NOW, AS YOU INDICATED TONIGHT, WE WANTED TO JUST TAKE A FEW MINUTES TO RECOGNIZE THE ACCOMPLISHMENTS OF ONE CURRENT AND ONE FORMER, UH, PLANNING COMMISSION MEMBER.

I'M SURE YOU ALL REMEMBER AND RECOGNIZE DON PHILLIPS, UH, BACK HERE, FORMER COMMISSIONER FROM DISTRICT THREE, UH, DR.

PHILLIPS, HIS TERM AS THE DISTRICT THREE COMMISSIONER, UH, ENDED A YEAR AGO, BUT BECAUSE OF THE PANDEMIC, WE WERE NEVER ABLE TO PROPERLY, UH, RECOGNIZE HIM FOR HIS SERVICE.

YOU CAN SEE THE DATES, UH, OF HIS SERVICE ON THE COMMISSION, ON THE SCREEN UP THERE, BUT ACTUALLY HIS INTEREST AND INVOLVEMENT IN PLANNING AND DEVELOPMENT IN YORK COUNTY, IT GOES BACK A LOT FARTHER.

UH, IN FACT, IT SPANS SEVERAL DECADES LONG BEFORE HE JOINED THE PLANNING COMMISSION.

UH, HE WAS A FAMILIAR FACE AT BOTH COMMISSION AND BOARDS OF SUPERVISORS MEETINGS SPEAKING OUT ON VARIOUS DEVELOPMENT PROPOSALS THAT CAME BEFORE THE COUNTY.

IN FACT, UH, I HAPPEN TO BE GOING THROUGH SOME OLD RECORDS ON COVENTRY THE OTHER DAY, AND THERE HE WAS IN THE 1987 BY A BOARD OF SUPERVISORS MINUTES, UH, GIVING HIS, UH, OPINIONS ON THAT DEVELOPMENT.

UH, SO HE HAS BEEN ACTIVE AND INVOLVED FOR A LONG, LONG TIME, UH, AS BOTH A CITIZEN AND A COMMISSIONER, HE HAS BEEN A CONSISTENT PASSIONATE ADVOCATE FOR MANAGED GROWTH AND ENVIRONMENTAL PROTECTION, ALWAYS LOOKING FOR THAT DELICATE BALANCE AMONG PRIVATE PROPERTY RIGHTS, THE PUBLIC GOOD AND RESPONSIBLE STEWARDSHIP OF OUR NATURAL RESOURCES.

UH, SO WITH THAT, I'D LIKE TO TURN IT BACK OVER TO YOU, MR. CHAIRMAN.

ARE WE ON CONGRATULATIONS? UM, I HAVE TO SAY, UH, I'VE BEEN ON THE COMMISSION FOR ALMOST SIX YEARS AND WHEN I FIRST CAME ON THE COMMISSION, I SAT RIGHT NEXT TO YOU.

AND WHEN YOU'RE SITTING TO, UH, DR.

PHILLIPS HERE NEXT TO HIM, AND YOU'RE HEARING ALL THE WISDOM THAT, THAT, UH, UH,

HE SPEAKING DURING THE MEETING, YOU'RE THINKING YOU'RE VERY INTIMIDATED.

THE FORTUNATE THING WAS, IS THAT I WAS ON THE END BECAUSE I WAS NEW AND I GOT TO HEAR DON'S WISDOM BEFORE I HAD A CHANCE TO, UH, EXPRESS MY OPINION.

SO I GOT TO SAY YOU CHANGED A LOT OF, UH, OPINIONS THAT I HAD BY, UM, BY YOUR EXPERIENCE, YOUR WISDOM, YOUR KNOWLEDGE, DON, ALWAYS SPECIALIZED IN SAFETY.

THE ENVIRONMENT CLIMATE CHANGE, UH, WAS A REAL ADVOCATE FOR ALL THOSE SUBJECTS.

AND DON, I MISS YOU.

AND CONGRATULATIONS, PICTURE OVER HERE.

I WANT TO THANK THE COMMISSION FOR THIS PRESENTATION.

AND I WANT TO NOTE THAT I REALLY ENJOYED SERVING ON THE COMMISSION WITH MOST OF YOU AND, UH, THAT, UM, DISCUSSING AND DEBATING LAND USE ISSUES.

IT'S AN IMPORTANT THING YOU DO DO FOR THE COUNTY AND AS A, AS A PRIVATE CITIZEN.

THIS IS HIS TERM EXPIRES, UH, AT THE END OR THE END OF THIS MONTH.

UH, MR. JOHNS HAS ACTUALLY SERVED TWO TOURS OF DUTY ON THE COMMISSION.

UH, FIRST FOR SIX YEARS IN THE NINETIES AS THE DISTRICT ONE OR DISTRICT TWO REPRESENTATIVE BACK THEN DISTRICT WHO ACTUALLY STRETCHED ALL THE WAY FROM THE UPPER COUNTY DOWN TO, UH, BETHEL MATTER.

UH, AND SO, AND THEN AGAIN, HE SERVED, HE HAD SERVED FOR THE PAST SEVEN YEARS AS THE DISTRICT ONE REPRESENTATIVE, ULTIMATELY SERVING A TOTAL OF MORE THAN 13 YEARS, WHICH IS CERTAINLY A RECORD IN THE 32 YEARS THAT I'VE BEEN HERE.

I DON'T KNOW IF IT'S AN ALL TIME RECORD, BUT IT VERY GOOD CHANCE THAT IT, THAT IT IS.

UH, AND THAT INCLUDES TWO TERMS AS CHAIRMAN.

UH, HE ALSO SERVED ON OUR COMPREHENSIVE PLAN REVIEW STEERING COMMITTEE BACK IN THE MID TO LATE NINETIES.

AND TODAY SERVES AS THE VICE CHAIRMAN OF OUR CURRENT, UH, COMP PLAN STEERING COMMITTEE FOR MUCH OF HIS TIME ON THE COMMISSION, PARTICULARLY HIS SECOND STINT, UH, MR. JOHNS WAS THE ONLY MEMBER FROM THE UPPER COUNTY AND HE HAS ALWAYS MADE SURE THAT PART, THAT, THAT PART OF THE COUNTY WAS WELL REPRESENTED THROUGH IT.

ALL.

HE HAS MAINTAINED A LASER-LIKE FOCUS ON COMMUNITY OUTREACH AND CITIZEN ENGAGEMENT AND ENSURING THAT ALL VOICES ARE HEARD.

YEAH.

OKAY.

WELL, THE STORY ABOUT, ABOUT MANI 25 YEARS AGO, I WAS WORKING HERE IN THE COUNTY IN 1995 AND, UH, MANI WAS ON THE PLANNING COMMISSION AND, UH, NOT ONE TO LET ANYONE IGNORE THE, UH, INTEREST OF THE UPPER COUNTY.

WE WERE IN A COMP PLAN MEETING.

AND I REMEMBER ONE OF THE OTHER COMMISSIONERS OR COMMITTEE MEMBERS, UH, WERE, WAS TRYING TO SWAY EVERYBODY'S OPINION TO APPROVE SOME ARE TO RECOMMEND A CERTAIN POLICY.

AND THAT INDIVIDUAL ASKED, UH, MANI SAID, MANI, I NEED YOUR HELP.

I NEED YOU TO SUPPORT ME MANI DIDN'T AGREE WITH THEM AND JUST STOOD UP AND SAID, NO, I'M NOT, I'M NOT SUPPORTING YOU, MAN.

I'M NOT GOING ALONG WITH IT.

AND BECAUSE IT WASN'T GOOD FOR THE UPPER COUNTY AND YOU'VE BEEN STEADFAST, UH, THE WHOLE TIME, UH, WHEN I CAME ON TO COMMISSION SIX YEARS AGO, UH, MY FIRST QUESTION WITH MR. CROSS WAS, I COULDN'T BELIEVE MANI WAS STILL ON A COMMISSION BECAUSE HE WAS THERE 25 YEARS AGO.

UH, OF COURSE I KNOW NOW THAT YOU HAD A LARGE GAP IN THERE BETWEEN ONE THING MANI ALWAYS DID ON THE COMMISSION, WHICH I APPRECIATED.

AND I THINK OUR FELLOW COMMISSIONERS UNDERSTAND THIS, ALWAYS WENT TO VISIT, UH, THE PUBLIC HEARING ITEM.

TALK TO NEIGHBORS, TALK TO PEOPLE IN A STORE, REALLY GOT A COMPLETE BACKGROUND FROM A CITIZEN POINT OF VIEW, THEN BROUGHT THOSE VIEWS TO

THE COMMISSION AND SHARED THEM WITH US THE PUBLIC, AND IT MADE A DIFFERENCE AND MANI, WE'RE GOING TO MISS YOU AND CONGRATULATIONS.

I, I DON'T KNOW WHAT I WAS THINKING WHEN I CAME ON HERE, BUT I WILL TELL YOU MY, MY REASON FOR SERVING WAS FOR LOVE OF THIS COUNTY.

I APPRECIATE THE BOARD GIVING ME THE OPPORTUNITY TO SERVE THE CITIZENS, UH, WHO BELIEVED IN ME AND SOME OF THOSE WHO, WHO DIDN'T, YOU KNOW, THAT GOES WITH THE TERRITORY.

YOU GOTTA STAY IN THE KITCHEN, EVEN WHEN IT'S HOT.

AND SO I CALLED THAT MY SUMMER VACATION.

SOME SOMETIMES, UH, I'VE NEVER BEEN GOOD AT MATH.

SO, UH, IF YOU DON'T THINK I'M TELLING YOU THE TRUTH, I'LL SAY THAT I WAS 25 WHEN I CAME HERE, BUT I TOLD HIM THAT'S THE STORY ON THAT, BUT LISTEN, IT'S BEEN GOOD.

UM, I'M STILL GOING TO DO SOME OTHER THINGS.

WALLACE HAS BEEN OPERATING FROM HIS LOCATION ON HAMPTON HIGHWAY SINCE AROUND 1989.

UM, AND HE WISHES TO BUILD A LARGER FACILITY ACROSS THE ROAD.

THIS IS HIS EXISTING, UM, STRUCTURE NOW, UM, THE NEW BUILDING WOULD ALLOW HIM TO CON WOULD ALLOW HIM TO ADD MORE STAFF, UM, BUT ALSO CONTINUE THE THINGS HE ALREADY OFFERS LIKE MEDICAL AND SURGICAL SERVICES AND LIMITED BOARDING ACTIVITY.

UH, HIS CURRENT, UM, OPERATION IS FROM 7:00 AM TO 6:00 PM ON MONDAY THROUGH FRIDAY AND 8:00 AM TO 12:00 PM ON SATURDAY.

UH, THEY ARE CLOSED ON SUNDAY, BUT THEY DO HAVE A SMALL NUMBER OF EMPLOYEES THAT COME TO THE SITE FOR THE BOARDING ACTIVITIES.

SO THEY WILL HAVE EMPLOYEES ONSITE DURING, UM, SUNDAY HOURS.

UH, THIS IS THE PLAN THAT THEY SUBMITTED.

IT IS, IT DOES SHOW ABOUT A 7,200 SQUARE FOOT BUILDING, UH, PARKING ALONGSIDE THE BUILDING, PARKING OUT FRONT, UH, CIRCULAR ENTRYWAY.

AND THEN TO THE BACK, THEY ARE SHOWING AN EXERCISE YARD.

UH, THIS IS A PICTURE OF THE CURRENT EXERCISE YARD.

SO WHILE WE WERE OUT THERE, WE, WE WENT AROUND AND TOOK SOME PICTURES JUST TO, YOU COULD SEE, UH, THEY RUN A VERY CLEAN OPERATION.

UH, THERE'S NOTHING BACK THERE.

UH, THIS IS A USED PROPOSED WITHOUT OUTSIDE RUNS, BUT IT DOES HAVE AN EXERCISE YARD.

SO THE DIFFERENCE BETWEEN RUNS AND AN EXERCISE YARD RUNS ARE USUALLY CHAIN-LINK AREAS WHERE THERE'S A HOLE IN THE BUILDING.

THE ANIMALS RELEASED CAN RUN OUT THERE WITHOUT ANY KIND OF SUPERVISION.

UH, THE EXERCISE YARDS, UH, WOULD REQUIRE SUPERVISION.

SO THEY WOULD HAVE STAFF OUT THERE AT ALL TIMES MONITORING ANY ANIMALS THAT ARE OUT THERE CLEANING UP AND THINGS OF THAT NATURE.

UH, WE DO, UH, TREAT IT A BIT DIFFERENTLY WITH THIS, UH, BECAUSE IT IS SUPERVISED, UM, AND THE EMPLOYEES ARE THERE TO BE ABLE TO CONTROL WHAT GOES ON ONLY ORDINANCE DOES REQUIRE, UH, THESE KINDS OF USES TO HAVE ADEQUATE SOUNDPROOFING AND TO BE CONSTRUCTED SO THAT THERE ARE NO EMISSIONS OF ODORS OR NOISE.

UM, SPECIFICALLY WHENEVER IT'S WITHIN 200 FEET OF A RESIDENTIAL PROPERTY LINE.

AND AS I SHOWED YOU, THIS IS PRETTY MUCH SURROUNDED BY PD.

SO IT DOES FALL WITHIN THAT 200 FEET.

UH, THE EXERCISE YARD MAY HAVE TO MOVE A LITTLE FURTHER BACK AND OVER SOMEWHAT JUST DEPENDING ON HOW, UM, THAT 200 FEET PLAYS IN THERE.

UH, BUT AGAIN, THIS IS JUST A SKETCH PLAN FOR THE OVERALL USE.

UH, BUT THE BUILDING WILL HAVE TO BE SOUNDPROOFED.

UM, THEY WILL HAVE TO, UH, BRING FORWARD A WASTE MANAGEMENT PLAN.

THAT'LL SHOW HOW THEY PLAN TO DO WHAT THEY PLAN TO DO WITH ANY OUTSIDE, UH, FECES THAT ARE LEFT, CLEAN UP THINGS OF THAT NATURE SO THAT THEY CAN MAINTAIN, UM, UH, A, UM, AN AREA THAT IS NOT EMITTING ODOR OR NOISE, BUT W W WE DID VISIT HIS CURRENT LOCATION.

AS I SAID, I SHOWED YOU THE PICTURE AND WE DIDN'T, WE DIDN'T JEANNIE.

AND I WERE THERE NEITHER ONE OF US SMELLED ANYTHING OR EVEN SAW ANYTHING ON THE PROPERTY.

SO IT LOOKED VERY, VERY, WELL-MADE MAINTAINED, UH, JUST A LITTLE QUICK, UH, UNDERSTANDING OF LIMITED BUSINESS CAUSE WE DON'T SEE IT VERY OFTEN.

UH, ONE OF THE BIG PIECES THAT WITH WHEN YOU'RE, UM, YOU HAVE DIFFERENT ZONING CLASSIFICATIONS, WHERE HERE YOU HAVE A BUSINESS CLASS FEE CATION UP AGAINST A RESIDENTIAL CLASSIFICATION, UH, THERE'S A REQUIRED TRANSITIONAL BUFFER IN THOSE TIMES, UM, BETWEEN LB AND PD IS REQUIRES A 25, 25 FOOT TRANSITIONAL BUFFER AREA.

SO, UH, HE WILL HAVE TO MAINTAIN A TRANSITIONAL BUFFER ALONG ASCOT DRIVE THE BACK PROPERTY LINE AND THIS PROPERTY LINE ON THIS SIDE, UM, AND THAT ACROSS, UH, THERE IS A GREENBELT BUFFER HERE ON, UM, HAMPTON HIGHWAY, WHICH REQUIRES A 35 FOOT UNDISTURBED VEGETATIVE BUFFER.

SO WHAT HE HAS OUT THERE WILL HAVE TO REMAIN, UH, HE IS ALLOWED TO CLEAN IT UP SOME MAYBE, AND SOME ADDITIONAL PLANTINGS IN THERE, THINGS OF THAT NATURE.

UH, THE ONE THING WE LOOKED AT WHEN WE SAW THIS PLAN WAS EVEN THOUGH IT'S LIMITED BUSINESS TO THE WEST AND THAT'S A MOBILE HOME PARK, UH, WE DID FEEL WE WANTED TO PROVIDE SOME PROTECTION FOR THAT RESIDENTIAL USE, EVEN THOUGH IT'S NOT REQUIRED BY THE ZONING ORDINANCE, WHEN YOU HAVE LB AGAINST LB, THEY'RE THE SAME KIND OF ZONING, SO YOU DON'T REALLY NEED IT, BUT WE HAVE PROPOSED A CONDITION TO PUT A, A TYPE 25 FOOT TRANSITIONAL BUFFER ALONG THAT PROPERTY LINE ALSO TO HELP BUFFER AND SCREEN FOR THAT USE.

ADDITIONALLY, THE PARKING LOT IS SHOWN VERY CLOSE TO THE PROPERTY LINE.

SO WE ARE, UH, WE DID PUT A CONDITION IN THERE TO PUT A SIX FOOT BOARD ONBOARD PRIVACY FENCE TO RUN ALONG THAT PARKING LOT.

SO THAT LIGHTS AND STUFF WOULDN'T SHINE.

UM, YOU KNOW, IF THEY WERE THERE AT SIX O'CLOCK ON A WINTER DAY, UH, THOSE KINDS OF THINGS.

SO, UH, WE ARE TRYING TO PROVIDE SOME PROTECTION FOR THAT ADJACENT PROPERTY.

THE, UM, COMPREHENSIVE PLAN HAS OUR REGIONAL BIKEWAY MAP AND THESE YELLOW LINES ARE OUR BIKEWAYS.

UH, THEY ARE THE MULTI-USE PATHS THAT THE COMPREHENSIVE PLAN HAS APPROVED FOR THEM.

UH, SO IT DOES SHOW HAMPTON HIGHWAY HAVING A, UM, A MULTI-USE PATH ALONG IT.

UH, THIS IS A FUTURE PATH.

UM, WE HAVE, UH, PUT A CONDITION IN THERE THAT, UH, DR.

WALLACE WOULD GRANT US OR THE PROPERTY OWNER WOULD GRANT S A 20 FOOT EASEMENT ALONG HAMPTON HIGHWAY.

SO IN THE FUTURE, WHEN THAT BIKE LANE IS PUT IN, WE'LL HAVE THE SPACE TO START MAKING THOSE CONNECTIONS.

ONE, ONCE THEY GO THROUGH, I SHOWED YOU THE, UM, THE PATH THAT'S IN TO THE NORTH BACK THERE IN THE DOMINION POWER LINE, UM, THAT IS SHOWN AS A MULTI-USE PATH AND WHERE THE COUNTY IS WORKING NOW TO KIND OF MAKE THAT A LITTLE BIT LARGER OF A PATH AND MAKE SOME CONNECTIONS.

AND SO ANOTHER PIECE THAT WE WANTED TO DO WAS MAKE A CONNECTION BETWEEN THOSE TWO, UM, SO THE EXISTING AND THEN THE FUTURE.

SO WE HAVE ALSO, UM, ASKED FOR A CONDITION OF APPROVAL, BE PLACED IN THE RESOLUTION THAT WOULD REQUIRE A 20 FOOT EASEMENT ALONG ASCOT DRIVE THAT WE CAN MAKE THAT FUTURE CONNECTION, UM, UH, DOWN THE ROAD.

NOW THAT DOES IMPACT THE TWENTY-FIVE FOOT TRANSITIONAL BUFFER ON ASCOT DRIVE.

UH, BUT WE HAVE DONE THAT IN OTHER, OTHER PLACES.

SO WE WOULD HAVE 20 FEET OF EASEMENT, BUT THEN HE STILL HAS FIVE FEET WHERE HE CAN PUT HIS 25 FOOT TRANSITIONAL BUFFER IN.

AND WE'VE DONE THAT BEFORE WHERE YOU HAVE A SMALLER AREA, BUT YOU JUST INCREASE YOUR SCREENING IN THOSE AREA WITH PLANTINGS AND THINGS OF THAT NATURE.

SO IT IS DOABLE.

UM, AND THAT IS ONE OF THE THINGS THAT YOU'LL SEE IN THE CONDITIONS.

UH, THIS IS A VERY LOW IMPACT TRAFFIC GENERATOR, UH, 27 TRIPS IN THE MORNING, 25 IN THE EVENING, ASCOT DRIVE HANDLES ABOUT 1200 TRIPS A DAY, AND THERE IS NO, UM, DIRECT ACCESS ON HAMPTON HIGHWAY.

IT IS OFF ASCOT DRIVE THROUGH THOSE TWO ENTRANCES THAT HE WAS SHOWING ON HIS PLAN.

UH, PARKING REQUIREMENTS PLAN IS SHOWING ABOUT 41 BASIS RIGHT NOW.

UH, THE ORDINANCE REQUIRES ONE PARKING SPACE FOR EVERY 350 SQUARE FEET, UH, SUBTRACTING OUT ANY KENNEL SPACE AND THEN ADDING A SPACE FOR EVERY EXAM ROOM.

SINCE WE DON'T HAVE A FLOOR PLAN, WE CAN JUST KIND OF BASED OUR CALCULATION ON THE SQUARE FOOTAGE OF THE BUILDING.

UM, SO WE APPROXIMATED ABOUT 20 TO 22 SPACES.

SO HE'S OVER PARKED A LITTLE BIT RIGHT NOW.

SO HE MAY HAVE TO ADJUST THAT DEPENDING ON WHAT HIS PLAN WANTS TO BE.

UH, ONE WAS THE, UH, REDSIN COMPANIES REZONING ON HAMPTON HIGHWAY FROM OUR 22 GB, WHICH WAS DENIED.

AND THE OTHER IS, WAS THE, A USE PERMIT FOR A TOURIST HOME ON LAFAYETTE ROAD, WHICH WAS APPROVED.

UH, NEXT WEEK AT ITS JUNE 15TH MEETING.

THERE WERE THREE APPLICATIONS ON THE BOARD'S AGENDA.

ONE IS A USE PERMIT FOR THE CHESTER'S CONVENIENCE STORE EXPANSION ON ROUTE 17, THE, UH, TRIPLE FEATURE ASSOCIATES APPLICATION.

YOU REMEMBER THE COMMERCIAL PROPERTY BETWEEN BOJANGLES' AND YORKTOWN ARCH, UH, WHICH, UH, WHERE THE APPLICANT WAS PROPOSING TO AMEND THE PROFFERS AND ALSO THE, UH, VON MALL FROST SETBACK, VARIANCE, UH, IN YORKTOWN, UH, FOR A SINGLE FAMILY DETACHED HOME.

SO THOSE WILL ALL BE ON THE BOARD'S AGENDA FOR JUNE 15 AT YOUR NEXT MEETING, JULY 14TH.

UH, WE HAVE JUST ONE APPLICATION AND THAT IS FOR MOTORCYCLE SALES IN THE VILLAGE SQUARE AT KILLIN CREEK SHOPPING CENTER.

THERE'S A VACANT UNIT OUT THERE AND THEY WANT TO MOVE INTO IT.

THE EXECUTIVE DIRECTOR CAME AND TALKED ABOUT, UH, THEIR CURRENT PLANS, THEIR OPERATIONS, THINGS THAT ARE GOING ON.

UH, IT WAS A GREAT PRESENTATION.

UH, TOOK UP A GOOD
