7. Application No. ZT-164-15, York County Board of Supervisors: Proposal to amend the following sections of Chapter 24.1, Zoning, of the York County Code to incorporate changes made necessary by amendments to the Code of Virginia: • Sections 24.1-104 and 900: Change the definition of the term Variance and revise the standards and procedures by which they can be granted by the Board of Zoning Appeals, adding parcel shape and building height to the types of provisions that can be deviated from through the granting of a variance and changing the standard from “unnecessary or unreasonable hardship to the property owner” to “unreasonably restrict the utilization of the property.” • Section 24.1-114(d)(4): Remove the July 1, 2017 expiration date of a law that delays the payment of certain cash proffers until after the final inspection of the property and before the issuance of a certificate of occupancy. • Sec. 24.1-505: Specify that reviews of resubmitted site plans solely involving commercial land shall consider only the deficiencies identified in the initial plan review, deficiencies that arise as a result of corrections made to address deficiencies identified in the initial submission, material revisions of infrastructure or physical improvements from the earlier submission, and revisions requiring review by a state agency or public authority.

Application No. ST-22-15, York County Board of Supervisors: Proposal to amend Chapter 20.5, Subdivisions, of the York County Code to incorporate changes made necessary by amendments to the Code of Virginia. Changes are proposed in Sections 20.5-28, 29, and 30 to specify that reviews of resubmitted subdivision plans and plats solely involving commercial land shall consider only the deficiencies identified in the initial plan review and any deficiencies that arise as a result of corrections made to address deficiencies identified in the initial submission.
