THE CODE OF CONDUCT, VIRGINIA REQUIRES LOCAL GOVERNMENTS TO HAVE A PLANNING COMMISSION.

THE PURPOSE OF WHICH IS TO ADVISE THE BOARD OF SUPERVISORS ON LAND USE AND PLANNING ISSUES AFFECTING THE COUNTY.

THE RESPONSIBILITY IT'S EXERCISE THROUGH RECOMMENDATIONS, CONVEYED BY RESOLUTIONS OR OTHER OFFICIAL MEANS AND ALL ARE MATTERS OF PUBLIC RECORD.

THE COMMISSION IS COMPRISED OF CITIZEN VOLUNTEERS APPOINTED BY THE BOARD REPRESENTING EACH VOTING DISTRICT.

THIS APPLICATION IS REQUEST TO REZONE A 0.4 ACRE PARCEL AT 70 37 BAD CREEK ROAD FROM RURAL RESIDENTIAL TO WATER ORIENTED COMMERCIAL INDUSTRIAL.

THE PARCEL IS OUTLINED IN PURPLE ON THE ZONING MAP HERE, THE APPLICANTS, THE LANGS PURCHASE, THE PROPERTY AND THE MILLS MARINA PROPERTY ALSO SHOWN ON THE MAP HERE.

UM, BACK IN 2018, UH, THEY PURCHASED THE TWO PROPERTIES TOGETHER AND THEY OWN THE BOWS.

UH, THEY'RE SEEKING TO REZONE THE, UH, UH, THE SUBJECT, UH, PARCEL, WHICH, UH, IS OUR, OUR, UH, THE MILLS MARINA PROPERTY IS WATER COUNTRY, WATER, WATER ORIENTED, COMMERCIAL, INDUSTRIAL, UH, SURROUNDING PROPERTIES WITH A MIX OF RURAL RESIDENTIAL AND WCI.

BUT, UH, ON THE WEST SIDE OF BECK ROAD, IT'S ALL RURAL RESIDENTIAL CONFERENCE PLAN DESIGNATES, UH, UH, THIS PROPERTY AND THE SURROUNDING PROPERTY TO THE NORTH AND HAS LIMITED BUSINESS.

THE LIMITED BUSINESS DESIGNATION, UH, AS YOU KNOW, UH, IS FOR, UH, COMMERCIAL ACTIVITIES.

WELL, THERE ARE TWO KINDS OF CATEGORY, TWO CATEGORIES.

ONE IS COMMERCIAL ACTIVITIES THAT CAN BE COMPATIBLE WITH RESIDENTIAL ACTIVITIES.

THE OTHER IS SPECIFICALLY FOR AREAS LIKE THIS, UH, ERA WATER ORIENTED KINDS OF BUSINESSES, EXCUSE ME, UM, THAT ARE LOCATED IN LARGELY RESIDENTIAL AREAS AS IS THE CASE HERE.

UH, THE APPLICANTS INTEND TO, UH, DEMOLISH THE BUILDING.

WHAT THEY WANT TO DO IS USE THIS PROPERTY FOR, UH, UH, PARKING OF BOATS AND EQUIPMENT IN CONNECTION WITH, UH, MILLS MARINA, UH, UP THE ROAD, WHICH I MENTIONED, UH, THAT THEY ALSO, UM, UH, AS I SAID, THEY PLANNED TO DEMOLISH THIS BUILDING AND PUT UP A METAL GARAGE BUILDING, UH, IN WHICH BOATS WOULD BE PARKED, UH, PRETTY MUCH COVERED ALL THIS BOAT EQUIPMENT PARKING ABOUT A 2,400 SQUARE FOOT GARAGE BUILDING.

UH, THEY HAVE PROFFERED, UH, AS CONDITIONAL REZONING TO, UH, PROHIBIT CERTAIN USES, UH, THAT WOULD OTHERWISE BE ALLOWED IN THE WCI DISTRICT.

AND, UH, THIS IS IMPORTANT BECAUSE THE SURROUNDING PROPERTY IS, UH, ALL RESIDENTIAL AND THERE ARE CERTAIN MORE INTENSIVE KINDS OF WCI USES THAT YOU WOULDN'T WANT, UH, NECESSARILY, UH, IN A RESIDENTIAL AREAS, SUCH AS BAIT TACKLE, MARINE SHOP, GROCERY SALES, THEY HAVE THAT AT MILLS MARINA.

THEY DON'T NEED ANOTHER ONE, A FISH SEAFOOD STORE, A SMALL ENGINE REPAIR BOAT, SALES SERVICE, RENTAL BOAT REPAIR.

AND THAT'S IMPORTANT BECAUSE WHAT GENERATED THIS APPLICATION, UH, UH, SOMEBODY, UH, THERE WAS A COMPLAINT, UH, ABOUT, UH, SOMEBODY, ONE OF THE BOAT OWNERS APPARENTLY WAS, WAS ON THE PROPERTY DOING SOME WORK ON HIS BOAT.

AND, UH, SOMEBODY CALLED HER THE ZONING OFFICE.

UH, AND THAT'S WHAT INITIATED, UH, THIS APPLICATION, UH, TO BRING THE, UH, THE PROPER ZONING TO WCI BOAT REPAIR SERVICING STILL WOULD NOT BE PERMITTED, UH, BUT BOAT PARKING WOULD, AND THERE'S BASICALLY NOTHING ELSE THAT'S PERMITTED BY, RIGHT.

AND WCI, UH, THAT HASN'T BEEN PROFFERED OUT AND WITH THE EXCEPTION OF DOCKS AND MARINAS, AND OBVIOUSLY IT'S NOT A WATERFRONT PARCEL, YOU COULDN'T HAVE A DOCK MARINA.

SO, UH, IT'S, IT'S PRETTY RESTRICTIVE AS FAR AS THE PROFITS GO, UM, BECAUSE IT WOULD BE A WCI PROPERTY ADJACENT TO OUR, OUR, THERE WOULD BE SOME TRANSITIONAL BUFFERS REQUIRED, UH, AS YOU SAW FROM THE AERIAL PHOTO, THERE'S BASICALLY NO LANDSCAPING OUT THERE AT ALL.

UH, SO THERE WOULD BE A 12 AND A HALF FOOT, UH, LANDSCAPE BUFFERS WOULD HAVE TO BE PLANTED ON THE TWO SIDE PROPERTY LINES AND ALSO THE REAR PROPERTY LINE, UH, TO THE FRONT.

THERE WOULD BE THE USUAL 20 FOOT LANDSCAPE YARD, UH, REQUIRED.

UH, SO AS I STATED, THE APPLICATION IS CONSISTENT WITH THE COMP PLAN.

UM, NOTHING REALLY NEW GOING ON HERE.

UH, THE BOATS HAD BEEN ON THAT PROPERTY JUDGING FROM THE AERIAL PHOTOGRAPHY, UH, AT LEAST FOR THE LAST 20 YEARS.

UH, THE LANDSCAPE BUFFERS, UH, WILL PROVIDE A MORE AESTHETICALLY ATTRACTIVE, UH, PROPERTY AND PROVIDE SOME SCREENINGS, SOME BUFFERING, UH, BETWEEN THE BOATS AND THE, UH, RESIDENTIAL PROPERTY ADJACENT.

AND SO WE RECOMMEND APPROVAL OF THE APPLICATION THROUGH THE ADOPTION OF RESOLUTION PC 21 DASH 12.

WE DID NOT RECEIVE ANY EMAIL COMMENTS ON THE APPLICATION.

I DID RECEIVE A PHONE CALL TODAY FROM A GENTLEMAN WHO LIVES ON THE OTHER SIDE OF BACK CREEK ROAD, UM, JUST ABOUT TWO OR THREE HOUSES DOWN FROM THIS PROPERTY.

AND HE INDICATED THAT HE HAD NO PROBLEM WITH THE PROPOSED REZONING.

AND HE SAID THAT THERE HAD BEEN NO BOATS ON A PROPERTY, UH, FOR AS LONG AS HE CAN REMEMBER.

UM, I BELIEVE THE LANG'S ARE HERE TO SPEAK ON THEIR BEHALF.

IT'S HARD TO TELL WHAT THESE MASKS, UM, AND I'D BE HAPPY TO TAKE ANY QUESTIONS YOU MIGHT HAVE FOR ME AT THIS TIME.

ANY QUESTIONS FOR MS. CROSS ONE QUESTION YOU'VE MENTIONED THE FRONT BEING LANDSCAPED, IS THERE A SIZE OF A OPENING OR DRIVE THAT CAN COME IN THERE? THE PLAN SHOWED MOST ALL OF IT WAS DRIVEWAY GOING IN.

YEAH.

UH, PROBABLY HAVE NARROW THAT ENTRANCE SOMEWHAT, BUT OF COURSE IT HAS TO BE WIDER TO ALLOW THOSE BIG, UH, YOU SAW IT IN THE PICTURE.

SOME OF THOSE BOATS ARE PRETTY BIG.

UM, THERE IS, UH, A LOT OF LANDS OF GRAVEL, UH, OUT THERE.

UH, AND SO OBVIOUSLY SOME OF THAT'S GOING TO HAVE TO COME UP, UH, FOR THE LANDSCAPING.

UH, WHEN I WENT OUT THERE TO POST THE SIGN, IT, IT TOOK US 10 MINUTES TO FIND A SPOT IN THE GROUND WHERE WE COULD POST A SIGN BECAUSE IT'S JUST GRAVEL THROUGHOUT.

SO A PORTION OF THAT'S GOING TO HAVE TO BE REMOVED.

THERE IS AN OPPORTUNITY, UH, TO, UH, TO DEVIATE FROM THAT REQUIREMENT, UH, TO HAVE OFFSITE PARKING ARRANGEMENT SUCH AS THIS.

AND SO THIS WOULD BE, UH, IF THE APPLICATION IS APPROVED, THIS WOULD BE PERMITTED.

THIS PROPERTY IS BECAUSE WE HAVE LACK PARKING OF THE MARINA DURING THE BUSINESS HOURS, ESPECIALLY ON WEEKENDS.

SO WE NEED THE EXTRA PARKING IN ORDER TO ACCOMMODATE ALL OUR CUSTOMERS.

UM, I DID AGREE TO NO LONGER REPAIR BOATS ON THE PROPERTY, AS LONG AS WE CAN PARK THEM AND NOT HAVE ANY ISSUES WITH ANY OF THE NEIGHBORS.

UM, ALSO WE WOULD LIKE TO PUT A 40 BY 60 GARAGE UP SO THAT OUR EQUIPMENT COULD STAY IN INDOORS VERSUS BEING OUTSIDE AND IN THE, UH, ELEMENTS, UH, WHICH WOULD ALSO GIVE US MORE PARKING AROUND THE MARINA.

ALSO, UM, WE DO CURRENTLY PARK THE VEHICLES ON THAT PROPERTY BECAUSE THEY ARE REGISTERED AND THEY ARE ON WHEELS CURRENTLY.

SO, UM, IN ORDER TO PUT THE BUILDING UP, I'D HAVE TO, UH, DECONSTRUCT THE, THE, THE BUILDING THAT'S ON THERE NOW, UM, WHICH I BELIEVE WOULD ALLOW US A LITTLE BIT MORE PARKING TO, UM, AS FAR AS THE LANDSCAPING, I WAS SPEAKING WITH ONE OF THE NEIGHBORS AND THEY WERE KIND OF CONCERNED ABOUT THE LANDSCAPING AND THEY WOULD PREFER A PRIVACY FENCE.

I'M NOT SURE IF THAT'S SOMETHING THAT WE COULD DO VERSUS THE LANDSCAPING.

UM, I FIGURED WE COULD WORK THAT OUT EITHER TONIGHT OR, UH, DOWN THE ROAD, THERE'S THE CROSS PRESENTATION.

UM, SO, UH, YOU KNOW, WE, WE BOUGHT MILL'S MARINA IN DECEMBER OF 2018.

WE DID NOT ANTICIPATE ON GETTING AS BUSY AS WE DID.

COMMUNITY HAS BEEN EXCELLENT, VERY SUPPORTIVE IN EVERYTHING THAT WE'VE DONE AT MILLS MARINA.

UM, AND WE'VE GROWN SO FAST, UM, WHICH IS BECAUSE OF OUR CUSTOMER BASE.

SO WE WOULD LIKE TO CONTINUE TO GROW IN ORDER TO DO THAT.

WE'RE DEFINITELY GOING TO NEED MORE PARKING.

SO THIS WOULD BE A GREAT ASSET TO MILL'S MARINA AS WELL.

UM, I HAVE NOTHING ELSE.

CAN YOU ADDRESS TO ADDRESS THAT QUESTION IF YOU WENT THROUGH? OKAY.

UM, THERE'S NOTHING TO PROHIBIT MR. LANG FROM INSTALLING A PRIVACY FENCE, BUT THE TRANSITIONAL BUFFER IS AN ORDINANCE REQUIREMENT.

SO IT WOULD HAVE TO BE PROVIDED, UH, EVEN WITH THE PRIVACY FENCE AND THE BUFFER WOULD HAVE TO BE, UH, ON THE OUTSIDE THERE'S, SINCE THIS IS A REZONING AND NOT A USE PERMIT, WE DO NOT HAVE THE ABILITY TO MAKE THAT A CONDITION OF APPROVAL.

IF, UH, THE APPLICANT HAS THE OPPORTUNITY, IF THEY WANT TO, TO PROFFER TO BUILD A PRIVACY FENCE, IF THAT IS THEIR DESIRE, BUT THERE'S NO WAY SUSIE REZONING PROCESS THAT, UH, THE COMMISSION AND THE BOARD CAN COMPEL THAT IT WOULD HAVE TO BE VOLUNTARILY PROPER, BUT THEY'D STILL HAVE TO HAVE IT AS A BUFFER WOULD STILL BE THE LANDSCAPE BUFFER WOULD STILL BE READING.

IS THERE ANY, IS EVERYBODY WHO'S TALKING, I'M JUST GOING TO SPEAK FOR A MOMENT WITH THE GRAVEL THAT YOU TALKED ABOUT AND, AND TRYING TO KEEP PLANTS GROWING.

UM, I'M NOT SURE WHETHER IT'S WAY BEYOND MY EXPERTISE IS PROBABLY NOT IN THIS COMMISSION'S PURVIEW TO, TO ADDRESS THAT.

BUT I WOULD HOPEFULLY THAT I THINK THERE'S A COUNTY BOARD OR, OR SOMETHING THAT TALKS ABOUT, UH, WETLANDS AND THOSE KINDS OF THINGS.

WE'VE IMPLEMENTED THAT JUST BY MAKING IT A STANDARD CONDITION OF APPROVAL WITH ALL THE RECENT TOURIST HOME APPLICATIONS WE'VE HAD.

UM, I CAME AWAY SOMEWHAT, UM, SHOCKED THAT WE HAVE ALLOWED THAT DEVELOPMENT TO TAKE PLACE, UH, AND ALLOWED BASICALLY THAT ROAD TO BE UTILIZED FOR ALL THE CONSTRUCTION ACTIVITY, VERY NARROW, VERY SUBSTANDARD ROAD AND A, AND A VERY DISADVANTAGED I WOULD CALL, UM, ECONOMICALLY CHALLENGED COMMUNITY THAT LIVES ALONG THAT ROAD.

IT, IT LED ME TO TWO CONCLUSIONS.

ONE, AS WE LOOK INTO THE FUTURE DEVELOPMENTS, WE REALLY NEED TO BE AWARE OF ANY, UM, EXISTING COMMUNITIES, UH, PARTICULARLY DISADVANTAGED OR IN THIS CASE, A PREDOMINANTLY BLACK COMMUNITY, UM, THAT WE ARE CONSIDERING THEIR BEST INTERESTS AND THAT WE PUT MITIGATION STEPS IN PLACE TO PREVENT THE KIND OF, UH, ABUSE THAT APPEARS TO BE TAKING PLACE RIGHT NOW.

SO THAT WAS, THAT WAS ONE CONSIDERATION.

THE SECOND ITEM THAT REALLY CAME OUT OF THAT, THE SECOND INSIGHT, I SUPPOSE YOU WOULD CALL IT, IT'S REALLY DIRECTED TOWARDS COMMISSIONER KING AND HE'S NOT HERE TONIGHT, BUT I'M SURE HE'LL READ THE MINUTES.

WE REALLY NEED TO PUT SOME LANGUAGE IN THERE AROUND, UH, AFFORDABLE USE HOUSING OR AFFORDABLE HOUSING AND HOW WE PROTECT THE EXISTING AFFORDABLE HOUSING IN THIS COUNTY, PARTICULARLY, UH, IN AREAS WHERE THERE'S A DEVELOPMENT PLAN TO IMMEDIATELY ADJACENT OR NEXT TO IT, WHAT STEPS OR WHAT, UH, PROVISIONS SHOULD WE BE LOOKING AT, OR WHAT SHOULD WE HAVE IN PLACE? I THINK THAT REALLY NEEDS TO BE SPELLED OUT IN THE COMPREHENSIVE PLAN.
