THE MAIN EVENT AS FAR AS I'M CONCERNED IS THE OVERALL PROPOSED A BUDGET FOR FISCAL YEAR 2023, WHICH OF COURSE INCLUDES THE OPERATING BUDGET AND IS INCLUSIVE OF THE FIRST YEAR OF THE CAPITAL IMPROVEMENT PLAN.

AND OF COURSE THE PURPOSE IS TO ALLOW ALL INTERESTED PARTIES, TO GIVE COMMENTS TO THE BOARD AS REQUIRED BY LAW.

AND, UH, YOU'VE RECEIVED TWO RATHER DETAILED PRESENTATIONS AT BOARD MEETINGS, AND I'M NOT GOING TO GO THROUGH ALL THAT AGAIN SINCE MARCH 15TH, UH, THE BUDGET, AS WELL AS, UM, THE VIDEOS OF THE PRESENTATIONS AND THE MEETINGS HAVE BEEN AVAILABLE, UH, TO THE VIEWING PUBLIC.

UH, I THINK WE'RE ALL AWARE THAT PUBLIC SAFETY, UM, FUNDING, THE CAPITAL IMPROVEMENT PROGRAM, EMPLOYEE COMPENSATION AND THE SCHOOL CONTRIBUTION ARE THE FUNDING PRIORITIES IN THIS RECOMMENDATION.

AND I WASN'T SURE IF I SHOULD SHARE THIS AGAIN AFTER MR. SHEPHERD'S COMMENTS, BUT I COULDN'T RESIST.

UH, AND I NEVER WANT TO IMPLY THAT IT'S AN ABSOLUTE FAIR COMPARISON BECAUSE EVERY LOCALITY HAS UNIQUE CIRCUMSTANCES.

UH, AND AGAIN, UH, WE DON'T IN EVERY CASE, KNOW WHAT OTHER LOCALITIES ARE DOING THIS YEAR.

WE TRY TO MODIFY THIS, BUT, YOU KNOW, THINGS KEEP CHANGING UNTIL THE LAST MINUTE.

BUT WHAT WE DO THINK IS CERTAINLY FAIR IS, UM, IF YOU COMPARE US TO THE OTHER TWO SIGNIFICANTLY SIZED COUNTIES, UH, JAMES CITY AND ISLE OF WIGHT, UH, YOU SEE WHERE OUR RECOMMENDED RATE COMPARES.

UM, AND TOM HAD ALSO MENTIONED WILLIAMSBURG BEFORE, SO WE COMPARE PRETTY FAVORABLY AND WE CERTAINLY AREN'T, UM, LOSING ANY GROUND WITH THIS RECOMMENDED BUDGET MENTIONED PERSONAL PROPERTY TAX RATE AGAIN, BECAUSE WE DO HAVE ONE OF THE LOWEST RATES.

AND AS WE MENTIONED IN THE OTHER PRESENTATIONS, WE DO EXPECT A SHORT TERM INCREASE IN CAR TAXES BASED ON THE VALUE OF RELATIVELY NEW USED CARS.

ALL OF THE COMMISSIONERS AROUND THE STATE ARE REPORTING THAT.

AND, UH, SINCE WE HAVE A LOW RATE, WE THOUGHT THAT THE BEST POLICY WAS JUST TO MAINTAIN OUR LOW RATE.

THERE'S A VERY GOOD CHANCE THAT AFTER ONE YEAR, THIS PHENOMENON WILL DISSIPATE.

AND TRUTHFULLY, IF WE DO HAVE,

UM, A STRONG FINANCIAL PERFORMANCE, PARTLY AS A RESULT OF THE PERSONAL PROPERTY TAX, UM, THAT ANY SURPLUS WOULD MORE THAN LIKELY BE WHAT WE WOULD USE TO FUND THOSE CAPITAL PROJECTS, WHICH MAY COME IN, UH, HIGHER THAN WHAT WE BUDGETED FOR ALL THE REASONS THAT MR. BELLAMY AND SOME OF YOU DISCUSSED.

SO AGAIN, THIS JUST SUMMARIZES THE EXPENDITURE PLAN, UM, BY THE GENERAL FUND AND ALL OF THE SPECIAL FUNDS AND THE, UH, THE CAPITAL PROJECT FUND, UH, INCLUDES THE LAW ENFORCEMENT BUILDING.

SO IT KIND OF MAKES THE OVERALL NUMBER LOOK A LITTLE BIT BIGGER THAN IT WOULD IN A TYPICAL YEAR WHEN THE CAPITAL PROJECTS NUMBER WOULD BE, UH, SOMEWHAT SMALLER.

AND OF COURSE, THERE'S ALSO TRANSFERS BETWEEN FUNDS AND YOU HAVE TO SUBTRACT THAT FOR A NET NUMBER OF TOTAL SPENDING IN THIS RECOMMENDATION.

THERE ARE SOME ADJUSTMENTS THAT WE, UH, REPORTED TO YOU IN LAST FRIDAY'S CORRESPONDENCE PACKAGE THAT CAME OUT OF YOUR LAST WORK SESSION, AND I'LL JUST, UH, DETAIL THOSE FOR EVERYBODY, UH, VIEWING TONIGHT, UH, AT THE BOARD'S DIRECTION, WE HAVE MADE A CHANGE IN THE ELDERLY AND DISABLED, UH, TAX RELIEF PROGRAM.

AND FOR THE UPCOMING YEAR, WHAT YOU DIRECTED ME TO DO WAS MAKE A FLAT 10%, UH, INCREASE IN ALL THE CATEGORIES.

SO THE DOLLAR AMOUNTS FOR QUALIFYING THE DOLLAR AMOUNTS FOR BEING CAPPED, THE AMOUNT OF ASSETS OTHER THAN YOUR HOUSE, THAT YOU CAN HOLD IN THE AMOUNT OF, UM, TAXES THAT ARE REDUCED IN EACH CATEGORY.

IT'S THE FLAT 10% ACROSS THE BOARD.

WE ASSURED THE COMMISSIONER OF REVENUE THAT YOU ALL WERE OKAY WITH THAT, SO THAT SHE COULD START, UH, THE PAPERWORK THAT SHE NEEDS TO DO TO GIVE PEOPLE, YOU KNOW, THE TIME TO APPLY FOR THAT PROGRAM.

WE'D ALSO INDICATED THAT FROM THE TIME WE RECOMMENDED THE BUDGET, THAT FUEL COSTS HAD INCREASED.

AND SO WE SAID THAT WE WOULD LOOK FOR OTHER TWEAKS IN THE BUDGET WOULD ALLOW US TO, UH, INCREASE THE, UH, PER GALLON AMOUNT OF MONEY WE HAVE AVAILABLE FOR FUEL COSTS.

AND YOU SEE THAT HERE.

UH, WE DID THAT BY, UM, TAKING ANOTHER LOOK AT DEBT SERVICE AND OUR FINANCE DEPARTMENT BELIEVES THAT, UM, WITH THE DEBT, THE DEBT SERVICE SCHEDULE, AS WE NOW UNDERSTAND IT, WE WERE ABLE TO TRIM THAT NUMBER BACK.

UM, WE ALSO, UH, INCREASED STATE REVENUE.

NOW, AS WE KNOW, WE HAVE NO STATE BUDGET, BUT BASED ON WHAT WE UNDERSTAND ABOUT REIMBURSEMENTS FOR CONSTITUTIONAL OFFICERS, WE BELIEVE THAT WILL PROBABLY COME IN ABOUT $50,000 HIGHER THAN THE NUMBER WE HAD IN THE BUDGET ORIGINALLY.

SO, UH, WITH A FEW OTHER MINOR CHANGES, YOU NET OUT THOSE CHANGES AND YOU SEE THE, UM, THE REVENUE, THE $59,000 REVENUE ADJUSTMENT, UH, THAT'S THE NET RESULT OF THOSE CHANGES.

AND, UM, SO I THINK THAT'S WHERE I STOPPED FOR THE FIRST PUBLIC HEARING.

UM, I WAS THE ONLY ONE THAT SPOKE IN JANUARY AND IT LOOKS LIKE I'M THE ONLY ONE THAT'S GOING TO SPEAK TONIGHT.

UM, BUT I THINK IT'S WORTH TALKING ABOUT, UM, THE BUDGET THIS YEAR IS UP ABOUT 20%, A LITTLE BIT LESS THAN 20% FROM LAST YEAR.

I THINK 18.9% IS THE NUMBER THAT WAS PUT IN THE NEWSPAPER.

SORRY.

UM, SO THAT, THAT CONCERNS ME.

I'VE LIVED IN NEW YORK COUNTY FOR 20 YEARS AND THAT MY AMOUNT OF INCREASES IS UNPRECEDENTED IN MY TIME AND IN, IN YOUR COUNTY.

AND I'M JUST SURPRISED TO SEE IT GO UP THAT MUCH.

UM, I KNOW THERE'S A 7% INCREASE IN THEIR REAL ESTATE VALUE, AND THAT'S BEEN TALKED ABOUT SEVEN TO EIGHT.

YOU PICK A NUMBER SOMEWHERE IN BETWEEN THERE WHAT'S NOT BEEN TALKED ABOUT IN YOUR COUNTY IS THE ROUGHLY 30% INCREASE THAT'S GOING TO OCCUR IN PERSONAL PROPERTY TAXES BECAUSE THE VALUE OF CARS HAVE GONE UP SO MUCH.

UM, WILLIAMSBURG, I BELIEVE CUT THEIR ASSESSED VALUE BY 20% SO THAT THEY CAN NOT TAX THE CITIZENS AT THAT HIGH LEVEL.

BUT I HAVEN'T SEEN ANYTHING TALKED ABOUT ANYWHERE IN YOUR COUNTY ABOUT THE DRAMATIC INCREASE THAT WE'RE ALL GOING TO SEE ON OUR PERSONAL PROPERTY TAXES.

IN FACT, IF YOU RUN THAT MATH, THAT CHANGES OUR RATE FROM $4 TO $5 AND 12 CENTS WAY ABOVE EVERYBODY ELSE, WHEN YOU ADD 30% TO THE $4.

SO THAT'S, THAT'S OF CONCERN TO ME.

AND THE LAST THING I'LL ADD IS WHEN WE'VE HAD, REZONINGS WHERE WE'VE ADDED A SIGNIFICANT POPULATION, WHICH DRIVES PUBLIC SERVICE, NEW SHERIFF'S DEPUTIES,

PEOPLE IN SCHOOLS, ALL THOSE KINDS OF THINGS, EVERY ONE OF THOSE PROPOSALS BASED ON STAFF INFORMATION AND SAID, THEY'RE GOING TO PAY FOR THEMSELVES.

AND IN FACT, THEY'RE GOING TO OPERATE WITH A PLUS TO THE COUNTY.

YET, HERE WE ARE, WE'RE RAISING THE TAXES FOR THE CITIZENS, WHICH I'LL SPEAK ABOUT IN A COUPLE OF MINUTES, UM, FROM WHAT WOULD BE 74 CENTS BY STATE MANDATE, THE 78 CENTS.

AND SO THAT, THAT ALL JUST CONCERNS ME.

SO I JUST WANTED TO SAY MY 2 CENTS THERE AND THANKS, THANK YOU FOR YOUR 2 CENTS.

SO TO INCREASE REVENUES FROM THAT PARTICULAR SOURCE BY NO MORE THAN 1%, UH, E WAY BELOW RATES OF INFLATION, BUT NONETHELESS, OR TO RUN THE ADVERTISEMENT THAT MR. CHAMBERLIN REFERENCED AND THAT'S, THAT'S BEEN RUN THERE.

THERE'S NO OTHER REQUIREMENT TO IT.

AND THEN YOU HOLD THE PUBLIC HEARING.

SO THERE WAS AN ADVERTISEMENT, IT GAVE THE, THE NUMBERS, UH, E WHAT'S WHAT THE STATUTE CALLS THE EFFECTIVE TAX RATE INCREASE.

THAT IS TO SAY HOW MUCH IT'S, IT'S YOUR, YOUR TAXES ARE GOING UP BY VIRTUE OF INCREASES IN ASSESSED VALUES.

UM, AND AS YOU'LL BE REMINDED, I'M SURE JUST A SECOND.

WHEN WE GET TO THE TAX RATES, YOU'LL SEE THERE'S A RECOMMENDATION TO ACTUALLY REDUCE THE TAX RATE, ALTHOUGH NOT BY AS MUCH AS WHAT OTHERWISE BE REQUIRED.

SO W WE HAVE THIS HEARING EVERY TWO YEARS, UH, THERE WERE A FEW YEARS DURING THE RECESSION WHEN IT WASN'T NECESSARY BECAUSE VALUES WENT DOWN OR IT STAYED FLAT ENOUGH.

UM, AND, UH, BUT THAT'S, THAT'S WHAT THE STATUTE REQUIRES.

YOU PUBLISH THE AD, YOU INFORM THE PUBLIC OF WHAT THESE TAX RATES MEAN IN TERMS OF ACTIONABLE DOLLARS.

THEN YOU HAVE PUBLIC HEARING THAT'S SO, YES, THIS IS A, THIS IS A LEGAL PUBLIC HEARING.

SO TO THE COUNTY ADMINISTRATOR.

SO IF YOU WOULD, FOR THE PUBLIC DESCRIBED THE EFFECTIVE TAX RATE.

SO THIS IS A CONCEPT IN STATE LAW THAT SAYS IF THE VALUES ON AVERAGE GO UP BY MORE THAN 1%, UH, CALCULATE WHAT THE RATE WOULD HAVE TO BE REDUCED TO SO THAT THERE WAS NO INCREASE ON AVERAGE.

THAT IS WHAT THE EFFECTIVE TAX RATE IS.

AND OURS WAS 74 POINT SOMETHING I BELIEVE IS WHAT IS THAT? BASICALLY WHAT YOU'RE SAYING IS IT'S 74 ROUGHLY WOULD MEAN THERE WOULD BE NO INCREASE IN, IN VALUE BASED ON NO CONSIDERATION FOR INFLATION OR ANYTHING ELSE.

RIGHT? CORRECT.

SO TO MAKE SURE EVERYBODY CLEARLY UNDERSTANDS THAT I KNOW IT'S A LITTLE CONFUSING, BUT THERE IT IS.

SO THE, THE GENERAL FUND BUDGET IS GOING UP BY ABOUT 9%.

AND OF COURSE, INFLATION WENT UP BY ABOUT 7%.

SO THAT PUTS IT IN A MUCH DIFFERENT PERSPECTIVE.

SO ROUGHLY IT'S 7% OF INFLATION IN 2% INCREASE, AT LEAST THAT WOULD BE, WHICH IS USUALLY ABOUT WHAT WE DO THE LAST SEVEN YEARS THAT I'VE BEEN ON THE BOARD PRETTY CLOSE.

I'M NOT GOING TO SAY IT'S, YOU KNOW, PRECISELY THAT.

AND, UM, YEAH.

SO, UM, AND AS I DID MENTION IN MY REMARKS TONIGHT, THE, UH, THE CAPITAL FUND VARIES PRETTY WIDELY, DEPENDING ON WHETHER YOU HAVE A BIG PROJECT.

AND WE JUST HAPPENED TO HAVE A BIG PROJECT, JUST MOVING THOSE BIG SHOULDERS THAT HE WAS BACK IN.

I CAN SEE THE ADMINISTRATOR WE STARTED, UH, BEFORE THIS LAST ITERATION WITH A TAX RATE OF 79.50 CENTS PER $100 WORTH OF SETS OF VALUE.

THAT'S CORRECT.

UH, THE INCREASE THAT WE OWED WHEN WE GOT W W THE COMMISSIONER OF REVENUES, UH, TAX, UH, WAS THE, WHAT, EIGHT, EIGHT OR SO PERCENT ON AVERAGE, ON AVERAGE, UH, TO COMPLY WITH THE 1% INCREASE, THE STATUTORY 1% INCREASE THAT DROPPED IT FROM 79.50 CENTS TO 74 CENTS.

RIGHT.

BUT TO MEET OUR BUDGETARY REQUIREMENTS, WE HAD TO INTRUDE UP TO SEVEN, 8 CENTS.

THE APPLICANTS WOULD BE PRESENT WHENEVER RENTALS ARE TAKING PLACE.

THE MAXIMUM RENTAL OCCUPANCY WOULD BE TWO PERSONS.

THE LENGTH OF STAY WOULD BE A MINIMUM OF TWO AND A MAXIMUM OF 14 NIGHTS.

AND THE USE PERMIT WOULD TERMINATE UPON THE SALE OF THE PROPERTY BY THE APPLICANTS.

SO GIVEN THAT THE TOURIST HOME WOULD BE A ONE BEDROOM RENTAL WITH A MAXIMUM OF TWO GUESTS AT A TIME, STAFF BELIEVED THE PROPOSED TOURIST HOME WOULD HAVE A MINIMAL IMPACT.

THE FACT THAT THE OWNERS WOULD RESIDE IN THE DWELLING WHILE RENTALS ARE TAKING PLACE ENSURES THAT GUESTS BEHAVIOR WOULD BE MONITORED.

THE HOME IS LOCATED ON A LARGE PROPERTY THAT A BUD SIZE, 64, THE 2.3 ACRE PROPERTY HAS AMPLE SPACE ENTRIES BETWEEN NEIGHBORS AND THE DRONE OF TRAFFIC NOISE FROM THE NEARBY INTERSTATE WOULD LIKELY DROWN OUT ANY NOISE THAT GUESTS MIGHT GENERATE.

FURTHERMORE, THE APPLICANT SPOKE WITH THEIR IMMEDIATE NEIGHBORS AND WERE ABLE TO COLLECT SIGNATURES ON A LETTER OF SUPPORT FOR THIS APPLICATION.

AND THEY ALSO PUT CERTAIN USES INTO SPECIAL USE PERMIT CATEGORY.

UM, AND THIS IS ONE OF THOSE USES THAT WAS PART OF THE PROFFERED CONDITIONS AS A SPECIAL USE PERMIT, UH, COMMERCIAL RECEPTION HALLS.

SO THAT'S WHY THIS IS GENERAL BUSINESS.

UH, THE TWO PARCELS THAT I'VE OUTLINED THERE IN THE RED, THEY ARE STILL LIMITED BUSINESS.

UH, THEY CAN COME INTO WHOLE PROPERTY HAS ABOUT 122 PARKING SPACES THROUGHOUT, UM, LOCATED THROUGHOUT THE SHOPPING CENTER, UH, HAS TWO ENTRANCES, ONE OFF OF HAMPTON HIGHWAY AND THE OTHER OFF YORK DOWNS DRIVE, UH, WHERE YOU, YOU CAN ACCESS AND TO BOTH OF THOSE LOCATIONS, UH, THIS IS THE SITE PLAN THAT WAS APPROVED AFTER THE REZONING REQUEST.

AND I HIGHLIGHTED AND DREW A CIRCLE AROUND WHERE THE APPLICANT WILL BE LOCATED THERE.

YOU CAN ALSO SEE ALL THE PARKING, UM, AND THEN THE BUFFERING AREAS AROUND AND BETWEEN THE RESIDENTIAL, UH, COMPONENTS THAT WERE THERE AT THAT TIME.

SO THE ZONING ADMINISTRATOR HAS WAIVED THAT REQUIREMENT FOR THEM, JUST TO REALLY TALK ABOUT PARKING.

I TALKED ABOUT PARKING KIND OF SPREAD THROUGHOUT THE SITE, UH, BASED ON THE EIGHT, THE 70% LIMIT OR PERSON LIMITATION, UH, THIS USE WOULD BE REQUIRED TO HAVE 18 SPACES.

UH, THE EXISTING USES IN THE CENTER ONLY USE ABOUT 90 OF THE 122 SPACES.

THERE'S PLENTY, PLENTY OF PARKING, UH, FOR THESE, FOR THIS KIND OF USE.

AND THEY, IN ADDITION TO HAVING SOME ADDITIONAL, ADDITIONAL, UM, UM, UH, PARKING IF NEEDED, UH, THE, THERE ARE SEVERAL PERFORMANCE STANDARDS IN THE ZONING ORDINANCE WHEN IT COMES TO COMMERCIAL RECEPTION HALLS.

UM, AS YOU CAN QUITE UNDERSTAND, BECAUSE SOMETIMES THEY CAN MAKE A LOT OF NOISE AND THINGS OF THAT NATURE.

SO ONE OF THE REQUIREMENTS IS THAT THE PRINCIPAL AND SERVICE ENTRANCES HAVE TO BE ORIENTED AWAY FROM RESIDENTIAL DEVELOPMENT.

IT EITHER HAS TO BE 200 FEET AWAY, OR IF IT'S WITHIN OR WITHIN A HUNDRED FEET THEN HAS TO BE LANDSCAPED AND SOME FENCING.

AND SO THAT'S WHY WE'VE PUT THE CONDITION IN THERE TO PUT THAT BECAUSE THOSE REAR DOORS ARE ABOUT 101 FEET AWAY FROM THOSE CONDOMINIUMS. SO WE WOULD WANT TO MAKE SURE THAT THEY'RE PROTECTED.

WE'VE ALSO PUT A CONDITION IN THERE THAT THOSE REAR DOORS CAN ONLY BE USED FOR EMERGENCY INGRESS AND EGRESS.

UH, SHE'S GOT, SHE GAVE US A LOT OF INFORMATION ABOUT WHAT SHE WANTS PLANS TO INSTALL, TO MAKE SURE THAT HAPPENS.

AND SHE WILL ALSO HAVE ONSITE SECURITY WHO WILL BE THERE TO MONITOR ANYTHING THAT'S GOING ON IN THE PARKING LOT.

AND INSIDE THE BUILDING, LASTLY, PERFORMANCE STANDARD WISE IS THE HOURS OF OPERATION.

THE ZONING ORDINANCE SAYS IT CAN BE OPERATED FROM 6:00 AM TO 10:00 PM AND MUST CLOSE BY 11, BUT YOU AS THE BOARD HAVE THE RIGHT TO ADJUST THAT.

AND THE APPLICANT IS REQUESTING, UH, SOME SLIGHT CHANGES TO THAT.

SO SUNDAY THROUGH THURSDAY, SHE WILL STAY.

SHE WILL BE OPEN ONLY DURING THOSE TIMES AS THE ZONING ORDINANCE STATES, BUT ON FRIDAY AND SATURDAY, SHE WOULD LIKE TO HAVE ANOTHER HALF HOUR, UM, AND HAVE EVERYBODY OUT OF THE BUILDING BY 1230 AT THE LATEST, UH, THIS USE WOULD FILL AN EMPTY SPACE IN A SHOPPING CENTER.

THAT'S BEEN TRYING TO, UH, GET FILLED OVER THE LAST SEVERAL YEARS SINCE 2013, WHEN THEY MADE THESE CHANGES, UH, WE FEEL LIKE IT WOULD THE PROPOSED IMPROVEMENTS.

SHE PLANS TO MAKE INSIDE, ALONG WITH PUTTING IN THE ADDITIONAL BUFFERING AND LANDSCAPING BETWEEN THE CONDOMINIUMS IN HAVING ONSITE STAFF WILL REALLY HELP THIS USE TO BE A GOOD NEIGHBOR TO THE RESIDENTIAL COMPONENT.

SO WE ARE RECOMMENDING APPROVAL THROUGH RESOLUTION.

YOU CAN SEE THAT IT'S ANGULAR AS OPPOSED TO CURB.

AND SO IN ORDER TO, UM, TO, TO CLARIFY TITLE, WHAT I'M RECOMMENDING IS THAT MR. BIRD QUIT CLAIM TO THE COUNTY, EVERYTHING ON THE COUNTY SIDE OF THIS SURVEY LINE AND THE COUNTY QUITCLAIM CLAIM TO MR. BIRD, EVERYTHING ON HIS SIDE OF THE, OF THE SURVEY LINE.
